STREET, MARTINEZ FOR THE CLERK-RECORDER (T00026) Q

RECOMMENDATION
1. APPROVE the First Amendment to Lease with Robert L. La Fleur to extend the term of the
existing lease for the premises at 524 Main Street, Martinez, from June 1, 2006 to December 31,
2006, for continued occupancy by the Clerk-Recorder, under the terms and conditions more
particularly set forth in the Lease Amendment.
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease
Amendment.
FINANCIAL IMPACT
Extending the term of this Lease was anticipated and budgeted in the Clerk-Recorder's approved FY
2005/06 budget and requested FY 2006/07 budget. The rent for the period from June 1, 2006
through December 31, 2006 will be $115,780.
BACKGROUND
Approval of the Lease Amendment will provide for continued use of approximately 13,850 square feet
of office and warehouse space as requested by the Clerk-Recorder. The Clerk-Recorder has
occupied this location since 2001.
The Clerk-Recorder intends to vacate this building upon completion of the new Clerk-
Recorder/Elections building currently under construction at 555 Escobar Street in Martinez. Approval
of the First Amendment to Lease will extend the term of the lease from June 1, 2006 to December 31,
2006, at a rental rate of $16,540 per month, and will provide office and warehouse space to support
the Clerk-Recorder's operations until the new building is completed.

FIRST AMENDMENT TO LEASE
524 MAIN STREET
MARTINEZ, CALIFORNIA
FOR THE
CONTRA COSTA COUNTY
CLERK-RECORDER, ELECTIONS DIVISION
1. PARTIES: Effective on i ROBERT L. LA FLEUR,
hereinafter called "LESSOR," and the COUNTY OF CONTRA COSTA, a political
subdivision of the State of California, hereinafter called "COUNTY," for good and
valuable consideration mutually agree and promise as follows:
2. PURPOSE: The parties desire to amend that certain lease dated June 19, 2001
(the "Lease".), entered into between LESSOR and COUNTY for approximately 13,850
square feet of office and warehouse space, commonly known and designated as 524
Main Street and 723 — 725 Alhambra.Avenue, Martinez, California, to extend the Lease
term and modify the monthly rental as follows:
1 AMENDMENT: The Lease shall be amended as follows:
a. Paragraph A.3. TERM is hereby deleted in its entirety and replaced with the
following:
"A.3. TERM: The term of this Lease shall commence on June 1, 2001, and
terminate on December 31, 2006."
b. Paragraph A.4. RENT is hereby amended by adding the following language
immediately after LESSOR'S address:
"For the period commencing June 1, 2006, COUNTY shall pay to LESSOR
as rent for use of the Premises a monthly rental of SIXTEEN THOUSAND
FIVE HUNDRED FORTY AND NO/100 DOLLARS ($16,540.00),
payable in advance on the tenth day of each month during the term of this
Lease."
c. Paragraph A.S. EXTENSION of the Lease is hereby deleted in its entirety.

4. EFFECT: Except for the amendments agreed to herein, the Lease remains in full
force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment as of the date set
forth above.
