The fourth extension was granted on April 26, 2005, extending the permit to November 3, 2006. Since the approval, the County and the County Redevelopment Agency consented to EOP-11's assumption of the Spieker Properties' rights and obligations with respect to the parcel, pursuant to the Consent and Agreement dated December 11, 2001 and the amended Development Agreement approved October 19, 2004. The applicant requests a fifth one-year extension of the preliminary development plan due to economic factors affecting the development of the site, the overall downturn in the Bay Area economy and specifically the commercial office market. The request is consistent with the P-1 Ordinance Code and the Disposition and Development Agreement. D:\Pleasant Hill BART\Spieker-Equity Office\dp013019-bos 2006ext.doc
