FINANCIAL IMPACT: No fiscal impact. CHILDREN'S IMPACT STATEMENT This action impacts one of the community outcomes: 4) Families that are Safe, Stable and Nurturing. BACKGROUND: On June 2, 1998, the Contra Costa County Board of Supervisors approved Resolution No. 98/299 adopting the implementation of SB 468 which allows child welfare services of a social service department to obtain a criminal record through the California Law Enforcement Telecommunications System (CLETS) from municipal, County, or State law enforcement entities to assess the household of a relative who has agreed to receive a minor. The Board further authorized the EHSD to enter into inter-jurisdictional agreements with law enforcement agencies within the County to provide access to CLETS, including during non-business hours at night and on weekends. The Department of Justice has requested that specific language set forth in the new Resolution be included in any action implementing SB 468. AYES: NOES: ABSENT: ABSTAIN: /) J ATTESTED: CONTACT: Karen Mitchoff,EHSD JOHN B.CULLEN,CLERK OP THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY �/ ' - DEPUTY I ` The Board of Supervisors of Contra Costa County , California In the Matter of the Employment and ) Human Services Department Utilizing the ) California Law Enforcement ) Telecommunication System ) RESOLUTION NO. 2006/163 WHEREAS,on June 2, 1998, the Contra Costa County Board of Supervisors approved Resolution No. 98/299 adopting the implementation of SB 468 which allows child welfare services of a social service department to obtain a criminal record through the California Law Enforcement Telecommunications System (CLETS)from municipal, County, or State law enforcement entities to assess the household of a relative who has agreed to receive a minor; and WHEREAS, The Board of Supervisors authorized the Employment and Human Services Department to enter into inter jurisdictional agreements with law enforcement agencies within the County to provide access to CLETS, including during non-business hours at night and on weekends; and WHEREAS, the Department of Justice has requested the specific language set forth in the following paragraphs be included in any resolution implementing SB 468; and WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) authorize cities, counties and districts to access state and local summary criminal history information for employment, licensing or certification purposes; and WHEREAS, Penal Code Section 11105(b)(10) authorizes cities, counties and districts to access federal level criminal history information by transmittingfingerprint images and related information to the Department of Justice to be transmitted to the Federal Bureau oflnvestigation; and WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) require that there be a requirement or exclusion from employment, licensing, or certification based on specific criminal conduct on the part of the subject of the record; and WHEREAS,Penal Code Sections 11105(b)(10)and 13300(b)(10)require the City Council,Board of Supervisors, or governing body of a city, county or district to specifically authorize access to summary criminal history information for employment, licensing, or certification purposes. NOW, THEREFORE, BE IT RESOLVED that Contra Costa County Employment and Human Services Department, Children and Family Services Bureau, is hereby authorized to access state and federal level summary criminal history information for employment (including volunteers and contract employees), licensing, or certification purposes and may not disseminate the information to a private entity; and BE IT FURTHER RESOLVED that Contra Costa County Employment and Human Services Department, Children and Family Services Bureau,shall not consider a person who has been convicted of a felony or misdemeanor involving moral turpitude eligible for employment (including volunteers and contract employees), or licensing; except that such conviction may be disregarded if it is determined that mitigating circumstances exist, or that the conviction is not related to the employment, volunteer or license in question.
