DATE: MAY 2, 2006 PAGE: 2 of 2 FISCAL IMPACT: There is no fiscal impact to the General Fund. Funds are deposited by a drainage entity into the Flood Control Revolving Fund and loaned from the Flood Control Revolving Fund to another drainage entity. The borrowing drainage entity agrees to pay the loan principal and interest over a five-year period.DA 29G currently does not have sufficient funds available to pay for the construction of the DA 29G Line A Storm Drain Repair Proj ect and needs to borrow $350,000 from the Flood Control Revolving Fund. DA 56 currently has funds that are temporarily not needed and are available to deposit to the Flood Control Revolving Fund. REASONS FOR RECOMMENDATIONS AND BACKGROUND: Stone Drain Line A in DA 29G, Oakley,has been damaged since its construction in 1994.Numerous repairs have been made to a section of the line north of Wilbur Avenue to mitigate the effects of the damage to the surrounding areas.The DA 29G Line A Stone Drain Repair Project has been designed and advertised to rehabilitate the drainage facility.The estimated cost to complete the needed repairs in fiscal year 2005-2006 is$350,000. DA 29G currently does not have funds available to pay for the repairs.The Drainage Area currently has funds that are temporarily not needed and are available to be deposited into the Flood Control Revolving Fund. The attached resolution requests approval of the deposit from DA 56 to the Flood Control Revolving Fund and a loan from the Flood Control Revolving Fund to DA 29G. CONSEQUENCES OF NEGATIVE ACTION: If the proposed deposit and loan are not approved,the drainage area will be in a negative balance condition and the repair of the DA 29G Line A pipe will not be performed. (District V) WHEREAS the following entity has funds that are temporarily not needed and are available for deposit into the Flood Control District Revolving Fund: Drainage Area 56 (256600) $350,000 WHEREAS the following entity needs a loan in the amount indicated: Drainage Area 29G(256800) $350,000 WHEREAS said Revolving Fund Ioan is needed to eliminate the negative fund balance for fiscal year 2005-06 and to finance construction activity in the above Drainage Area; and I hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. (District V) DATE: May 2, 2006 PAGE: 2 of 2 WHEREAS said loan shall be repaid to the depositing entity within five years from the date of disbursement from the fund from monies available to said entities through drainage fee revenue. Repayment shall include interest on the unpaid balance at 4.62 percent per annum,which is the current rate received on similar types of investments by Contra Costa County as determined by the County Treasurer. NOW THEREFORE BE IT RESOLVED, as the Governing Board of Contra Costa County Flood Control and Water Conservation District,that said deposits and loans are approved,and authorize and direct the Public Works Department and the Auditor—Controller to process the transactions for the fiscal year 2005-06 closing.
