RECOMMENDATION:
APPROVE the extension of Development Plan #DP013019 to November 3, 2007.
FISCAL IMPACT:
None. Staff costs associated with this request are covered by application fees.
BACKGROUND:
The subject preliminary development plan, for the development of an approximately 49,000 sq. ft.
office building at 3035 Oak Road in the Contra Costa Centre Area, was approved by the Planning

BACKGROUND (continued):
Commission on April 24, 2001, with an expiration date of November 3, 2002. The first one-year
extension was granted by the Planning Commission on May 7, 2002, extending the development plan
to November 3, 2003. The second extension was granted on June 10, 2003, extending the permit to
November 3, 2004. The third extension was granted on May 18, 2004, extending the permit to
November 3, 2005. The fourth extension was granted on April 26, 2005, extending the permit to
November 3, 2006.
Since the approval, the County and the County Redevelopment Agency consented to EOP-11's
assumption of the Spieker Properties' rights and obligations with respect to the parcel, pursuant to the
Consent and Agreement dated December 11, 2001 and the amended Development Agreement
approved October 19, 2004.
The applicant requests a fifth one-year extension of the preliminary development plan due to
economic factors affecting the development of the site, the overall downturn in the Bay Area economy
and specifically the commercial office market. The request is consistent with the P-1 Ordinance Code
and the Disposition and Development Agreement.
