APPROVE Amendment No. 1 to the Consulting Services Agreement dated September 12, 2006 with URS Corporation which would increase the payment limit by $39,573 from $36,000 to $75,573 for additional geotechnical consultation and earthwork testing and inspection services for the Contra Costa County District Attorney Office Building Project, 950 Ward Street, Martinez. 2. AUTHORIZE the Director of General Services, or designee, to execute the amendment. FINANCIAL IMPACT The additional services will be paid with Plant Acquisition funds (4405-4224). BACKGROUND The project involves constructing a new four-stories District Attorney Headquarters Building at the downtown Martinez site bounded by Las Juntas, Court, Green, and Ward Streets. The project commenced construction in November 2006, and foundation work is currently in progress. URS Corporation is providing geotechnical consultation and testing services during the site grading and foundation construction phases. . Additional services by URS are necessary due to unforeseen conditions in backfilling the basement area and during the tubex piles installation. The proposed amendment is necessary to cover the time and expense of the additional services. Effective Date and Parties: Effective March 6, 2007, URS Corporation (herein called "Consultant"), a California Corporation, and the County of Contra Costa(herein called"County"),a political subdivision of the State of California,mutually agree as follows: 2. Purpose: On September 12, 2006. the parties entered into a contract entitled "Consulting Services Agreement," referred to as the "Agreement," which provides geotechnical engineering consultation, field observation and testing services durin" site grading operations and foundation construction for the Contra Costa County District Attorney's Office [wilding Project. The parties desire to amend the Agreement to expand the scope of services and to increase the payment limit accordingly. 3. Amendments to Agreement: A. In the Agreement,Section I(c),change the Payment Limit fi-om$36,000.00 to 575,573.00,an increase of$39,573. This change shall apply to charges from and after February I,2007. B. In accordance with Section 14 of the Agreement provide the following: Provide additional services in accordance with the attached February 7,2007 proposal,which is made a part of Appendix A to the Agreement. 4. Effect: Subject to the revisions made by this amendment,the Agreement shall remain in full force and effect. 5. Kanzaria Contra Costa County General Services Department 1220 Morello Avenue, Suite 100 Martinez, California 94553 Subject: Request for Additional Budget: Field Observation and Testing Services District Attorney's (DA) Office Building Martinez, California Dear Mr. Kanzaria: URS has been performing the geotechnical engineering consultation, field observation and testing services for the construction of the proposed DA office building in Martinez, California. This request for additional budget being submitted to complete the remaining work as required in the scope of work dated July 31, 2006. In the original proposal, we stated, "the hours are only estimates; and could vary considerably depending on the construction schedule". The following are some of the reasons for requesting additional budget: 1. Following the completion of backfilling the basement area, a breakage of one of the pipes at the site occurred during the first weekend of November 2006 and resulted in flooding the site. The Contractor was instructed to remove the.backfill material and to recompact. This additional time (re-compaction) for supervision was not plaruled. 2. There are some occasions, the field inspector had to work on weekends and overtime on weekdays. Our original cost estimates did not include any overtime for the inspector as clearly noted in our cost estimate that we submitted to you with our original budget (note that, the field inspector gets 1.5 tunes his regular pay for overtime). The Tubex pile installation was slowed down considerably due to unforeseeable subsurface conditions. The review of pile logs suggests that more than 95%of the piles that were installed at the site met refusal. The process of checking whether the pile met refusal criteria slows down the installation process. The amount of time spent on review of Tubex pile installation process both in the field and office (more consulting) was much = more than we anticipated. 4. The pile load tests performed at the site indicated that the ultimate capacity values of the piles were lower than expected. This necessitated revising the foundation recommendation, meetings with the design team and the contractor. These activities were not planned. URS Corporation 1333 Broadway. For example, typically pile installation and excavation for pier cap construction take place somewhat concurrently. This will facilitate one field supervisor to observe both activities. However, in this project, the pier cap construction almost started towards the end of pile installation. Therefore, we have to send a field supervisor just to observe pier cap construction. This was not planned. COST ESTIMATE Our estimated cost to complete the remaining engineering services is S34,573 as shown oil the attached table. Note that the hours are only estimates. and could vary considerabl} depending on the construction schedule. We propose to continue performing this work on a time and materials basis, and will obtain authorization from you before performing any additional work beyond this budget estimate. We will continue to bill for our services in accordance with already accepted rate for this project. The work will be done in accordance with the existing contract terns.
