SUBJECT: Approve Notice of Intention to Purchase Real Property Located at 555 Escobar Street,
Martinez Area, District II. [CP#06-112]
Project No.: 4405-6G5041 Gov. Code §25350
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action:
A. FIND that this purchase will not have a significant effect on the environment and that is has been
determined to be exempt from the California Environmental Quality Act under State CEQA guidelines
Article 5, Section 15061 (b)(3). This Board DIRECTS the Director of Community Development to file a
Notice of Exemption with the County Clerk, and DIRECTS the Public Works Director to arrange for
payment of the $50.00 fee to the County Clerk for filing and a $50.00 fee to Community Development for
processing of the Notice of Exemption.
B. DECLARE that this Board intends to purchase from J&L Busby Co. LLC., for County purposes, the real
property described in Exhibit "A" attached hereto, for $10,993,524, in accordance with Section 29 of the
Lease Agreement between the County of Contra Costa and J&L Busby Co. LLC., dated April 26, 2005,
which is a fair and reasonable price therefore. A copy of said Lease Agreement is on file in the Public
Works Department.
C. DECLARE that this Board will meet on April 10, 2007 at 9:30 a.m. or thereafter, in the Board's
Chambers, County Administration Building, Martinez, California, to consummate this purchase and the
Clerk of this Board is DIRECTED to publish the attached notice in the Contra Costa Times pursuant to
Government Code Section 6063.

Fiscal Impact:
Under the terms of the Lease, when'the County closes escrow on the purchase, the County will no longer be
obligated to pay rent of $83,556 per month which is required during the first lease year of the Post
Construction Period.
Reasons for Recommendations and Background:
The County has entered into a long term ground lease for the property at 555 Escobar Street in Martinez
(APN 373-182-001). The lease provides that the Lessor will construct an approximately 36,000 square foot
office building for occupancy by the Clerk-Recorder. That building has been constructed. The lease also
includes a purchase option whereby the County can purchase the improved property at any time during the
term of the lease. The purchase will terminate the obligation by the County to pay rent, and will benefit the
County in the long term.
Consequences of Negative Action:
The County will not obtain ownership interest and will be obligated to continue to pay rent of$83,556 per
month in the first year of the lease.
