SUBJECT: Second Hand Smoke Ordinance
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Direct Contra Costa Health Services (CCHS) staff to work with County Counsel to draft a model ordinance
that would expand secondhand smoke protections to workplaces not covered by LC6404.5, outdoor areas,
multi-unit residences, and to develop appropriate signage and enforcement measures for consideration.
Provisions of the model ordinance are to prohibit smoking:
a. In any indoor workplace, including tobacco shops, owner operated businesses, volunteer operated
businesses and hotel lobbies;
b. Within 20 feet of doors, operable windows, air ducts and ventilation systems of all workplace buildings;
c. In outdoor dining areas;
d. On public trails;
e. In public parks;
f. In public service areas, such as bus stops and ATM lines;
g. In public event venues; and
h. In common indoor and outdoor areas of multi-unit housing residences.
2. Direct CCHS staff to develop a plan for outreach and education to businesses and landlords about the
proposed ordinance provisions, and to investigate ways to assist businesses with any proposed signage
requirements.
3. Ask CCHS and County Counsel to bring the draft ordinance to the Family and Human Services Committee
in 60 days for review.
4. Direct CCHS to adopt a Smokefree Healthcare Campus Policy for county operated hospitals, which would
prohibit smoking on the total grounds of the Contra Costa Regional Medical Center and Clinics.
FISCAL IMPACT:
Minimal fiscal impact. A portion of the Prop 99.funding Contra Costa Health Services receives for its Tobacco
Prevention Project could be allocated to implementation.

BACKGROUND:
On December 20, 2005, the Board of Supervisors voted unanimously to direct the health department to
research and present policies to.expand protections from secondhand smoke. Staff prepared a report entitled
"Policy Options for Reducing Secondhand Smoke Exposure Among Contra Costa Residents and Workers and
For Improving Health" which was presented to the Family and Human Services Committee on April 2, 2006.
The committee discussed the options and asked staff to examine the policy and return with a set of
recommendations for a model secondhand smoke ordinance for Contra Costa County consistent with the
Committee's discussion.
Secondhand Smoke has been designated a Class A, known human carcinogen by the U.S. Environmental
Protection Agency. The California Environmental Protection Agency released a study in October 2005
containing new, stronger evidence linking secondhand tobacco smoke to a wide variety of adverse health
effects, including increased incidences of cancer, heart disease and respiratory ailments, as well as the
increased incidences of f yeast cancer in non-smoking pre-menopausal women. This report led to the
designation of secondhand smoke as a toxic air contaminant by the California Air Resources Board on
January 26, 2006.
In 1998, the State of California fully implemented LC 6404.5, the Labor Code section prohibiting smoking in
most enclosed workplaces. A number of State laws and regulations have extended secondhand smoke
protections to tot lots and public playgrounds, school campuses and outdoor areas of government buildings
and state higher education campuses. .
While Contra Costa and California residents enjoy the benefits of some of the strongest smoke-free laws and
ordinances in the country, they still face health risks associated with secondhand smoke exposure.. Residents
are exposed to secondhand smoke in some workplaces, at public events, in public parks, in outdoor dining
areas, in multi-unit housing complexes and on health care campuses, to name a few. Since 2000, Contra
Costa Health Services Tobacco Prevention Project has received increasing numbers of complaints about
smoking in these areas.
In Contra Costa County, smoking related illnesses cost an estimated $228 million annually in health care
expenditures. These costs could be decreased if fewer residents developed chronic disease as a result of
secondhand smoke exposure and smoking. Research shows that prohibiting smoking in workplaces and
public areas supports the quit efforts of smokers.
State law allows local jurisdictions to expand upon the protections provided by state law, and to restrict
smoking in many areas that are not covered by state or federal law. Since the Board of Supervisors first .
directed staff to research this issue, at least five other Bay Area jurisdictions have adopted or are considering
policies to limit secondhand smoke exposure. Contra Costa County has taken the lead in this area and should
now look for new ways to expand smoke-free living and working.

incorporated smoking cessation curriculums into our treatment centers as we. do
with other addictive substances that threaten the health and well being of
people. The next step toward reaching a healthier community is to promote
ordinates that reduce or eliminate the exsposure to second hand smoke.
