SUBJECT: Approve Extension of Time to Develop Residential Property in the Bay Point
Redevelopment Project Area for Low and Moderate Income Housing

RECOMMENDATION:
As the Board of Supervisors ADOPT Resolution to (1) extend for five years the period during
which the Redevelopment Agency may retain certain real property located on Bel Air Lane in
the Bay Point Redevelopment Project Area; and (2) reaffirm the intention of the board of
Supervisors that.the property be used for the development of affordable housing for low — and
moderate-income families; and
As the Governing Board of the Redevelopment Agency AFFIRM the intention to use Agency
owned property on Bel Air Lane for the development of affordable housing for low — and
moderate-income families.
FINANCIAL IMPACT:
None to the General Fund.
BACKGROUND:
In December 1993, the Redevelopment Agency acquired residential property on Bel Air Lane in
the Bay Point Redevelopment Project Area. The property was acquired by the Agency as part of
a Settlement Agreement between the.Agency, Westamerica Bank and D & M Development, Co.
The Agency and Westamerica Bank had been construction lenders for a ten-unit, affordable
condominium development proposed by D & M Development, Co. The Developer defaulted on
the construction loan. Because'Agency funds had been disbursed for property acquisition, the
property was conveyed to the Redevelopment Agency.

California Redevelopment Law (Health and Safety Code Section 33334.16) requires that for
property acquired using moneys from the Low and Moderate Income Housing Fund, the Agency
must initiate activities related to development within five years from the date it first acquires the
property. If the activities have not been initiated, the legislative body may extend the period
during which the Agency may retain the property for one additional period not to exceed five
years. The Agency approved an extension of time on January.19, 1999. Since that time the
County has adopted a Specific Plan for the area that includes this property (June 18, 2002), and
has rezoned the property as part of an area wide P-1 Rezoning (February 11, 2006). The
recommended resolution of extension affirms the intention of the Board of Supervisors that the
property be used for the development of low- to moderate-income housing. The Agency
Governing Board is also affirming this. Since the property is vacant, the Agency had identified
the site as a location suitable to provide for the relocation of a residential treatment center for
substance abusers which will be relocated as a result of the Orbasonia Heights Transit Village
Redevelopment Program. Staff is therefore recommending that the Board of Supervisors adopt
the resolution to extend by five years the period that the Agency may retain the property for the
development of housing affordable to low- and moderate-income households, and that the
Agency reaffirm its intent to so use the property.

SUBJECT: Approve Extension of Time to Develop Residential Property— Bay Point
Redevelopment Project Area for Low and Moderate Income Housing
In the Matter of a resolution of the Board of Supervisors of Contra Costa County pursuant to
Health and Safety Code Section 33334.16 approving an extention of time to.develop
property within the Bay Point Redevelopment Project Area for Low and Moderate Income
Housing
WHEREAS, the Board of Supervisors (the "Board") of the County of Contra Costa (the
"County") has adopted the West Pittsburg/Bay Point Redevelopment Plan by Ordinance No.
87-102 on December 29, 1987, (the "Redevelopment Plan"). The Redevelopment Plan sets
a forth a plan for redevelopment of the Bay Point Redevelopment Project Area (the "Project
.Area"); and
WHEREAS, the Redevelopment Agency of the County of Contra Costa (the "Agency") is
responsible for administering the Redevelopment Plan to cause redevelopment of the
Project Area, including assembly, site preparation and predisposition of property within the
Project Area for private redevelopment consistent with the Redevelopment Plan; and
WHEREAS, the Agency is the owner of certain real property located in the Project Area on
Bailey Road, more particularly described in the attached Exhibit A (the "Property"); and
WHEREAS, pursuant to Health and Safety.Code Section 33334.2, the Agency set aside a
portion of the tax increment revenue that it received, in the Agency's Low and Moderate-
Income Housing Fund (the "Housing Fund") for the purpose of increasing, improving, and
preserving the County's supply of low and moderate income housing; and
WHEREAS; the Agency initially conveyed the Property to a developer to construct low and
moderate income housing on the Property, and also provided a construction loan to the
developer out of the Housing Fund; and
WHEREAS, the Property was deeded back to the Agency when the developer failed to
perform its obligations; and
WHEREAS, for the past five years the Agency has been unable to develop the Property
due to the fact that the Property is being held to facilitate the relocation of a residential
facility for substance abusers from a nearby redevelopment site.; and
WHEREAS, pursuant to Health and Safety Code Section 33334.16 the Board may by
resolution extend the period for which the Agency may retain the Property by another five
years;.and .
WHEREAS, the Board passed a prior resolution on January 19, 1999, extending the period
for which the Agency may retain the Property.for affordable housing purposes; and
WHEREAS, the Agency has requested that the Board pass another such resolution since
five years have passed since the Agency acquired the Property; and
WHEREAS, the Agency intends within the extended five year period to develop on the
Property affordable housing for low and moderate income families.
;NOW, THEREFORE, BE IT BY THE BOARD RESOLVED
ySECTION 1. Pursuant to Health and Safety Code Section 33334.16, the period during which the
`Agency may retain the Property is extended for five years from the passage and approval of this
Resolution.
SECTION 2. The Board herby affirms that the Property shall be used for the development of
affordable housing for low and moderate income families and persons.
SECTION 3. This Resolution shall.take immediate effect from and after its passage and approval.
