STA- ---- County SUBJECT: Approval to Submit an Application and Execute a Grant Award Agreement with the State Office of Emergency Services for the Funding of the Victim/Witness Assistance Program for the Period July 1, 2006 through June 30, 2007 in the Amount of$492,277 (Federal/State Funds Budgeted-No Match) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: . Approve and authorize the District Attorney to submit an application and execute a grant award agreement,and any extensions or amendments thereof, pursuant to State guidelines, with the State Office of Emergency Services for funding of the Victim/Witness Assistance Program in the amount of$492,277 for the period July 1,2006 through June 30, 2007 (Federal/State Funds Budgeted-No Match). FINANCIAL IMPACT: The grant application will fund staff salaries and benefits to provide services to victims and witnesses of crimes. The grant funds a victim/witness assistance program manager, four victim/witness assistance program specialists and clerical support. As in all State Office of Emergency Services(OES)grants,the County agrees to the following conditions: to provide all matching funds required for said project, (including any amendment thereof) under the Program and the funding terms and conditions of OES, and that any cash match will be appropriated as required; that any liability arising out of the performance of the grant award agreement, including civil court actions for damages,shall be the responsibility of the grant recipient and the authorizing agency;the State of California and the OES disclaim responsibility of any such liability; and, that grant funds received from OES shall not be used to supplant expenditures controlled by the governing board. Expenditures and revenues for this program are included in the District Attorney's 2006/07 Preliminary Recommended Budget. There is no local march required by this Program. In 1986,responsibility for the program was transferred via Board of Supervisors resolution from the District Attorney to the County Probation Officer and the County Probation Officer operated the program until 2004. On June 22, 2004, the Board of Supervisors designated the District Attorney as the provider of comprehensive victim and witness services for Contra Costa County,effective July 1, 2004. Fiscal Year 2006/07 is the third year that the District Attorney is applying for the State Office of Emergency Services funds available to support the cost of the Contra Costa's Victim/Witness Assistance Program. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve the recommendation will result in the inability of the District Attorney to apply for the Federal/State funds available through the OES to support victim/witness assistance services in Contra Costa County.
