SUBJECT: SALARY ADJUSTMENT FOR SPECIFIED PUBLIC DEFENDER MANAGEMENT CLASSES DUE TO
COMPACTION
SPECIFIC REQUEST(S)OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt Position Adjustment Resolution Number 20287 to re-allocate, effective July 1, 2006, the Public Defender
classes of Assistant Public Defender (25D2) [unrepresented] from salary level B85-2228 to B85-2297, Chief
Assistant Public Defender (25D1) [unrepresented] from salary level B85-2301 to 1385-2370, and Chief
Investigator-Public Defender(6NNA) [unrepresented]from salary level B85-1673 to 1385-1723.
FISCAL IMPACT:
Upon approval, this action will result in an annual cost of$102,500. As reported in the mid-year budget report,
the Public Defender's Office is expected to have a budget deficit this year due to the unanticipated cost of
retirement buybacks. Consequently, the Public Defender's Office will be unable to absorb the cost increase
related to this action and the cost will become a General Fund encumbrance.
BACKGROUND:
The Department requests the re-allocation of the Assistant Public Defender, Chief Assistant Public Defender,
and Chief Investigator-Public Defender classifications due to the 5% salary increase given to represented

Deputy Public Defender II — IV and Public Defender Investigator I — 11 during labor negotiations. The increase
has resulted in compaction with the Assistant Public Defender, Chief Assistant Public Defender, and Chief
Investigator-Public Defender classifications. The recommended re-allocation will cure the compacted salary
interval between the respective classifications by creating a salary interval of at least 5%, which is the
minimum interval recommended between management supervisory and subordinate job classes.
CONSEQUENCE OF NEGATIVE ACTION:
The consequence of negative action will result in the continued compaction of salary between Deputy Public
Defender II — IV and Assistant Public Defender and Chief Assistant Public Defender, and the classifications of
Public Defender Investigator I — II and Chief Investigator-Public Defender.
