SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2007/ 5i'- for Subdivision 04-08839, accepting completion of public and private
(Emshee Lane) improvements, for project being developed by Davni II Development, Martinez area. (District II)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The improvements have been installed in a good workmanship like manner as required by the improvement plans
and in conformance with the County ordinance code.
CONSEQUENCES OF NEGATIVE ACTION:
The six month lien period will not start and the guarantee performance will not begin until the improvements are
accepted as complete.

These improvements are approximately located at Blum Road and Emshee Lane.
The Public Works Director has notified this Board that the improvements in Subdivision 04-
08839 have been completed as provided in the Subdivision Agreement with Davni II Development,
heretofore approved by this Board in conjunction with the filing of the Subdivision Map.

SUBJECT: Accepting completion of public and private (Emshee Lane) improvements,
Subdivision 04-08839, for project being developed by Davni II Development,
Martinez area. (District II)

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of February 6, 2007 thereby establishing the six-month terminal period for the filing of liens in
case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for$181,250.00,
Bond No. 720338S issued by the above surety be RETAINED for the six month lien guarantee
period until August 6, 2007, at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the private improvements (Emshee Lane) have been
COMPLETED and are NOT ACCEPTED NOR DECLARED as County Roads, at this time.
BE IT FURTHER RESOLVED that the beginning of the warranty period for public
improvements is hereby established, and the $5,400.00 of the $54,375.00 cash deposit (Auditor's
Deposit Permit No. 444714', dated May 19, 2005) made by David S. Margen be RETAINED
pursuant to the requirements of Section 94-4.406 of the Ordinance Code until release by this Board.
BE IT FURTHER RESOLVED that the performance surety bond,Bond No.720338S,dated
September 21, 2005 is exonerated.
All deposit permits are on file with the Public Works Department.
