COMPENSATION OF WEIGHTS,& MEASURES PERSONNEL IN FY2006/07 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): APPROVE Appropriations and Revenue Adjustment No. 5067 authorizing new revenue in the;amount of $65,816.00 from weights and measures device registration fees and from a judiciary settlement and authorize the transfer of appropriations to the Department for the addition of one Weights & Measures Inspector position, the purchase of a handheld price auditing device, the upgrade of office network cabling, and to move funds to Fleet Services division of General Services to cover the purchase of one vehicle. -FISCAL IMPACT: Because.the revenue comes from fees and penalties imposed on regulated industry this action will not result in an increase in net county cost or negatively impact the Department's budget. BACKGROUND: The revenue to cover expenses incurred in FY2006-07 come from weights and measures device registration fees and point-of-sale system inspection fees from County Ordinance 2006-09. These fees were authorized last FY and where to be phased-in by formula at 60% the first year, 80% the second year and fully implemented in the third year. The department also realized a judgment settlement of$24,415 from a weights and measures case involving a major grocery store. The department had planned to request authorization for an additional Weights & Measures Inspector and a vehicle necessary for this position in the third year of the phase-in. However, the Department is making the request early due to the additional revenue that has been identified. Long term funding for this position is secured through realization of the full registration fee next year. The addition of the position will bring our Weights & Measures Division staff to nine positions. This will help the Department to better meet state mandated inspection frequencies. In the 1970's the Weights & Measures Division numbered ten staff members. With that number of staff the Division was able to keep up with the mandated inspection frequencies and was able to do other weights and measures related work such as package inspection quantity control. The number of devices and consumer packages and the need for quantity control workin the county has increased significantly since then along with increases in population. The use of point-of-sale systems did not start until the very end of that decade and inspections of those systems by weights and measures officials did not begin until the mid 1980's. The department has also been told by DOIT personnel that the network cabling in our main office is outdated,. Upgrades will solve most of the network problems that this office has been experiencing over the last couple of years. The additional revenue that is identified will also cover staff compensation increases that were negotiated this fiscal year. After approval of this request we expect a fund balance in this Division that will offset small revenue shortfalls in other areas of the overall departmental budget. CONSEQUENCE OF NEGATIVE ACTION: Negative action will result in the Department's failure to meet State mandated nondiscretionary functions in weights and measures inspections of weighing and measuring devices and point-of-sale systems throughout the county. The vehicle is necessary for the Inspector to perform work independently. .Failure to upgrade network cabling will result in further deterioration of the function of the network and will affect staff productivity. BACKGROUND: The Agriculture Department is requesting the addition of the Weights and Measures Inspector Trainee position to meet the current staffing needs of the Weights and Measures Program in the Agriculture Department.
