ACCEPT filing of the Preliminary Engineer's Report; INTRODUCE Ordinance No. 33 and WAIVE the reading. 2. FIX July 11, 2006 at 9:30 a.m. in the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California, as the time and place for a public hearing to consider the Fiscal Year 2006/2007 report and approval of the annual sewer service charges for SD 5. 3. DIRECT the Clerk of the Board to publish a Notice of Filing of the Preliminary Engineer's Report and fix a Public Hearing thereon in accordance with Health and Safety Code 5473.1 and pursuant to Government Code Section 6066. DIRECT SD 5 to immediately make available to the public at the office of the Clerk of the Board and the Public Works Department a copy of the Preliminary Engineer's Report and Ordinance No. 33. FISCAL IMPACT• There is no impact to the County General Fund. County services to SD 5 are funded entirely by the annual sewer service charges obtained from the users of the sewer system, in accordance with Government Code Section 25210.77a. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The annual levy of sewer service charges benefits all property owners within SD 5 by providing for a community sewer system (miscellaneous extended service) in accordance with Government Code Section 25210.4(d). The SD 5 miscellaneous extended service includes, but is not limited to, the acquisition, construction, operation, replacement, maintenance, and repair of sewer collection, transportation, and disposal systems, including land, easements and rights-of-way in accordance with Government Code Section 25210.4a(2). CONSEQUENCES OF NEGATIVE ACTION: SD 5 would be unable to have the Fiscal Year 2006/2007 sewer service fees collected by the County Tax Collector, and would have to use an alternate method to collect the service fees. OR'.DINANCE NO. 33 BEFORE THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, AS AND CONSTITUTING THE BOARD OF DIRECTORS OF CONTRA COSTA COUNTY SANITATION DISTRICT NO. 5 AN ORDINANCE PRESCRIBING THE ANNUAL SEWER SERVICE CHARGES FOR FISCAL YEAR 2006/2007 IN CONTRA COSTA COUNTY SANITATION DISTRICT NO. 5 The Board of Supervisors of Contra Costa County, as and constituting the Board of Directors of Contra Costa County Sanitation District No. 5, ordains as follows: SECTION 1. ANNUAL UNIT CHARGE FOR FISCAL YEAR 2006/2007. For fiscal year 2006/2007, the "annual unit charge" referred to in Section 11 of Ordinance No. 20 is prescribed at $1105. SECTION 2. COLLECTION ON TAX ROLL. The District hereby elects to collect the annual sewer service charges on the Fiscal Year 2006/2007 assessment roll. SECTION 3. EFFECTIVE DATE. This Ordinance becomes effective 30 days after passage and, within 15 days after passage, shall be published once with the names of Supervisors voting for and against it in the Contra Costa Times, a newspaper published in the county.
