RECOMMENDED ACTION:
APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to execute an interagency agreement with the
City of San Ramon in an amount up to $821,073 for Police Dispatch Services for the period July 1, 2007
through June 30, 2008.
APPROVE and AUTHORIZE the issuance of a mutual indemnification clause in the interagency agreement
with the City of San Ramon for Police Dispatch Services.
FINANCIAL IMPACT:
No County Costs. Revenue; 100% City of San Ramon.
BACKGROUND:
The City of San Ramon elected to operate its own police department effective July 1, 2007. The City requests
the County provide dispatch services to its police department. The County currently provides dispatch services
and Sheriffs Deputies under contract with the City of San Ramon.

Contract for Police Dispatch Services

3 PARTIES•
4 This contract is entered into by and between the City of San Ramon
5 (hereinafter referred to as City) and the County of Contra Costa (hereinafter
6 referred to as County) .
7 TERM.
8 This Contract shall become effective July 1, 2007 at 12:01 hours A.M. ,
9 and continue in place until terminated by either party giving written notice
10 at least one year prior to termination date as follows.
11 When written notice of termination of the Contract is delivered
12 to the other party from January 1 to June 30, the termination of the
13 contract shall be effective on July 1 of the next calendar year.
14 When written notice of termination of the Contract is delivered to the
15 other party from July 1 to December 31, the termination of the contract shall
16 be effective on July 1 of the second following calendar year.
17 CITY OBLIGATIONS:
18 . City shall make to the County those payments described in
19 the Payment Provisions attached hereto by reference, subject to all the terms
20 and conditions contained or incorporated herein.
21 COUNTY OBLIGATIONS: County shall provide those resources and services
22 described in the Service Plan attached hereto which are incorporated herein
23 by reference.
24 CONTRACT PROVISIONS•
25 This Contract is subject to the General Conditions,

1 Payment Provisions, and Service Plan which are incorporated here in by
2 reference, subject to all the terms and conditions contained or incorporated
3 herein.

Legal Authority:

This Contract is entered into under and subject to

Government Code Sections 55631 through 55634, the Joint Exercise of Powers
7
Act (Government Code section 6500 et seq.) and any and all other applicable
8
authority.

1 GENERAL CONDITIONS
2 LABOR RELATIONS:
3 County shall negotiate all labor relations agreements and personnel
4 rules, regulations, and procedures between County and its employees rendering
5 services under this Contract. City may at any time report to County their
6 concerns about County personnel performing services under this Contract.
7 County will investigate these concerns and take whatever action it deems
8 appropriate.
9 In the event obligations under this Contract by County to provide
10 dispatch services to City are interrupted by strikes, boycotts, or other
11 forces beyond control of County, the County shall make pro-rata adjustment or
12 refund of amounts payable to County hereunder. Further, in the event of any
13 such strike or boycott, County will exert reasonable means available to
14 provide dispatch services to City, and agrees that City may, at its option,
15 secure dispatch service from another agency during the term of any such
16 strike or boycott.
17 INTERRUPTION OF SERVICES:
18 In the event that obligations under this contract by the County to
19 furnish dispatching services to City are interrupted by strikes, boycotts or
20 other forces beyond County control, County shall make reasonable effort to
21 continue providing services to the extent possible and to fully restore
22 services as soon as possible.

1 CITY AND COUNTY COOPERATION:
2 City shall give County full cooperation and assistance of its officers,
3 agents and employees and hereby designates its Chief of Police as its
4 representative to coordinate with the Sheriff's Support Services Bureau all
5 activities provided pursuant to this contract.
6 County shall give City full cooperation and assistance of its officers,
7 agents and employees and hereby designates the Commander of Support Services
8 Bureau to coordinate with the Chief of Police all activities provided
9 pursuant to this contract.
10 NOTICES•
11 A11 notices provided by this Contract shall be in writing and may be
12 delivered by deposit in the United States mail, postage prepaid. All notices
13 shall be mailed first class, certified mail, return receipt requested to
14 Contra Costa County Sheriff's Office, 651 Pine Street, Martinez, California
15 94553 or San Ramon City Manager 2222 Camino Ramon, San Ramon, California
16 94583.
17 INDEMIFICATION:
18 County shall 'defend, save, and hold harmless and indemnify City and its
19 Officers and employees from any and all claims, costs and liability damages
20 for death, sickness or injury to person(s) or property, including without
21 limitation all consequential damages from any cause arising directly or
22 indirectly from or connected with the operations or services of County or its
23 agents, servants or employees hereunder, save and except claims litigation
24 arising through sole negligence or sole willful misconduct of City or its
25 officers or employees.

9 COUNTY EMPLOYEE STATUS:
10 Persons employed by County in the performance of services under the
11 Contract are County employees, and do not have and not acquire any pension,
12 civil service or any other status of right which City confers upon its
13 employees.
14 RESOLUTION OF CONFLICTS:
15 The Chief of Police or his specifically designated representative will
16 meet with the Office of the Sheriff Support Services Commander to resolve
17 conflicts that may arise in the performance of this Contract.
18 BUSSINESS LINES:
19 City is solely responsible for the installation cost and maintenance of
20 business lines that may have to be installed in the Communications Center.
21 (Non 911)
22 EQUIPMENT PURCHASES:
23 City shall reimburse County for any equipment purchase made at City's
24 request on terms mutually agreed upon.

1 SERVICE PLAN
2 SERVICES:
3 County shall provide City with police dispatching services; including
4 dispatching, call-taking, sending and receiving voice and data traffic,
5 answering 911 calls, performing want checks and supervision and management
6 thereof. County will not perform callouts of any nature, warrant
7 confirmations, nor will it notify or receive request for warrant confirmation
8 unless a mutually agreed upon reciprocity agreement exists. County will not
9 send non-urgent teletype messages. County will not provide information and
10 technology support for Mobile Data Computers, (NDC) to include software
11 upgrades or repairs. County will not perform radio repairs for subscriber
12 radios mobile, portable, or base stations. County will provide CLETS/NCIC
13 Transaction Responsibility as outlined in Attachment A. Services under this
14 contract are limited to dispatch services only.
15 The City will provide County with one telephone number to which
16 Dispatch will refer business callers and callout messages as appropriate.
17 City agrees to monitor this line around the clock on a daily basis.
18 The City will provide and maintain Mobile Data Computers (HDC) in all
19 field enforcement vehicles except motorcycle and parking enforcement vehicles
20 compatible with County Computer Aided Dispatch (CAD) and Records Management
21 Systems (RMS) . City will provide individual CLETS mnemonics for all MDC's and
22 desktop CLETS terminals.
23 If operational adjustments to this agreement are necessary the City
24 will correspond with the Support Services Bureau Commander. The County will
25 correspond with the City Chief of Police.

1 RADIO FREQUENCY:
2 County will provide a Radio Channel for City to conduct Police
3 operations which will be shared with other police agencies and County.

5 PAYMENT PROVISIONS
6 INVOICE:
7 An invoice will be provided by County to City for the first year of
8 this contract prior to July 1, 2007. City shall pay invoice in full prior to
9 services being provided. Invoices during subsequent years of contract between
10 County and City will be provided to City by County prior to February 1 of the
11 billing year and shall be paid by City within 90 days.
12 Cost:
13 County will calculate cost of the Dispatch Contract with City based on
14 apportioned amount of actual dispatching costs based on percentage of calls
15 for service generated by the City the prior calendar year. Calls for service
16 are defined as an incident created in the Computer Aide Dispatch System as a
17 result of performing all dispatching functions excluding out-of-service
18 calls.
19 The City will pay the County a 1096 Acquisition fee for future
20 infrastructure maintenance or acquisitions to support voice and data
21 communications. See Attachment B.
22 All other requests for services, such as special events or enhanced
23 staffing above normal staffing levels, shall be paid for by City on a time
24 and materials basis upon mutual agreement.
