DATE: April 4, 2006 PAGE: 2 of 2 FISCAL IMPACT: No impact to the County GeI l eral Fund (State Waters Resources Control Board/CALFED Prop 13 Grant). REASONS FOR RECOMMENDATIONS AND BACKGROUND: In order to comply with the Statewide General National Pollutant Discharge Elimination System requirements and a Grant Agreement entered into with the State Water Resources Control Board/CALFED Bay Delta Program, the County entered into an agreement with the California Coastal Commission and Department of Boating and Waterways to assist with implementation of the Contra Costa County Marina Program called the"Keep the Delta Clean."These agencies arel entering into an amended agreement(JEPA)to extend the term of the Agreement from its original expiration date of December 31,2005 to March 31,2006. The extension will provide more time to assist the County with additional tasks. See Section 2, for the changes made to the original Scope of Work. I CONSEQUENCES OF NEGATIVE ACTION: If the County does not prof ess the amended JEPA,the County and the other entities will not be in compliance with its obligations outlined inithe Grant Agreement with the State Water Resources Control Board and CALFED Bay- Delta Program. I i I I I I I I I FIRST AMENDMENT TO JOINT EXERCISE OF POWERS AGREEMENT AMONG CONTRA COSTA COUNTY, CALIFORNIA COASTAL COMMISSION, AND DEPARTMENT OF BOATING AND WATERWAYS TO PROVIDE TECHNICAL ASSISTANCE FOR A PROJECT FUNDED BY THE STATE WATER RESOURCE CONTROL BOARD/CALFED PROP 13 GRANT IPROGRAM This Amendment is effective as of the 31St day of December, 2005 and is entered into by and among the COUNTY OF CONTRA COSTA, a political subdivision of the State of California, hereinafter referred to as "COUNTY", an the DEPARTMENT OF BOATING AND WATERWAYS, a California state agency, and hereinafter referred to as "DBW", and the CALIFORNIA COSTAL COMMISSION, a state agency established pursuant to Section 30300 of the California Coastal Act of 1976 (California Public Resources Code section 30000 et seq.) and hereinafter referred to as "CCC", pursuant to Government Code section 6500 and who mutually agree and promise as follows: i RECITALS WHEREAS COUNTY, DBW and CCC entered into Joint Exercise of Powers Agreement Between Contra Costa County, Department of Boating and Waterways,:and California Coastal Commission to Provide Technical Assistance of a Project;Funded by the State Water Resource Control Board/Calfed Prop 13 Grant Program (Agreement), effective July 1, 2004; WHEREAS the Parties desire to extend the term of the Agreement from the original:expiration date of December 31, 2005 to a new expiration date of Marc;$) 31, 2006; WHEREAS the Parties desire to add additional tasks to assist with the implernentlation of the Contra Costa Marina Program NOIW, THEREFORE, for and in consideration of the mutual benefits, covenants and agreements set forth herein, the Parties agree to amend the Agreement as follows: AMENDMENT 1. Paragraph 9 of the Agreement is deleted in its entirety and replaced with the following; "Agreement Termination. Unless terminated earlier through the mutual, written consent of the parties, this agreement shall terminate on March 31, 2006. Thereafter, the CCC will have 60 days to submit invoices for final payment." Page 1 of , j 2. Appendix A, "Scope of Services" is amended by the addition of the following paragraphs: a. "B. 6. Distribute marine supply store displays to Unincorporated Contra Costa County marine supply shops and other appropriate outlets." b. "B. 7. Assist with the development and distribution of the "Clean Boating Theme" posters and fliers to marinas in the Delta." c. "D.17. Analyze the results from the Recreational Boarder Survey and prepare a summary report. d. "'D.8. Prepare a summary report of Delta section of the Needs Assessment that was prepared for the California Integrated Waste Management Board. i e. "D,'. 9. Work with Contra Costa County Public Works Department and Contra Costa County Water District in the development of a Model for assessing the potential effectiveness of boarder education efforts in the Delta." I f. "E.4. Assist the County and Department Boating and Waterways in organizing and facilitating the March 2006 Sacramento-San Joaquin Delta Meeting. g. "E.5. Assist the County in the development of the January-February issue of the Changing Tides newsletter." h. H. Public Education and Outreach 1.
