FISCAL IMPACT: Because the revenue comes from increased and new fees to regulated industry this action will not result in an increase in net county cost or negatively impact the Department's budget. BACKGROUND: The additional revenue in this fiscal year (2005/06) is due to increased weighing and measuring device registration fees and the establishment of new fees for point-of-sale systems as adopted through County Ordinance No. 2006-09. The Department is requesting that General Services purchase two cargo vans and a Liquefied Petroleum Gas (LPG) Trailerized Prover. The two vehicles are needed for two new Weights & Measures Inspectors that were authorized in the FY2006-07 budget. These new Inspectors will need the vehicles to enable them to perform weights and measures inspection work for which they are being hired. Delivery of new vehicles after going through the ordering process typically takes 3-4 months. These new Inspectors will undergo a training process with existing staff until the vehicles are ready for use. This testing is required to be performed annually by the California Code of Regulations §4070. Up to this time the Department has not had the funds or resources to meet this mandate in regard to LPG device testing. It has been necessary to borrow from either a surrounding county or the State to respond to LPG complaints. This borrowed equipment is not available for normal testing of these devices at mandated annual frequency. The adoption of County Ordinance No. 2006-09 has allowed the Department the additional revenue stream to both hire the new Inspectors, obtain necessary equipment and to better meet inspection mandates. CONSEQUENCE OF NEGATIVE ACTION: Negative action will result in the Department's failure to meet State mandated nondiscretionary functions in the testing of commercial wholesale and retail LPG dispensers throughout the county. It will further result in the Department not meeting nondiscretionary State mandated testing frequencies of other weighing and measuring devices due to the inability of the Inspectors to have the vehicles necessary to perform the work independently.
