(District III) These improvements are approximately located at Bixler Road and Balfour Road intersection. The Public Works Director has notified this Board that the improvements in Subdivision 04- 08580(Discovery Bay West,Village 4,Lakes 7)have been completed as provided in the Subdivision Agreement with Hofmann Land Development Company, heretofore approved by this Board in conjunction with the filing of the Subdivision Map. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the$39,783.00 cash security for performance (Auditor's Deposit Permit No. 430669, dated September 2, 2004) plus interest in accordance with Government Code Section 53079,if appropriate,to Hofinann Land Development Company pursuant to the requirements of the Ordinance Code;and the Subdivision Agreement and performance surety bond for$3,938,517.00, Bond No. 070000703, dated August 31, 2004, are exonerated.
