(All Districts) FISCAL IMPACT: None. BACKGROUND: At meetings of both the Board of Supervisors and the Finance Committee, questions have been raised regarding various code compliance activities by County departments. This report will attempt to address(questions regarding code compliance activities and the status of various efforts employed to address illegal dumping problems throughout the County. (All Districts) DATE: May 9, 2006 PAGE: 2 County Code Compliance Activities Activities to address these goals ha I e been forwarded to the Code Compliance Committee which consists of the following departments with specific enforcement responsibilities: • The Building Inspection Department Code Enforcement Division enforces the building and zoning code (Title 7 and 8 of the County Code). Activities include enforcement of the uniform building code, electrical and plumbing code, mechanical code, uniform housing code, house moving, grading, community preservation code, land use, advertising and agricultural land conservation. • The Community Development Department Solid Waste/Recycling Division is responsible for the unincorporated area development and implementation of waste reduction and recycling programs and operation of the County Recycling Hotline which provides businesses and residents with information on where items can be reused or recycled. • The Sheriff s Department Patrol Division is responsible for the enforcement and administration of the Abandoned Vehicle Abatement Program (specified under Title 4 of the County Code). The Sheriff is authorized to enter onto private or public property to examine a vehicle, obtain information as to the identity of the vehicle and to remove or caused the removal of an abandoned vehicle. • The Public Works Department Maintenance Division is responsible for code compliance activities under Title 10 of the County Code, specifying the abatement of items dumped along public road right-of-way under County jurisdiction. The Clean Water Program is responsible for the elimination of pollutants from storm drains and natural waterways, management of the 1/800-NODUMPING hotline and direction of calls related to illegal dumping to appropriate divisions of the County. • The Health Services Department Environmental Health/Solid Waste Program involves permitting and inspection of landfills and transfer stations as well as services in waste abatement and nuisance abatement involving investigation and abatement of solid waste and animal waste accumulation on vacant or occupied properties. It is responsible for implantation of the mandatory subscription pilot program to ensure full garbage service throughout the County. • The Health Services Department Hazardous Materials Programs involve regulations and oversight of businesses that handle, store and process hazardous materials and serves as the primary Response Agency for inappropriately released, spilled, abandoned or dumped hazardous materials in all areas of the County. Education Efforts are being made by all County departments to educate County residents on illegal dumping prevention. • Attachment A "Contra Costa Reuse, Recycling Guide" has been put in three County area AT&T phone books. • Attachment B "Illegal Dumping Brochure" has been produced and distributed in the North Richmond area and versions are being developed for countywide distribution.. • Attachment C — "Illegal Dumping Website" was recently developed and is being implemented on the County Website. • Establish liaison between community groups, franchised haulers, city and county staff regarding illegal dumping and related issues. (All Districts) DATE: May 9, 2006 PAGE:3 j Prevention l Contra Costa County Mandatory Subscription Ordinance 418-6 requires the owners of dwellings and certain types of commercial facilities in unincorporated areas of the County to subscribe with a collector for the collection and disposal of solid waste. The Environmental Health Division has implemented a pilot program in the North Richmond community which began in September 2005. It is anticipated that this has reduced illegal dumping in the North Richmond area. However, given the relatively small number of properties (32), the overall effect has been hard to determine. Work crews conducting a survey of types of materials do note less litter typically considered household items have been present in litter sites. Several communities have begun going through litter sites and, based on materials found on the sites, began a letter campaign to get response on cleaning up the sites. Investigation Illegal dumping typically occurs in areas near junkyards, active landfills, solid waste transfer stations, poorly lit access roads, property along railways or other vacant areas. All of these areas have a reduced potential for dumpers to be sighted. Law enforcement personnel have advised County staff that the dumpers must be caught in the act for a case to be taken forward for prosecution. However, to enhance the investigation of illegal dumping, 911 can be used for reporting of illegal dumping. Another item under investigation is the purchase of cameras for installation at hot spots for dumping. Issues being discussed under this section include: • Type of cameral 1. Good (expensive ) cameras 2. Flash cameras 3. Dummy cameras • Quantity of cameras • Location of cameras • Costs • Permission for placements Prosecution The campaign to fight illegal dumping can be further enhanced by dedicating a district attorney to dumping cases. The District Attorney's Office has indicated a willingness to prosecute cases brought to the office. However, there are ongoing issues which must be resolved, including evidentiary process, manpower al location and court priorities. Other Supplemental Items for Consideration Prevention: 1. Street Lighting • Establish maintenance program for street lights • Install street lights in locations that not adequately lit to combat night time illegal dumping. 2. Property Address Identification • Assure addresses are clearly labeled on all buildings to assist in clearly identifying properties without garbage. 3. On-call Cleanups • Determine cu rent level of utilization of on-call cleanups • Establish subsidy for on-call pickup services for bulky items that are not accepted in the current on-call cleanups. 4. Neighborhood Cleanups • Sponsor one or more community cleanup events per year. • Sponsor one or more cleanups exclusively for bulky items and other materials not accepted through the on-call cleanups SUBJECT: ACCEPT report on the status of various code compliance activities for County departments. Public Outreach Campaign • Establish public outreach campaign with emphasi, on positive imagery (children, community , etc) • Explore effectiveness of Oakland's campaign that used humor to gain support and assistance related to illegal dumping • Hire private consultants to help define approach and campaign • Conduct door-to-door outreach effort targeting areas subject to frequent dumping, requesting community assistance to report illegal dumping and/or independent hauler activities. o Independent Haulers ■ Establish system to officially inform independent haulers about applicable local code requirements and franchise agreements ■ Educate County residents that only franchised businesses are authorized to charge for the collection of waste in the County Enforcement 1. Illegal Dumping Investigator • Hire retired law enforcement personnel • Build a file of cases specific to instances of commercial dumping which are suitable for prosecution 2. Reward Systems • State law provides for reward of 50% of the fine collected to person(s) that provide information leading to conviction of certain types of illegal'dumping cases (must be convicted for violating specific Penal Code Section) 3. Illegal Dumping Penalties • Assure that illegal dumping violations are assessed the maximum penalties authorized by law and that courts support that assessment • Monitor legislation related to proposed increases to penalties/fines for illegal dumping violations under California Penal Code (SB 151). • Monitor legislation that would allow the County to seize vehicles used for illegal dumping (AB2233). 4. Community Involvement • Identify opportunities (including financial incentives) to involve the community in County efforts to combat illegal dumping • Identify,funding sources to expand effects of local community groups that actively work on illegal dumping matters. Any illegal dumping prevention program will have to involve County staff, industry and community stakeholders working in a collaborative manner. The County is moving forward in addressing an issue that is not unique to this area, the state or other parts of the United States. However, given the current fiscal constrains, full expansion of code compliance activities will occur at a much more measured pace of implementation. Potentially Hazardous Material Spill or Dumping To report potentially hazardous materials which have been dumped or spilled, contact the County Health Services Department- Hazardous Materials Division at 925-646-2286 (during business hours) or 925-646- 1112 (24-hour hotline for emergencies only). Debris on Public Roads To report debris that has been dumped on a public road, it is important to first identify whether the section of road is within a city or in the unincorporated area of the County. If the debris is located on a public road within a city, contact that city(links to the city websites are included at the bottom of this page). If the debris is located on a public road within the unincorporated area, contact the County Public Works Department - Road Maintenance Division at 925-313-7000. Debris in Creeks To report debris that has been dumped into a creek call the Contra Costa Clean Water Program hotline at 1-800-No-Dumping. Contra Costa County, nineteen of its incorporated cities and the Contra Costa Flood Control & Water Conservation District joined together to form the Contra Costa Clean Water program (CCCWP). The CCCWP strives to eliminate stormwater pollution through public education, inspection and enforcement activities and industrial outreach. What is the County currently di Ing about Illegal Dumping i Sites used for illegal dumping vary but may include abandoned industrial, residential, or commercial buildings; vacant lots on public or private property; and infrequently used alleys or roadways. Because of . their accessibility and poor lighting, areas along rural roads and railways are particularly vulnerable. Illegal dumping can occur at any time of day but is more common at night or in the early morning hours during warmer months. If not addressed illegal dumps often attract more waste, potentially hazardous wastes such as asbestos, household chemicals and paints, automotive fluids, and commercial or industrial wastes. Offenders can include: constru(tion, demolition, remodeling, rLfing, or landscaping contractors, general hauling contractors, operators of junkyards, automobile repair,or tire shops, scrap collectors, local residents and "do-it-yourselfers". The costs to local government and industry associated with continuous clearing of illegally dumped wastes are significant. In recent years the County has spent up to one million dollars per year on cleanup, hauling, and disposal associated with illegal dumping. Without adequate revenue, the funding available to establish and maintain effective illegal dumping prevention programs is limited. These costs may be passed along to residents in the form of higher service fees or property taxes.
