FISCAL IMPACT: None BACKGROUND: The Human Relations Commission's initial 1996 Bylaws were last amended in 1998. The intent of this submission is to reflect current operations and address inconsistencies of the type shown in the examples below: • The current Commission meets on the first Wednesday of each month. The 1998 Bylaws report a second Wednesday meeting date. • The current Human Relations commission selects officers each November. The 1998 Bylaws report officer selection annually in May. These Bylaws were approved by a majority vote (7 aye; 1 no)at the March 7, 2007 regularly scheduled meeting of the Human Relations Commission. The Commission shall encourage and stimulate agencies under the jurisdic- tion of the Contra Costa County Board of Supervisors and the cities that adopt this charter to take such action as will fulfill the purpose of this charter. The Commission shall submit an annual report to the Contra Costa County Board of Supervisors and to cities that adopt this charter. For issues of alleged discrimination, complainants are referred to the Califor- nia Department of Fair Employment and Housing (DFEH) and the Federal Equal Employment Opportunity Commission (EEOC). The Commission also sponsors and provides educational programs that are designed to prevent "bias-motivated incidents" among students in kindergar- ten through the twelfth grade. These programs contain activities that promote and teach respect for and celebration of cultural diversity. ARTICLE IV: MEMBERSHIP All members shall be selected in compliance with these by-laws. The number of members of the Commission shall not be more than nineteen (19). Com- missioners shall reside within Contra Costa County. There shall be at least one representative from each of the five supervisorial districts. Membership shall be broadly representative of the general public including, but not limited to, members of business, labor, religious groups, education, criminal justice, community organizations, and city representatives character- istic of the County's diverse population with respect to gender, sexual orien- tation, ethnicity, national origin, disability, economic disadvantage or age. SECTION 1: NUMBER OF MEMBERS 15 Commissioners, each representing the county at-large, to be appointed by the Board of Supervisors, other than a member of the Board of Supervisors. 1 Alternate Commissioner, also representing the county at-large; the alternate shall sit and vote for any absent Commissioner, and when a vacancy occurs, the alternate shall assume the vacant seat per Board Order dated June 3, 1997. The alternate commissioner shall be appointed by the Board of Supervisors, other than a member of the Board of Supervisors. 3 Youth Associate Commissioners, as per Board Order dated March 20, Human Relations Commission By-Laws Adopted by HRC: March 7, 2007 Page 3 of 9 and Committee Chairpersons and Vice-Chairpersons. SECTION 2: CHAIRPERSON The Chairperson shall: (1) preside at all business meetings; (2) set the agenda and review minutes for all meetings in consultation with Commission staff; (3) have general supervision over all Commission business conducted; (4) serve as Chairperson of the Steering Committee, and; (5) have such other powers and duties as may be assigned to him/her by the Commission. SECTION 3: VICE-CHAIRPERSON The Vice-Chairperson shall, in the absence of or inability of the Chairperson to act, exercise all the powers and perform all the duties of the Chairperson. He/she shall also have such other powers and perform such other duties as as- signed to him/her by the Commission. SECTION 4: COMMITTEE CHAIRPERSONS AND VICE-CHAIRPERSONS The Committee Chairpersons and Vice-Chairpersons shall preside over their respective committees. They shall report to the Commission on work and progress of their committee. They shall also have such other powers and per- form such other duties as may be assigned to them by the Commission. SECTION 5: TERM OF OFFICE The Chairperson, Vice-Chairperson, and Committee Chairpersons and Vice- Chairpersons shall serve terms of one year and may succeed themselves for one additional term. The elective officers shall serve until replacements are elected. SECTION 6: ELECTION OF OFFICERS The elective officers of this Commission are the Chairperson and Vice- Chairperson. Both officers shall be elected at the first general meeting in No- vember. A majority vote of the Commissioners present constituting a quorum are required to elect. ARTICLE VII: MEETINGS SECTION 1: REGULAR MEETINGS The regular meetings of the Commission shall be held on the first Wednesday of each month at 2425 Bisso Lane, Concord, or other designated location. Human Relations Commission By-Laws Adopted by HRC: March 7, 2007 Page 5 of 9 All meetings shall be conducted under the most recent edition of Roberts Rules of Order, unless in violation of applicable statutes. All meetings of the Commission shall be called to order by the Chairperson, or in the Chairperson's absence, by the Vice-Chairperson, or in the Vice- Chairperson's absence, by a Commission member designated for that purpose by the Chairperson or Vice-Chairperson. Public comment at all meetings shall be as provided for under applicable law. ARTICLE IX: COMMITTEES SECTION 1: STEERING COMMITTEE The Steering Committee shall be comprised of the Chairperson, Vice- Chairperson and Standing Committee Chairpersons. Chairpersons of Ad-Hoc Committees shall serve as ex-officio members of the Steering Committee and are not entitled to a vote in the Steering Committee. Committee Chairpersons and Vice-Chairpersons shall be appointed by the Commission Chairperson. The Steering Committee shall develop and recommend policy and operating procedures, as may be appropriate to the Commission; develop and submit an annual written committee work plan to the full HRC body itemizing needed resources; create an annual budget that requires two-thirds vote for Commis- sion ratification. SECTION 2: STANDING FINANCE COMMITTEE The Finance Committee- shall monitor and report funds maintained in the County account; develops fundraising strategies; makes recommendations re- garding revenue and expenditures; submits an annual written committee work plan to the full HRC body itemizing needed resources. The Chairperson and Vice-Chairperson of the Finance Committee must be at least eighteen years of age. SECTION 3: STANDING MEDIA COMMITTEE The Media Committee shall develop working relationships with the media; identifies select HRC meetings for media invitation; creates press releases for programs; submits program write-ups to local newspapers; submits an annual written committee work plan to the full HRC body itemizing needed re- sources; may be responsible for the development and maintenance of an HRC website, and other public relations materials for the HRC, as directed by the Chairperson and approved by the Commission. The proposed amendment shall be voted upon at the next regular meeting of the Commission. The agenda for the meeting at which the proposed amendments are to be voted upon shall contain an item entitled"Proposed By-Laws Amendment". ARTICLE XI: PUBLIC ACCESS TO COMMISSION RECORDS The commission shall make available to the general public all records as re- quired by law. ARTICLE XII: AGREEMENT Prior to the interview of a prospective Commissioner the candidate shall be given a copy of these by-laws. A current commissioner shall explain the functions and responsibilities of the Commission to the candidate. If the can- didate acknowledges and is willing to accept the responsibilities of being a Commissioner, the Commission may then proceed with the interview and se- lection process.
