HomeMy WebLinkAboutMINUTES - 05162006 - D.7 The Board - of Supervisors of Contra Costa County , California In the Matter of Opposing H.R. 4437 RESOLUTION NO. 2006/302 WHEREAS, on December 16, 2005, the U.S. House of Representatives passed H.R. 4437, the Border Protection, Anti-Terrorism, and Illegal Immigration Control Act"; WHEREAS, H.R. 4437 proposes, among other things, to classify undocumented immigrants, convicted of unlawful presence in the U.S., as aggravated felons; to indirectly shift the costs and responsibility of immigrant enforcement to state and local law authority and potentially increases County jail populations; to make it a crime to knowingly assist an undocumented immigrant to reside or remain in the US; to require day laborer centers and other non-profit organizations that facilitate the hiring of workers, to verify workers' immigration status; to further restrict the already limited judicial review of immigration courts' decisions; to extend mandatory detention to all non-citizens who are detained along the border or at a port of entry; to give the government virtually unfettered discretion to designate gangs and make immigrants deportable as members of gangs even if they have never violated the law; WHEREAS,H.R. 4437 would negatively impact immigrant communities and Contra Costa County residents, generally, by creating fear, discrimination and abuse of immigrant communities; and WHEREAS, Contra Costa County wishes all of its inhabitants to work and live free from discrimination and exploitation. NOW, THEREFORE, BE IT RESOLVED, that the Contra Costa County Board of Supervisors opposes H.R. 4437 which violates human and civil rights and instead urges the Conference Committee formed to reconcile the House and Senate immigration reform legislation to include the humane approach to immigration reform contained in the Senate Judiciary Committee approved bill; BE IT FURTHER RESOLVED, that the Contra Costa County Board of Supervisors urges the U.S. Senate (including California Senators Boxer and Feinstein) and President Bush to oppose H.R. 4437, and BE IT ALSO RESOLVED THAT, that the Contra Costa County Board of Supervisors urges other local and state governments to oppose the passage of H.R. 4437 and recognizes the important role immigrants play in strengthening our communities and country. S. House Resolution(HR) 4437, the Border Protection, Anti-Terrorism, and Illegal Immigration Control Act, which would make changes to immigration laws. Chair Gioia noted impacts the United States House Resolution 4437 would have on counties and local jurisdictions. He said locally it would grant law enforcement agencies the authority to arrest and transfer to federal protection undocumented immigrants and would potentially impose an extra burden on local law enforcement and on local jail facilities, which are already full. He said there is need to look at immigration reform in this country and said he did not know whether this House Resolution is the best way to achieve it. He noted a minor adjustment in the fourth paragraph to read WHEREAS, Contra Costa County, wishes all its inhabitants to work and live free from discrimination and exploitation. Supervisor Uilkema asked county staff to include the Bill itself along with the Board Order for future such items that are placed on the agenda. She said it would be inappropriate for the Board of Supervisors to take a position on this and noted her abstention. With Supervisor Gayle B. Sometime ago, a man went to jail for keeping many trans-ocean foreigners in slavery. If workers were legally here they could join the Union, and they need allies. It is sad to note that Mt. Diablo School Board will, illegally (I think) , _ spend state fund to identify legal residents because they have too many in a school boundary. They failed to plan on growth they knew about for many years. It is hard to be believe that the best educated are uneducated on State Law and will have to be sued for them to learn the law. As a local official, I am particularly concerned that the key elements of this legislation are in violation of basic human and civil liberties. More importantly, the fact that undocumented immigrants, their families or anyone offering them help would be labeled as "felons", has a chilling effect to our basic human rights. Further, H.R. 4437 would negatively impact immigrant communities and Contra Costa County residents, generally,by creating fear,discrimination and abuse of immigrant communities.
