FINANCIAL IMPACT: None. The First Amendment to the Design and Construction Agreement does not alter any of the financial terms. BACKGROUND: On December 19, 2005 the Redevelopment Agency executed a Design and Construction Agreement with the Bay Area Rapid Transit District (BART) and the Pleasant Hill Transit Village Associates, LLC (the "Developer"). The Developer is a partnership of Avalon Bay Communities and Millennium Partners. The Design and Construction Agreement relates to the construction of the BART replacement parking garage among the other things.
