RECOMMENDATIONS
ACCEPT recommendations of the Fish and Wildlife Committee regarding the awarding of grants from the Fish
and Wildlife Propagation Fund;
DIRECT the Auditor/Controller to release a total of$44,160 from the Fish and Wildlife Propagation Fund to the
following organizations to support projects benefiting the fish and wildlife resources of the County: $1800 to the
Contra Costa Mosquito and Vector Control District, $900 to the Native Bird Connections, $9450 to the Save
Mount Diablo, $3250 to the Watershed Project,$10000 to the Muir Heritage Land Trust,$3200 to Lindsay Wildlife
Museum, $1840 to the Regional Parks Foundation in Partnership with the East Bay Regional Park District,$4670
'to the Kids for the Bay, $250 to California Bluebird Recovery Program, $4900 to the Earth Team Environmental
Network for Educators and Teens, and $3900 to the Contra Costa Watershed Forum (c/o County Community
Development Department).
AUTHORIZE the Fish and Wildlife Committee to use no more than$2200 from the Fish and Wildlife Propagation
Fund to purchase equipment to improve the Fish and Game Code enforcement in Contra Costa County.
FINANCIAL IMPACT
No impact to the general fund. A portion of the fines collected from violations of fish and game regulations in the
County is deposited in the Fish and Wildlife Propagation Fund, which has a current balance of approximately
$90,000. State law defines how money in this fund maybe spent, but the Board of Supervisors is responsible for
authorizing specific expenditures.The project recommended to receive funding is consistent with the expenditure
criteria established by State Law.
REASON FOR RECOMMENDATION/BACKGROUND
Since 1996,the Fish and Wildlife Committee(FWC)has implemented a structured process for reviewing funding
requests. The intent of this structured review process was to replace case-by-case decision-making (such as
occurred previously and such as is the norm with most other Fish and Wildlife Committees)with a grant process
that enables comparative and efficient review of applications. FWG

The FWC developed a grant application packet(attached), which included a cover letter to explain the grant
process and funding priorities, an application to solicit relevant information about the project,and a copy of the
expenditure criteria established by California law for the Fish and Wildlife Propagation Fund. In the fall of
2005, application packets were sent to the Fish and Wildlife Committee mailing lists and to anyone who
requested one. A press release was issued on the availability of funding for fish and wildlife projects. A total of
31 funding applications requesting a total of $194,589 were received during the application period, which
ended December 29, 2005.Two additional applications were received in early January 2006, which the
applicants asked that their applications be considered as a part of the 2005/2006 grant review process. The
Fish and Wildlife Committee discussed the funding applications at its January, and February 2006 meetings.
Some applicants came to our meetings to talk about their applications during the public comment section of the
agenda. The FWC acknowledged the hard work that went into all of the applications received and appreciates
the commitment to improving the resources of the County demonstrated by these applications.
The amount of funds currently in the Fish and Wildlife Propagation Fund is larger at present than in years
past. The increase may be partially due to increased awareness among agencies enforcing fish and game
regulations and that the Fish and Wildlife Propagation Fund is an appropriate account to deposit fine monies
resulting from negotiated settlements of regulation violations.
At the February 2006 meeting,the Committee recommended funding eleven proposed.projects to the County
Board of Supervisors.
1) Require three general commitments from all projects receiving funding from the Fish and
Wildlife Propagation Fund: a) return funds if the project is not performed; b) provide
documentation and/or accounting to show that funds were spent for the purpose described in
applications;and c)provide a brief summary report on the progress or results of the project by
April 15, 2007 [unanimous (9 ayes/0 noes)]
2) Appropriate $1800 to the Contra Costa Mosquito and Vector Control District for Trout in the
Classroom. The original grant proposal budget was for $1700. However, the District
requested an additional $100 to cover the additional cost of salmonid eggs. The Committee
approved an appropriation of $1800 from the Fish and Wildlife Propagation Fund for this
project [7 ayes/0 noes (2 Abstentions, Pellegrini and Belleci)]
3) Appropriate$900 to the Native Bird Connections for the Taxidermy for Education. This fund is
exclusively for saw whet owl ($200), copper's hawk($350) and red shouldered hawk($350).

4) Appropriate $9450 to Save Mount Diablo for Fencing Fish and Wildlife Protection, Mangini
Ranch. This fund is exclusively for the pond/creek fencing project(3000 ft; 5 strand, ten foot
center barbed wire Q $3.00/ft, 3 gates). [9 ayes/0 noes]
5) Appropriate$3250 to the Watershed Project for the Bayshore Stewardship Project. This fund
is exclusively for native plant nursery improvements. [9 ayes/0 noes]
6) Appropriate $10000 to the Muir Heritage Land Trust for Fernandez Ranch/Christie Road
Fencing and Illegal Dumping Prevention. [9 ayes/0 noes]
7) Appropriate $3200 to Lindsay Wildlife Museum for Antibiotics for Injured Wildlife. [8 ayes/0
noes (1 Abstention, Heckly)]
8) Appropriate $1840 to the Regional Parks Foundation in Partnership with the East Bay
Regional Park District for Prairie Falcon Telemetry Study. This fund is exclusively for 8 radio
transmitters at$230/unit. [9 ayes/0 noes]
9) Appropriate $4670 to the Kids for the Bay for the Watershed Action Program. This fund is
exclusively for the non personnel expenses, including native plants, mulch, gloves, shovels,
waders, reach extenders, and school bus rentals [9 ayes/0 noes]
10)Appropriate $250 to the California Bluebird Recovery Program for Lafayette Reservoir Nest
Box Expansion Program. [9 ayes/0 noes]
11)Appropriate$4900 to the Earth Team Environmental Network for Educators and Teens for the
Contra Costa County Watershed Education and Restoration Program. This fund is exclusively
for non personnel costs, including six bus rentals and plants. [9 ayes/0 noes]

The Fish and Wildlife Committee did not recommend funding the following applications (a brief,
partial explanation is provided below):

• Marsh Creek Fish Ladder project, proposed by Natural Heritage Institute. The Committee
had a concern over where this project is located. It felt there is not a suitable habit in the
upper stream of the location and thus a completed project will not greatly benefit fish in this
location. This year only 20 fish have been found at this location; the Committee felt that
other fish and wildlife resource projects recommended would benefit the County more.

• Interpretive Sign — Cerrito Creek project, proposed by Friends of Five Creeks. The
Committee has funded a similar signage project before for a different location for this
organization. The Committee felt other proposals would provide more benefit to fish and
wildlife resources in the County. [0 ayes/9 noes]
• Monitoring and applying non-lethal method to manage California ground squirrel
population, proposed by Lands for Urban Wildlife Inc. This project required permission
from the homeowner's association in the area to implement the proposed project, which
the grant applicant did not obtain prior to the submission of its grant application. The
Committee felt that project proposals submitted to the Fish and Wildlife Propagation Fund
should have permissions to perform proposed projects prior to the submission of
proposals. [0 ayes/9 noes]
• Pine Creek Salmon Spawning Enhancement Project proposed by Jim Schuricht. The
project requires permits from several entities to install a check dam, which the grant
applicant did not obtain prior to the submission of the proposal. The Committee felt that
project proposals submitted to the Fish and Wildlife Propagation Fund should have
permissions to perform proposed projects prior to the submission of proposals. [0 ayes/9
noes]
• ACREEC Environmental Education Projects proposed by Muir Heritage Land Trust(fiscal
sponsor of ACREEC). The Committee has funded a similar project to the beneficiaries of
the project, students of the Environmental Studies Academy in the past. It felt the project
would not convey as much benefit to public resources as other proposals the Committee
has recommend for funding. [0 ayes/9 noes]
• McNabney Marsh Viewing Platform Blind, proposed by Mt. View Sanitary District and Mt.
Diablo Audubon Society. The proposal stated that guided tours of the platform will take
place only four times a year, which the Committee felt would not convey much benefit to
public resources as other proposals it decided to recommend for funding. [0 ayes/9 noes]
• Leigh Creek Side Park Creek Bank Restoration, proposed by Friends of Lafayette Creeks.
Professional supervision fee included in the proposal seemed very high for only 180 finer
feet of creek bank that was affected by this project. The Committee felt other proposals
would provide more benefit to the fish and wildlife of the County. [0 ayes/9 noes]
• Volunteer Based Watershed Nursery for Kirker Creek Watershed and East Contra Costa
County, proposed by Contra Costa Resource Conservation District. The funds requested
were entirely a staff labor cost. The Committee has generally been in support of funding
education materials or restoration equipment and plants, while grant applicants pay for
labor cost associated with utilizing the above materials. Matching funds is not a
requirement by the Section 13101 of the Fish and Game Code to be considered for the
Fish and Wildlife Propagation Fund. However, the Committee feels it is reasonable in
suggesting grant seeking organizations to provide most of the labor to implement
environmental projects, when there is not a sufficient fund to fund all the submitted grant
applications. The Committee felt that the proposed project does not significantly improve
fish habitat, compared to other proposals that have been reviewed. [0 ayes/9 noes]
• Strentzel Meadow and Local Sites Native Plant Restoration, proposed by Friends of
Alhambra Creek. Most of the properties that the group plans to remove invasive plants are
privately owned and it was felt the project would not convey as much benefit to public
resources as the recommended projects. [0 ayes/9 noes]
• Classification of Contra Costa Hardwood Vegetation, proposed by University and Jepson
Herbaria c/o University of California Berkeley Sponsored Projects Office. 70% of the
proposed budget was salary of the University employees. The Committee has generally
been in support of funding education materials or restoration equipment and plants,while
grant seeking organizations try to match labor costs associated with utilizing the above
materials. Matching funds is not a requirement by the Section 13101 of the Fish and
Game Code to be considered for the Fish and Wildlife Propagation Fund. However, the
Committee feels it is reasonable in suggesting grant applicants to provide a majority of
labor to implement environmental projects, when there is not a sufficient fund to fund all
the submitted grant applications. The Committee felt other proposals would provide more
benefit to the fish and wildlife of the County. [0 ayes/9 noes]
• Contra Costa County Sheriff's Marine Services Operation, proposed by Contra Costa
County Sheriff's Office Marine Services. The original proposal lacked information on
budget details. Only 20 Fish and Game violations were sited by the Marine Services unit in
2005. The Committee felt it was too excessive to fund this project at this time. [0 ayes/9
noes]
• Overnight Trip to Sempervirens Outdoor School in Santa Cruz proposed by Shannon
Elementary School Combined Sixth Grades. The Committee felt that similar
environmental education programs are available in or nearby Contra Costa County. The
Committee encourages Shannon Elementary School to work with organizations in the

County,which may focus on educating natural resources specific to the County. [0 ayes/9
noes]
• Lime Ridge North Habitat Improvement Corridor project, proposed by Walnut Creek Open
Space Foundation. The Committee has funded a similar project several times in the past
and felt the project would not convey as much benefit to public resources as other
proposals the Committee decided to recommend for funding. The proposal also lacked
details on its budget. [0 ayes/9 noes]
• Wildcat Creek Environmental Education Program proposed by Ma'at Youth Academy. The
project lacked detailed budget information. [0 ayes/9 noes]
• Backyard Nurseries Program, proposed by Alhambra Valley Creek Coalition. The
proposed project uses private residents to propagate and plant vegetations in the
Alhambra Creek watershed. The proposal lacked information on qualifications of these
individuals that will be responsible for growing plants in their backyards and thus a
success of the project was not certain. [0 ayes/9 noes]
• Education Process for Improvement of Fish and Wildlife Habitat, proposed by Orinda
Union School District/Wagner Ranch Nature Area. The project lacked detailed information
on its proposed project as well as its budget. History of this project was not clearly stated,
which did not help the Committee envision the success of this project. [0 ayes/9 noes]
• Wildlife Habitat Restoration on Elkhorn Creek proposed by Carquinez Regional
Environmental Education Center(CREEC). The funds requested were mostly labor. The
Committee has generally been in support of funding education materials or restoration
equipment and plants,while grant applicants pay for labor cost associated with utilizing the
above materials. Matching funds is not a requirement by the Section 13101 of the Fish
and Game Code to be considered for the Fish and Wildlife Propagation Fund. However,
the Committee feels it is reasonable in suggesting grant applicants to cover a majority of
labor cost to implement environmental projects, when there is not a sufficient fund to fund
all the submitted grant applications. [0 ayes/9 noes]
• Kids Creek Fest 2006 proposed by Parents for a Cleaner Environment. The proposed
project will provide a one-day festival to educate children on urban run-offs, habitat
restoration, along with recycling and integrated pest management. The Committee felt
that providing educational materials at such an event where children may not be able to
focus their attentions well may not convey as much benefit to wildlife of the County as the
recommended projects. [0 ayes/9 noes]
The Fish and Wildlife Committee did not consider the following proposals for the 2005/2006 Fish
and Wildlife Propagation Fund grant program (a brief, partial explanation is provided below):
• Baxter Creek Gateway Volunteer Stewardship Program,proposed by the Friends of Baxter
Creek Administrated by the Watershed Project. This proposal was submitted to the
County Community Development office after the due date.
• Streamside Revegetation Project, proposed by San Pablo Watershed Neighbors
Educations and Restoration Society. This proposal was submitted to the County
Community Development office after the due date.
• Improving the Wildlife Value or an Agricultural Property in East Contra Costa County by
Contra Costa Resource Conservation District. The Contra Costa Resource Conservation
District withdrew its grant application in February 2006.
• Sandshed Analysis for the California Legless Lizard proposed by Legless Lizard Working
Group. The Legless Lizard Working Group withdrew its grant application in February
2006.
The Fish and Wildlife Committee unanimously recommend using no more than $2200 from the Fish and
Wildlife Propagation Fund to purchase a deer decoy to improve the Fish and Game Code enforcement in
Contra Costa County. The Committee has been working with the California Department of Fish and
Game (DFG) to assist regional wardens with reducing Fish and Game Code violations. Wildlife decoys
have been used successfully throughout the State. The primary goals for the use of the deer decoy is to
deter violations, reduce illegal hunting and related violations, reduce the unlawful harvest of deer and
reduce the threat of injury to both the public and property. This decoy will be used by the DFG's
i enforcement branch throughout Contra Costa County. After the purchase, it will be donated to the DFG
and the DFG will be fully responsible for maintaining it and liabilities that may arise during the course of its
use. This purchase is consistent with the expenditure criteria established by State Law(Fish and Game
Code Section 13103-g).

RE: Requests for funding from the Fish and Wildlife Propagation Fund
The Contra Costa County Fish and Wildlife Committee is pleased to announce the availability of funds from the
Contra Costa County Fish and Wildlife Propagation Fund. The Fish and Wildlife Committee requests the
submission of completed Funding Applications(attached). Proposals need to be received by 5:00 p.m.on Thursday,
December 29,2005 (a postmark of December 29`h does not satisfy the submission deadline). Recommendations of
the Fish and Wildlife Committee will be forwarded to the Contra Costa County Board of Supervisors, which
maintains final decision-making authority for expenditures from the Fund. Successful applicants may anticipate
receiving funding awards by the spring of 2006.
The Contra Costa County Fish and Wildlife Propagation Fund is entirely supported by fine revenues which result
from violations of the Fish and Game Code and Title 14 of the California Code of Regulations in Contra Costa
County. Expenditures made from the Fund must benefit the fish and wildlife resources of the County. Projects
awarded funds from the Fish and Wildlife Propagation Fund must meet the requirements of Section 13103 of the
Fish and Game Code (attached) which describes the types of projects that may be eligible. Though all projects
which meet the requirements of Section 13103 will be considered, the Fish and Wildlife Committee strongly
encourages applications relating to activities to protect and conserve fish and wildlife,including improvement of fish
and wildlife habitat,public education about fish and wildlife conservation,and scientific fish and wildlife research in
Contra Costa County. The Fish and Wildlife Committee generally does not recommend funding for operating costs
and overhead. The funds also need to be expended within a year of receiving funds from the Committee(i.e. spring
of 2007). Grant applicants need to submit their final project report at the same time.
The Committee expects to recommend awards to several applicants. However, it is possible that a particularly
excellent proposal will be recommended to receive a large portion of the total available funds. Awardees will be
asked to provide a summary of the outcome of the project and an explanation of how awarded funds were spent.
During the 2004/2005 grant cycle a total of$94,471 was awarded to 17 projects. The awards ranged from $480 to
$10,000. The Fish and Wildlife Committee appreciates your interest in this opportunity to improve the fish and

13103. Expenditures from the fish and wildlife propagation fund f /
county may be made only for the following purposes:
(a) Public education relating to the scientific principles of fish and wildlife
conservation, consisting of supervised formal instruction carried out pursuant to a
planned curriculum and aids to education such as literature, audio and video
recordings,training models, and nature study facilities.
(b) Temporary emergency treatment and care of injured or orphaned wildlife.
(c) Temporary treatment and care of wildlife confiscated by the department as evidence.
(d) Breeding, raising, purchasing, or releasing fish or wildlife which are to be released
upon approval of the department pursuant to Sections 6400 and 6401 onto land or
into waters of local, state, or federal agencies or onto land or into waters open to the
public.
(e) Improvement of fish and wildlife habitat, including, but not limited to, construction
of fish screens, weirs, and ladders; drainage or other watershed improvements;
gravel and rock removal or placement; construction of irrigation and water
distribution systems; earthwork and grading; fencing; planting trees and other
vegetation management; and removal of barriers to the migration of fish and
wildlife.
(f) Construction, maintenance, and operation of public hatchery facilities.
(g) Purchase and maintain materials, supplies, or equipment for either the department's
ownership and use or the department's use in the normal performance of the
department's responsibilities.
(h) Predator control actions for the benefit of fish or wildlife following certification in
writing by the department that the proposed actions will significantly benefit a
particular wildlife species.
(i) Scientific fish and wildlife research conducted by institutions of higher learning,
qualified researchers, or governmental agencies, if approved by the department.
(j) Reasonable administrative costs, excluding the costs of audits required by Section
13104, for secretarial service, travel, and postage by the county fish and wildlife
commission when authorized by the county board of supervisors. For purposes of
this subdivision, "reasonable cost" means an amount which does not exceed 3
percent of the average amount received by the fund during the previous three-year
period, or three thousand dollars ($3,000) annually, whichever is greater, excluding
any funds carried over from a previous fiscal year.
(k) Contributions to a secret witness program for the purpose of facilitating enforcement
of this code and regulations adopted pursuant to this code.
(1) Costs incurred by the district attorney or city attorney in investigating and
prosecuting civil and criminal actions for violations of this code, as approved by the
department.
(m) Other expenditures, approved by the department, for the purpose of protecting,
conserving, propagating, and preserving fish and wildlife.

Dear Contra Costa County Fish and Wildlife Committee,
Please find the enclosed 2006 Fish and Wildlife Propagation Fund Grant application.
With the help of this fund, the Watershed Project continues to grow its Richmond
Bayshore Stewardship program. In fact, this year the program propagated and plans to
plant more then 10,000 locally native plants of more than fifty different species into a
tidal marsh and upland habitat restoration project at West Stege Marsh in Richmond,
protecting and enhancing habitat for numerous wildlife species.
Additionally, the Richmond Bayshore Stewardship program works to educate and
inform students and community members about fish and wildlife habitat conservation,
offering workdays and student programs for all ages.
The Watershed Project truly appreciates the support the Contra Costa County Fish and
Wildlife Committee supplied over the last two years, and looks forward to continuing to
grow the program with their support. This year we plan to build on past successes, with
funds needed to continue plant propagation and planting efforts, make improvements to
our nursery, monitor and control Harding grass within the rare coastal prairie habitat,
and involve volunteers and students in the project.

1) Description of the project for which funding is requested:
The San Pablo Creek Watershed is one of the largest and most geographically diverse in
the East Bay. The creek drains 41 square miles of land ranging from near pristine oak
woodlands in portions of the upper watershed to the suburbanized and urbanized
regions in the lower watershed of El Sobrante, Richmond, and San Pablo.
Midway along San Pablo Creek lies the East Bay Municipal District's San Pablo Dam and
Reservoir. Below the Dam, the creek flows through a broad valley draining Richmond
and El Sobrante before entering San Pablo and flowing to the Bay. As it flows through
the El.Sobrante Valley it is joined by three year-round and more than twelve ephemeral
creeks. Most of the creek main stem is above ground and more than eighty percent of it
is privately owned. San Pablo Creek and its tributaries function as a riparian wildlife
corridor in an area where development threatens remaining open space.
SPAWNERS has established a native plant demonstration garden at the El Sobrante
Library which is situated on the right bank of San Pablo Creek. Last year SPAWNERS
began a three year streamside revegetation project to restore native habitat down the
bank to the Creek. In the first year we cleared and revegetated one quarter of the
restoration area. We plan to complete an additional one third in Year II, and the
remainder in Year III. We are requesting funding form the Contra Costa Fish and
Wildlife Committee for Year II tasks and materials.

SUBJECT: Purchase of a deer decoy
As discussed at the previous Fish and Wildlife Committee (FWC) meetings, the California Department
of Fish and Game has requested the FWC to purchase a deer decoy by using funds from the Fish and
Wildlife Propagation fund account. Discussion on recommending a release of fund to purchase the
decoy to the County Board of Supervisors will be held at the March meeting. This purchase is consistent
with the expenditure criteria established by State Law (Fish and Game Code Section 13103 —g).
The deer decoy will be delivered to the Department directly and will be used and maintained by the
Department, as its own property, after the County Board of Supervisors approves the expenditure. The
Department is responsible for any liabilities that may arise during the course of use, by signing a release
of liability letter from the County Community Development Department.
Wildlife decoys have been used successfully throughout the State. They are intended to aid in the
apprehension of the individuals who are predisposed to violate Fish and Game codes. The primary goals
for the use of the deer decoy is to deter violations, reduce illegal hunting and related violations, reduce
the unlawful harvest of deer and reduce the threat of injury to both the public and property. The decoy
that is requested by the Department is a mechanical life size deer that is placed in areas that have
reported problems of deer poaching or are suspected to have a deer poaching problem. The estimated
total price of the decoy is $1922.31, provided by Custom Robotic Wildlife. The decoy will be used by
the Department's enforcement branch throughout Contra Costa County. A minimum of three wardens
are present during the deployment of the decoy.
