(District III) FISCAL IMPACT: None. ]BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The private improvements have been installed in a good workmanlike manner as required by the improvement plans and in conformance with the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The improvements will not be accepted as complete and the Subdivision Agreement and surety bond will not be exonerated. (District I1.1) DATE: March 6, 2007 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of March 3,2007 thereby establishing the six-month tenninal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT NAME OF BANK/SURETY April 27, 2004 Safeco Insurance Company of America BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,644,300.00, Bond No. 6260526 issued by the above surety had been RETAINED for the six month lien guarantee period and the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED NOR DECLARED as County Roads, at this time. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $32,886.00 cash security for performance (Auditor's Deposit Permit No. 423016;dated April 15, 2004) plus interest in accordance with Government Code Section 53079, if appropriate, to Western Pacific Housing pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond, Bond No. 6260526, dated March 30, 2004, are exonerated.
