Recommended Action:
APPROVE and AUTHORIZE the Public Works Director, or designee, to reimburse Hofmann Land
Development Company with funds from the Discovery Bay West Project Traffic Mitigation Fee in the amount
of $17,026.71 (Fund 139200, Org 0682) for aerial topographic and related survey work completed along
Balfour Road, Discovery Bay area. (District III) Project No. 0662-6R4002.
Financial Impact:
There is no impact to the General Fund. The County has not funded any of the aerial topographic and related
survey work and was completed by the developer's consultant with minimal oversight by the County.

Reasons for Recommendations and Background:
The existing section of Balfour Road, between Sellers Avenue and Bixler Road in the Discovery Bay area, is
approximately 18 to 20 feet in width, within a public right-of-way width as narrow as 40 feet and as wide as 84
feet. This section of roadway is located in an agricultural-type area in East County and has historically carried
low volumes of traffic along with farming equipment associated with agricultural-type land uses. In recent
years, this roadway has experienced an increase of traffic volumes due to a number of developments in the
Discovery Bay area. As a result of this increase in traffic volumes, the Public Works Department has
experienced an increased need for maintenance along this section of roadway, especially the repair of pavement
along the edge of roadway due to the lack of existing shoulder width.
In April 2005, the Public Works Department applied for and received a 2005/2006 Hazard Elimination System
(HES) grant to install a 4 foot wide section of shoulder backing on both sides of Balfour Road, between Byron
Highway and Bixler Road. Concurrently as part of the Discovery Bay West project's condition of approval
requiring a flexible mitigation monitoring program, a traffic study as a result of this program determined that
Balfour Road would benefit from a road widening considering the increase of traffic volumes due to new
developments in the area, particularly the Discovery Bay West project.
Given the need for road widening, receipt of HES grant funding, and the availability of Discovery Bay West
traffic mitigation funds the Public Works Department approached Hofmann Land Development Company with
the opportunity to make a joint effort to widen this section of Balfour Road. The Public Works Department
agreed to obtain the necessary right-of-way and relocate utilities as needed, with Hofmann Land Development
Company providing the design and construction of the road widening. Initially, a narrower road widening
meeting minimum standards was considered to avoid the need for right-of-way acquisition and relocation of
utilities. Therefore, there was a need for an aerial topographic survey and other related survey work to be
completed to verify existing pavement widths, right-of-way widths, existing utilities and other existing features
to make a determination of appropriate project improvements.
After further discussion among Public Works Department staff, it was decided that it would be more prudent to
widen Balfour Road to full collector road standards at this time, rather than a temporary narrower width.
Unfortunately, given the acquisition of right-of-way and relocation of utilities would require a significant
amount of time, this schedule did not fit into Hoffman Land Development Company's timetable, considering
they are near project build-out and could very well be done with their project before construction of the road
widening were to occur. Therefore, Hofmann Land Development Company has decided that the timing is not in
their favor and the Public Works Department has agreed to pursue this as a capital road improvement project.
In turn, Hofmann Land Development Company has requested reimbursement for aerial topographic and related
survey work completed for the purposes of determining the project scope. The Public Works Department has
received the aerial topographic and related survey work for use in the completion of this project.

The Public Works Department is currently in the planning stages to widen this section of Balfour Road. In
order to widen Balfour Road, the County will be accepting existing offers of dedication and purchasing right-of-
way to obtain the ultimate right of way width of 84 feet along this corridor. In preparation for this widening,
the joint utility poles along Balfour Road will be required to be relocated to the new right of way line to provide
clearance from the edge of the pavement. The current plan is to widen the existing 18 to 20 foot wide road to
36 feet. The future ultimate pavement width is planned for 64 feet. Utility pole realignment relative to the new
right-of-way line will help to avoid future relocations, as eventually Balfour Road will need to be widened to its
ultimate width in the future.
Upon approval by the Board of Supervisors, the amount of$17,026.71 will be reimbursed from the Discovery
Bay West Project Traffic Mitigation Fee, to pay for completed aerial topographic and related survey work.
Consequences of Negative Action:
If the action is not approved, Hofmann Land Development Company will not be reimbursed.
