SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1. APPROVE the Second Amendment to the Lease with Thomas E. Stewart to extend the term of
the existing lease for the premises at 816 Main Street, Martinez, from April 1, 2006 to December
31, 2006, for continued occupancy by the Clerk-Recorder, under the terms and conditions more
particularly set forth in the Lease Amendment.
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease
Amendment, and to EXERCISE any options to extend the Lease.
FINANCIAL IMPACT
Extending the term of this Lease was anticipated and budgeted in the Clerk-Recorder's approved FY
2005/06 budget and requested FY 2006/07 budget. The rent for the period from April 1, 2006
through December 31, 2006 is $43,065.
BACKGROUND
Approval of the Lease Amendment will provide for continued use of approximately 3,140 square feet
of office space as requested by the Clerk-Recorder. The Clerk-Recorder has occupied this location
since 2002.
The Clerk-Recorder intends to vacate this building upon completion of the new Clerk-
Recorder/Elections building currently under construction at 555 Escobar Street in Martinez. Approval
of the Second Amendment to Lease will extend the term of the lease from April 1, 2006 to December
31, 2006, at a rental rate of $4,785 per month, and will provide office space to support for the Clerk-
Recorder's operations until the new building is completed.

SECOND AMENDMENT TO LEASE
816 MAIN STREET
MARTINEZ, CALIFORNIA
FOR THE
CONTRA COSTA COUNTY CLERK-RECORDER
1. PARTIES: Effective on APR 4 2006 , THOMAS E. STEWART,
hereinafter called "LESSOR," and COUNTY OF CONTRA COSTA, a political
subdivision of the State of California, hereinafter called "COUNTY," mutually agree and
promise as follows:
2. PURPOSE: The parties desire to amend that Lease dated September 17, 2002,
and amended March 4, 2003, entered into between LESSOR and COUNTY for
approximately 3,140 square feet of office space commonly known and designated as 816
Main Street, Martinez, California, for the purpose of adding an option to extend the term
of the Lease as follows:
3. AMENDMENT:
Paragraph 4.5 EXTENSION, as added by the First Amendment to Lease dated March 4,
2003, is amended to add a fourth extension option, to read as follows:
A.4.5. EXTENSION: This Lease may, at the option of COUNTY, be extended
upon the same terms and conditions, except the rental shall be adjusted as follows:
a. First Option: For a six (6) month term commencing October 1, 2004 and
ending March 31, 2005, at a monthly rental of FOUR THOUSAND SIX
HUNDRED AND NO/100 DOLLARS ($4,600.00).
b. Second Option: For a six (6) month term commencing April 1, 2005 and
ending September 30, 2005, at a monthly rental of FOUR THOUSAND
SIX HUNDRED AND NO/100 DOLLARS ($4,600.00).
C. Third Option: For a six (6) month term commencing October 1, 2005 and
ending March 31, 2006, at a monthly rental of FOUR THOUSAND

($4,785.00).
d. Fourth Option: For a nine (9) month term commencing April 1, 2006 and
ending December 31, 2006, at a monthly rental of FOUR THOUSAND
SEVEN HUNDRED EIGHTY-FIVE AND N0/100 DOLLARS
($4,785.00).
It is understood and agreed that COUNTY shall give LESSOR sixty (60)
days prior written notice of its intention to exercise any option to extend this
Lease. However, in the event COUNTY does not give such written notice, its
right to exercise any option before termination of this Lease shall not expire until
fifteen (15) working days after receipt of LESSOR'S written demand to exercise
or forfeit said option.

4. EFFECT: Except for the Amendment agreed to herein, the Lease dated
September 17, 2002 and amended March 4, 2003, remains in full force and effect.
