FROM: William Walker,M.D.,Health Services Director Costa By: Jacqueline Pigg, Contracts Administrator ~- DATE: 'a County April 26, 2006 SUBJECT: Approval of Standard Agreement (Amendment) 429-502-17 with the State of California,Department of Alcohol and Drug Programs C, S SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND]USTIFICATION RECOMMENDATION(S): Approve and authorize the Health Services Director or his designee (Haven Feam) to execute, on behalf of the County, Standard Agreement (Amendment) #29-502-17, with the State Department of Alcohol and Drug Programs, to amend Standard Agreement #29-502-13, effective July 1, 2005 to reflect an increase by the State, Federal Block Grant and Federal Drug Medi-Cal funding, in an amount not to exceed $343,711, for fiscal year 2005-2006, with a new payment limit of$11,274,793, and no change in the original term of July 1, 2004 through June 30,2008. FISCAL IMPACT: Approval of this(Amendment) agreement will increase the funds for fiscal year 2005-2006 by$343,711 from the State, Federal and Federal Drug Medi-Cal as follows: FY 2004-05 As Amended Net Change State General Funds $ 2,611,941 $ 2,775,297 $ 163,356 Federal Block Grants 6,626,764 6,626,764 —0— Federal Drug/Medi-Cal 1,692,377 1,872,732 180,355 TOTAL $10,931,082 $11,274,793 $343,711 No change in the required County match for this Agreement. Funding for this Contract is included in the Department's fiscal year 2005-06 budget,of this four year Agreement. BACKGROUND/REASON(S)FOR RECOMMENDATION(S): This Standard Agreement #29-502 is a combined Negotiated Net Amount (NNA) and Drug/Medi-Cal contract. The NNA Agreement(effective July 1,2004 through June 30,2008)requires counties to provide Drug/Medi-Cal services up to their full State General Fund allocation for Drug/Medi-Cal match. If the required services exceed the allocation, counties may access a Drug/Medi-Cal resi rve set aside for this purpose. On May 25, 2004, the Board of Supervisors approved Standard Agreement #29-502-13 (as amended by subsequent amendments#29-502-14 and#29-502-16 ,with the State Department of Alcohol &Drug Programs, for the period from July 1, 2004 through June 30, 2008, for the provision of Substance Abuse services. These Agreements reflected the anticipated FY 2005-2006 funding allocation. In a State Department of Alcohol and Drug Programs memorandum dated April 13,2006,the County was notified of the increased allocation. Approval of this Standard Agreement ( mendment) #29-502-17 will result in an increase in the State Medi-Cal and Federal Medi-Cal match to the County and allow continuation of the Prevention and Treatment Program,through June 30, 2008. This increase allows for potentially higher billings. Based on current service level billings however, no additional revenues are expected from this amendment. Three sealed and certified copies of this Board Order should be returned to the Contracts and Grants Unit for- submission to the State. (Federal funds—No Match required) Authorize the District Attorney to enter into a Memorandum of Understanding with the City of Richmond,required by federal guidelines to implement the program funding. FINANCIAL IMPACT: Of the$110,416 available under this program,$49,687 will be used by the City of Richmond for program costs and $60,729 by the District Attorney,pursuant to agreement, The County portion will provide partial funding of salary and benefits for a Deputy District Attorney dedicated to domestic violence prosecution. The District Attorney will serve as the lead agency for the progra>n, and has dedicated the permitted allocation for administrative support to direct service. Currently, $110,416 in total funding is available through the federal fiscal year 2006 appropriation and must be spent by September 30,2009. Funding requirements require the establishment of a trust fund in which to deposit the JAG funds. Supplantation is prohibited.Expenditures and revenue for the County portion of the grant will appropriated in the fiscal year the funding will be used. No match is required for this program. ABSENT: None ABSTAIN: None ' ATTESTEDy� CY' v ^v 6 JOHN CULLEN LERK OF THE BOARD OF SUPERVISORS cc: J BY: L --_-BEPUTY w SUBJECT: DATE: PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: The federal government has amended Part E of Title I of the Omnibus Crime Control and Safe Streets Act of 1968 to establish the Edward Byrne Memorial Justice Assistance Grant(JAG) Program. This program includes an allocation available to the City of Richmond to use in concert with the County,pursuant to a Memorandum of Understanding. The District Attorney and the Richmond Police Department secured JAG funding in 2005 of$192,176 which will be used by the City of Richmond to enhance its code enforcement program, through funding a deputy city attorney dedicated to this program area and working in close cooperation with the Police Department. The District Attorney's program is in the area of domestic violence prosecution. The 2006 grant funding would permit both agencies to continue these programs. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve the recommendation will result in the inability of the District Attorney to apply for and receive Federal funds designated by the Federal Department of Justice for use by Contra Costa County and the City of Richmond. 7
