Chatman, County Probation Officer Costa DATE: June 20, 2006 ti `� COUIy� SUBJECT: Probation's Application to The Office of Traffic County Safety (OTS) for First Time Felony DUI Offenders , SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the County Probation Officer to apply for and accept funding from the State Office of Traffic Safety in an amount not to exceed $614,722 for an Enhanced Driving Under the Influence (DUI) Program for First Time Felony DUI Offenders for the period October 1, 2006 through December 31, 2008. FISCAL IMPACT: The grant application will fund a full-time Deputy Probation Officer and two part-time Clerks (one in Probation, one in the Courts) and other direct program expenses including new . technology for monitoring alcohol use. In addition to grant revenues, offenders will be required to pay fees according to their ability to pay. Additionally, the grant funds will support an evaluation component. No County match is required. BACKGROUND: The purpose of the proposed project is to protect public safety and reduce DUI recidivism by implementing a First Time Felony DUI Offender Program for 150 individuals. Currently, Contra Costa County does not offer formal active probation for any category of DUI. Budget cuts and high caseloads have led to a situation where only Felony DUI's get any probation supervision through the Probation Department's Computer Assisted Probation Services (CAPS). Given their:more serious case factors, among all DUI offenders, felony offenders are arguably the most at-risk for re- offending. Experience indicates that this group is often intervention resistant, treatment phobic, and unlikely to follow the Terms and Conditions of Probation. The program proposed in the application is to begin supervising first-time DUI felons on a regular Probation caseload, using a specially trained Probation Officer to work closely within the existing criminal justice treatment program, the Recovery Gateway Unit, and with Alcohol and Other Drug Services (AODS) case managers. Conventional and cutting edge drug and alcohol use testing protocols will be utilized. Theproposed multidisciplinary approach will mirror the way in which the County already addresses other treatment court defendants - as an effective and realistic method of addressing the level of risk they pose to public safety.
