RECOMMENDATION
1. APPROVE the Fourth Amendment to the Lease with Earl D. Dunivan and Joanne Dunivan to
extend the term for the 822 Main Street portion of the lease for the premises at 822 and 826
Main Street, Martinez from April 1, 2006 to December 31, 2006, for continued occupancy by the
Clerk-Recorder, under the terms and conditions more particularly set forth in the Lease
Amendment.
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease
Amendment, and to EXERCISE any options to extend the Lease.
FINANCIAL IMPACT
Extending the term of this Lease was anticipated and budgeted in the Clerk-Recorder's approved FY
2005/06 budget and the requested FY 2006/07 budget. The rent at 822 Main Street for the period
from April 1, 2006 through December 31, 2006 is $28,710. The rent for 826 Main Street remains
unchanged.
BACKGROUND
The buildings located at 822 and 826 Main Street in Martinez are separate, but adjacent, office
buildings occupied by two different County departments that have been combined into one lease.
The 822 Main Street building contains approximately 2,580 square feet of office space and has been
occupied by the Clerk-Recorder since 1984. The 826 Main Street location contains approximately
1,350 square feet of office space and has been occupied by the Health Services Department since
1991.
The Clerk-Recorder intends to vacate the 822 Main Street building upon the completion of the new
Clerk-Recorder/Elections building currently under construction at 555 Escobar Street in Martinez.
Approval of the Fourth Amendment to Lease will extend the term of the lease as it applies to the 822
Main Street space from April 1, 2006 to December 31, 2006, at a rental rate of $3,190 per month, and
will provide for the Clerk-Recorder's occupancy until the new building is completed. The terms of the
lease as they apply to the 826 Main Street location will not be c a 8d by this Lease Amendment.

FOURTH AMENDMENT TO LEASE
822-826 MAIN STREET
MARTINEZ, CALIFORNIA
FOR THE
CONTRA COSTA COUNTY CLERK-RECORDER
HEALTH SERVICES DEPARTMENT
1. PARTIES: Effective on APR 6 4 2006 EARL D. DUNIVAN and
JOANNE DUNIVAN, hereinafter together called "LESSOR," and COUNTY OF
CONTRA COSTA, a political subdivision of the State of California, hereinafter called
"COUNTY," mutually agree and promise as follows:
2. PURPOSE: The parties desire to amend that Lease dated May 22, 1984, and
amended June 11, 1991, April 28, 1998, and April 1, 2003, entered into between
LESSOR and COUNTY for approximately 2,580 square feet of office space commonly
known and designated as 822 Main Street, Martinez, California, and 1,350 square feet of
office space commonly known and designated as 826 Main Street, Martinez, California,
totaling 3,930 square feet, for the purpose of adding an option to extend the term of the
Lease as follows:
3. AMENDMENT:
Paragraph 5.1 EXTENSION, added by paragraph 3 AMENDMENT of the Third
Amendment to Lease dated April 1, 2003, shall be deleted in its entirety and replaced
with the following:
5.1 EXTENSION: For the purposes of this paragraph and this paragraph only,
822 Main Street and 826 Main Street shall be considered to be separate properties,
and, as such, the extensions may be exercised individually. This Lease may, at the
option of the COUNTY, be extended upon the same terms and conditions, except
the rental shall be adjusted as follows:
822 Main Street
a. First Option: For a six (6) month term commencing October 1, 2004 and

ending March 31, 2005, at a monthly rental of TWO THOUSAND NINE
HUNDRED FIFTY AND NO/100 DOLLARS ($2,950.00).
b. Second Option: For a one (1) year term commencing April 1, 2005 and
ending March 31, 2006, at a monthly rental of THREE THOUSAND
SEVENTY AND NO/100 DOLLARS ($3,070.00).
C. ThirdiOption: For a nine (9) month term commencing April 1, 2006 and
ending December 31, 2006, at a monthly rental of THREE THOUSAND
ONE HUNDRED NINETY AND NO/100 DOLLARS ($3,190.00).
826 Main Street
a. First Option: For a two (2) year term commencing April 1, 2007 and
ending March 31, 2009 at a monthly rental of ONE THOUSAND SEVEN
HUNDRED THIRTY-FIVE AND NO/100 DOLLARS ($1,735.00) for the
period commencing April 1, 2007 and ending March 31, 2008, and ONE
THOUSAND EIGHT HUNDRED FIVE AND NO/100 DOLLARS
($1,805.00) for the period commencing April 1, 2008 and ending March 31,
2009.
It is understood and agreed that COUNTY shall give LESSOR ninety (90)
days prior written notice of its intention to exercise any option to extend this
Lease. However, in the event COUNTY does not give such written notice, its
right to exercise any option before termination of this Lease shall not expire until
fifteen (15) working days after receipt of LESSOR'S written demand to exercise
or forfeit said option.

4. EFFECT: Except for the Amendment agreed to herein, the Lease dated
May 22, 1984 and amended June 11, 1991, April 28, 1998, and April 1, 2003,
remains in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment as of the date set
forth above.
