RECOMMENDATIONS:
OPEN the hearing on the appeal of the Notice and Order to Abate a public nuisance on the real
. property located at 515 Palms Drive Martinez, CA in Contra Costa County; APN:380-070-007
RECEIVE and CONSIDER oral and written testimony and other evidence from the county abatement
officer, the property owner, and other persons; and CLOSE the hearing.
, FIND that the facts set forth below are true.
AFFIRM the county abatement officer's determination in the Notice and Order to Abate by
finding that the inoperable vehicles ,scrap metal, household appliances, trash, wood,
and foliage on the above-referenced real property is a public nuisance in violation of
Contra Costa County Ordinance Code section 84-14.402,84-68.1404, 88-4.206.
ORDER the property owner to abate the public nuisance by removing the inoperable vehicles,
scrap metal, household appliances, trash, wood, and foliage from the property within 30
days of the mailing of the Board decision.
DIRECT the county abatement officer to remove the inoperable vehicles, scrap metal,
household appliances, trash, wood, and foliage from the property, and charge the cost of
the work and all administrative costs to the property owner, if the property owner does not
comply with the Board's order to abate the public nuisance.
DIRECT the county abatement officer to send the Board's decision by first class mail to the
property owner and to each party appearing at this hearing, and to file the Board's decision
with the Clerk of the Board of Supervisor.
FISCAL IMPACT:
The Cost of the removing the inoperable vehicles, scrap metal, household appliances,
trash, wood and foliage from the property is estimated to be 10,000.00. If the county
abatement officer performs the work of abatement and thepFcoperty owner does not pay, the
actual cost of the work and all administrative cost may m sed as a lien on the property
after notice and a hearing, and may be collected as an a ement agatnst th property.

FACTUAL BACKGROUND:
The real property located at 515 Palms Dr. , Martinez, CA in Contra,Costa County; APN: 380-
070-007 is owned by Roger T. G000dwin.
The .above-referenced property is located in an (R-6 zoning district) .
Contra Costa County Ordinance Code section Title 8, Chapter 88-4.206 Junkyard Condition
"Junkyard means any property used (whether or not for profit or gain) for (1) the
dismantling or wrecking of automobiles or other vehicles or machinery, or (2) the storage or
salvage of automobiles or other vehicles or machinery, scrap metal, or other scrap materials,
including salvaged building materials.
Contra Costa County Ordinance Code section Title 8, Chapter 84-14.402, prohibits uses other
than those allowed in an R-20.. The Storage of inoperable vehicles, scrap metal, household
appliances , trash, wood and foliage over 18 inches in height. are not allowed.
The county abatement officer made an initial inspection of the above-referenced property on
February 16, 2006. The county abatement officer observed debris, inoperable vehicles,
scrap metal and foliage over 18 inches in height.
Re-inspection of the property on May 26, 2006, showed that the property continued to be in
violation of Contra Costa County Ordinance Code section 84-14.402,84-68.1404, 88-4.206.
The Notice and Order to Abate was served on the property owner and all known to be in
possession of the property by certified mail on May 30, 2006, and posted the above-referenced
property on May 30, 2006.
The Property owner filed an appeal of the Notice and Order to Abate on June 7, 2006 . Notice
of this appeal hearing was sent to the property owner by the Clerk of the Board - see Clerk
of the Board's mailing confirmation.

I am the appellant and just received notice of the date this is on the Agenda
on Friday 7-7-06 @ 4:15P.M. . I am out of town .for job training from the 10th
through the 21st and unable to be at the hearing. I am requesting this item be
rescheduled to a time I am in town, and given enough notice in order to
schedule time off work in order to be present. I have made significant
progress towards compliance, and ask to have time to finish the work. I am
organizing a community clean-up as many others are also in need of clean-up
and I am working with Susan Hurl at Allied Waste to provide dumpsters so we
can all do as requested by code enforcement. Tentatively the date will be near
the end of July. I ask that no action be brought against me or the neighbors
until such work can be accomplished. I have been working six days a week, and
out of town three weeks in April-May, and again from the tenth till the twenty
first for job training in Oklahoma. I am employed with the USPS and train
ing dates are not optional. Having only known about the date of this item
since Friday afternoon, I have. been unable to properly prepare any substitute
.representation. If action were to be taken without my presence, it would
create a great hardship and I respectfully request consideration in
re-agendizing this item. I have been making progress as has been physically
possible, given the time constraints I've been under and due to the time I've
had to be out of town.

Dear Supervisors,
How are you? Hope all is well. =T am going to be out of town training
in OTC from "7-10 thru 7-21 and unable to respond to the item SD-2 which deals
with an appeal filed by myself on an order to abate code violations at my
property at 51.5 Palms drive, Martinez, (unincorporated) . I had tried working
out some time frame with Tyrone who noticed me, but he said it would be out
of his hands so the only option I had was to appeal the order, which I did
in timely fashion. Having no communication since, and working six days a
week as well as being out of town for training April 16th through May 6th
and again July 10th through the 21st, I have had very little time to work
towards compliance, but HAVE made significant progress and I am in the
process of organizing a Neighborhood Community Clean-up after I return so we
can all come into compliance. Many of my neighbors also have been noticed on

code violations recently, with surprise and wonder as to why. we pze trying
to come into compliance in a speedy timeframe, though it cannot happen
overnight.
I only learned of the Agenda date on Friday the 7th, the first
opportunity I had to pick up the certified letter. I immediately went to the
clerk of the Board's office to explain and was told they had not the power
to change the date. 7bo' BuiIdiog inspection office was closed, (lst Friday) ,
Mike Silva is out of the office until Wednesday, and I cannot sufficiently
prepare representation.
I am respectfully requesting this item be moved to a time I am in
town, 'noticed ahead of time enough to schedule a day off to attend, so Z can
be prepared. In the meantime, I am working as fast as possible to come into
compliance prior to any action being taken which would cause a great
hardship.

REQUEST FOR WAIVER OF THE $125 FILING FEE
Individuals requesting a waiver of the $125 filing fee for
appealing the decision of the County Abatement officer before the
Board lof Supervisors must satisfy one .or more of the following
conditions to demonstrate economic harship:
1F. Appellant is legally indigent;
2. Appellant is receiving benefits pursuant to the
Supplemental Security Income (SSI) and State
Supplemental Payments (SSP) programs, the Aid
to Families with Dependent Children (AFDC) program,
or the Food Stamp program (Section 17000 Welfare and
Institutions Code) ;
Appellant has a monthly income of $125% or less of
the current monthly poverty line annually established
by the U. S. Secretary of Health and Human Services
pursuant to the Omnibus Budget Reconciliation Act of
1981, as amended; or
4. Appellant is unable to proceed without using money
which is necessary for the use of the appellant or
appellant's family to provide for the common
necessities of life.
(CCC Ord. Code Sec. 14-6.416; Gov. Code Sec. 68511.3)

NOTICE IS HEREBY GIVEN that junkyard conditions (debris, inoperable cars,
household appliances, trash, foliage, wood and metal debris) exist on property
located at 515 Palm'$ Drive, Martinez, CA, Contra Costa County, APN 380-070-
007. This condition is a public nuisance in violation of Contra Costa County
Ordinance Code Section 88-4.402 and 82-2.006.
YOU ARE HEREBY,ORDERED TO ABATE SAID PUBLIC NUISANCE.
You must abate the nuisance by removing the junkyard conditions (debris,
inoperable cars, household appliances, trash, foliage, wood and metal debris)
from the property within ten (10) days of the issuance date of this Notice and
Order to Abate. The issuance date is specified below.
If you do not abate the public nuisance, the County will remove the junkyard
conditions (debris, inoperable cars, household appliances, trash, foliage, wood
and metal debris) from the property. The abatement will be by public employees,
private contractor or other means. The cost of said abatement, if not paid, may
be levied and assessed against the property as a special assessment lien and
may be collected of the same time and in the same manner as ordinary county
taxes are collected, subject to the same penalties, procedures and sales in case
of delinquency.
YOU MAY APPEAL FROM THIS ORDER OF ABATEMENT, but any such
appeal must be brought prior to the expiration of the number of days specified
above for completion of abatement. The appeal must be in writing; specify the
reasons for the appeal; contain your name, address and telephone number; be
accompanied by an appeal fee of 'ONE HUNDRED TWENTY FIVE dollars
($125.00); and be submitted to the Clerk of the Board of Supervisors at the

NOTICE IS HEREBY GIVEN that junkyard conditions (debris, inoperable cars,
household appliances, trash, foliage, wood and metal debris) exist on property
located at.515 Palms Drive, Martinez,_ CA, Contra Costa County,,APN 380-070-
007. This condition is a public nuisance in violation of Contra Costa County
Ordinance Code Section 88-4.402 and 82-2.006.
YOU ARE HEREBY ORDERED TO ABATE SAID PUBLIC NUISANCE.
You must abate the nuisance by removing the junkyard conditions (debris,
inoperable cars, household appliances, trash, foliage, wood and metal debris)
from the property within ten (10) days of, the issuance date of this Notice and
Order to Abate. The issuance date is specified below.
If you do not abate the public nuisance, the County will remove the junkyard
conditions (debris, inoperable cars, household appliances, trash, foliage, wood
and metal debris) from the property. The abatement will be by public employees,
private contractor or;other means. The cost of said abatement, if not paid, may
be levied and assessed against the property as a special assessment lien and
may be collected at!,'the same time and in the same manner as ordinary county
taxes are collected, subject to the same penalties, procedures and sales in case
of delinquency.
YOU MAY APPEAL FROM THIS ORDER OF ABATEMENT, but any such
appeal must be brought prior to the expiration of the number of days specified
above for completion of abatement. The appeal must be in writing; specify the
reasons for the appeal; contain your name, address and telephone number; be
accompanied by an appeal fee of ONE HUNDRED TWENTY FIVE dollars
125.00 ; and be submitted to the Clerk of the Board of Supervisors at the
following address:

One who is legally indigent may--obtain a waiver of the appeal fee. Upon timely
