APPROVE an agreement transferring from the County to the Judicial Council of California - Administrative Office of the Courts (AOC), responsibility for and title to the. Pittsburg-Delta Court property, 45 Civic Avenue, Pittsburg. 2. APPROVE a Lease Agreement for County use of offices at the Pittsburg-Delta Court building, 45 Civic Avenue, Pittsburg. 3. AUTHORIZE the Chair, Board of Supervisors, to EXECUTE the Transfer Agreement and Grant Deed upon recommendation of the General Services Director and approval as to form by County Counsel 4. AUTHORIZE the General Services Director to execute the Lease Agreement for County use of offices at 45 Civic Avenue, Pittsburg. 5. AUTHORIZE the General Se I ices Director to execute any other documents necessary for the transfer of responsibility for, and title to, 45 Civic Avenue, Pittsburg, to the AOC. 6. DETERMINE that the above project is a Class 1 (a) Categorical Exemption under the California Environmental Quality Act (CEQA). . 7. DIRECT the Director of Community Development, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Community Development Department and County Clerk for filing of the Notice of Exemption. The annual payment is based upon actual costs over a five-year period from FY 1995-96 to FY 1999-00 adjusted for inflation. The Court Facility Payment for 45 Civic Drive, Pittsburg for the next year has been approved by the State Department of Finance and is $ 183,661. This amount may be slightly different after adjusting for inflation during the past three months. Funding for this payment has been included in the FY 2006-07 County budget. The County currently occupies 810 square feet of the 26,431 square-foot building (3.1%). The AOC is buying the County's equity share for $85,000 and leasing back the space to the County. BACKGROUND The Trial Court Facilities Act of 2002 was adopted to provide for the transfer of responsibility for funding and operation of trial court facilities from the counties to the State. The counties con tinue to be responsible for the historical funding of the trial court facilities, by way iof an annual facilities payment to the AOC. Under this Act, all county court facilities must be transferred to the State by June 30, 2007. The Pittsburg-Delta(Court, 45 Civic Drive, Pittsburg, is the first of the thirteen court occupied facilities that will be transferred. TRANSFER AGREEMENT. County staff has been working with AOC staff to complete the transfer agreement for the Pittsburg-Delta Courthouse prior to the May 15, 2006 deadline for the AOC to obtain funding in the upcoming fiscal year for design and property acquisition for the new court facility planned for East County . Approval of this agreement prior to May 15 will allow for the planning and design for the new East County Courthouse to proceed as currently scheduled. This agreement call for atwo-part transfer process to facilitate the AOC's ability to secure said funding. The first step will be the transfer of responsibility for the building and property and the second step will be the transfer of title. The transfer of title will occur when the State Public Works Board approves accepting the property and the AOC has met the conditions for transfer of title stated in the agreement. The parties have agreed upon most of the terms of the transfer agreement. The General Services Director anticipates that by May 9, the staffs of both parties will have reached agreement on all terms. Upon the transfer of responsibility for the facility to the AOC, the AOC will be responsible for all facility operations and maintenance costs. The County will continue to provide telecommunications service pursuant to a preexisting MOU, as well building security software. I
