SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
SUPPORT AB 1634 (McCarthy) which would reimburse Counties for their costs for the November
2005 special election.
BACKGROUND/REASONS FOR RECOMMENDATION:
The November 2005 Special election resulted in significant unanticipated costs for County
governments as well as for the state.
The Governor's January Budget proposed a $54 million allocation for both state and county
special election costs in the current 2005-06 budget year. Subsequent to the initial budget
proposal, the Legislature approved SB 306 (Ackerman), which appropriated $9 million to the
Secretary of State for state-only costs associated with the November 2005 election. The
Governor signed SB 306 on April 10, 2006. AB 1634 (McCarthy) would appropriate $38.8 million
to reimburse counties for their costs in running the special election. The total figure was
ascertained by surveying each county about its actual net costs for conducting the elections
which, for Contra Costa County was $1.26 million.

1 SECTION 1. The sum of thirty-eight million eight hundred
2 eighteen thousand three hundred ten dollars ($38,818,310) is
3 hereby appropriated from the General Fund to the Controller to
4 reimburse counties for the state's share of special election costs,

31 SEC. 2. This act is an urgency statute necessary for the
32 immediate preservation of the public peace, health, or safety
33 within the meaning of Article IV of the Constitution and shall go
34 into immediate effect. The facts constituting the necessity are:
35 County budgets statewide contain funding authority to support
36 one statewide election per fiscal year. However, there was a
37 special statewide election held in November 2005. In order for
38 counties to carry out the regularly scheduled statewide primary
39 election in June 2006, an appropriation must be provided as
40 soon as possible to cover the costs expended for the November

1 2005 special statewide election. It is therefore necessary that this
2 act take of ect immediately to reimburse counties and the
3 Secretary of State for election expenses of the November 2005
4 election.
