BACKGROUND/REASON(S) FOR RECOMMENDATION(S): Nighttime activities along the road generate refuse, trash, and human waste. Arson, vandalism, trespassing, discharging of firearms, parties involving drugs and alcohol, and malicious activities leading to the death of livestock has resulted in a concerted effort by property owners, the City of Antioch,the California Highway Patrol,Contra Costa County Fire Protection District, and County Sheriff to close the road. The County Public Works Department supports this temporary closure and recommends that the Board of Supervisors support this request, and that they approve Traffic Resolution No. 2006/4162. The City of Antioch has passed a resolution (see attachment with supporting letters) to close the portion of Empire Mine Road that is in the City. CONSEQUENCES OF NEGATIVE ACTION: The County would not be able to close the road and the nighttime activities that are occurring along the road would continue. As you may be aware, the road is 3.5 miles in length and extends from Deer Valley Road in the County to Mesa Ridge Drive in the City of Antioch. The 0.5 mile portion from Deer Valley Road to the Antioch City Limits line is located in the County and the subject of this letter. At their September 13, 2005 meeting, the Antioch City Council adopted a resolution temporarily closing Empire-Mine Road to vehicular traffic within the City. Criminal activity in the area, including arson, vandalism, dumping, trespassing, discharging firearms and other illegal activities have become such a problem that requests from the adjacent property owners, County Sheriff, Highway Patrol, County Fire Protection District, Antioch Public Works Maintenance and Antioch Police Department prompted the Council action. In speaking with Fil, he recommended I send you the information we had presented to the Council along with current traffic counts which our traffic group has just gathered. The Council directed staff not to proceed with closure of the road until the County Board of Supervisors has had an opportunity to vote on a similar resolution. It is Antioch's request that the County staff prepare a staff report and recommendation to temporarily close the County portion of the road to vehicular traffic. The City's resolution permits use of the road by bicycle and pedestrian traffic with a locked gate system that would permit access to emergency, maintenance and delivery vehicles and equipment. Additionally, a single residence on the Higgins Ranch property (located in Antioch) gains access to their property via the road. Mine Road Between Mesa Ridge Drive and Deer Valley Road RECOMMENDATION It is recommended that the. City Council conduct a public hearing and approve the resolution temporarily closing Empire Mine Road from Mesa Ridge Drive to the City Limit Line 2600' west of Deer Valley Road for an initial period of eighteen (18) months as a measure to reduce criminal activity in the area. BACKGROUND INFORMATION Empire Mine Road, a scenic and somewhat isolated road, is located in the southwest portion of the City in undeveloped Future Urban Area 1 (FUA 1) and in unincorporated Contra Costa County. The 3.5 mile stretch of two lane paved road with gravel shoulders that extends from Mesa Ridge Drive in the Dallas Ranch Subdivision to Deer Valley Road in the County has been a long-time source of consternation for adjacent land owners and the law enforcement community. Arson, vandalism, dumping, trespassing, discharging of firearms, parties involving the, use of drugs and alcohol, and malicious activities leading to the death of livestock has resulted in a concerted effort by property owners (especially rancher Jack Roddy), the Antioch Police Department and County Sheriff to close the road. Fronting property owners include Ginochio, Richland Development Corporation, Shea Adult Communities, Zeka Group, The Golf Course at Roddy Ranch (Merchant Land Fund LLC), East Bay Regional Park District, and City open space adjacent.to developed residential property. The road is generally flat with a steep windy portion for a stretch of around three quarters of a mile from the old Higgins Ranch driveway (Zeka property) up to Mesa Ridge Drive. The "Feed Lot/Concert Barn" and the "Gates of Hell" both located along Empire Mine Road have long been gathering places for adults and juveniles who regularly participate in illegal activities. Further interest in the Empire Avenue area can be attributed to a website that has a section devoted to haunted places in California. The "Gates of Hell" and "Slaughterhouse" (Feed Lot/Concert Barn) have both been listed as locations people are encouraged to explore. According to statistics provided by the Antioch Police Department, from August 2002 until August 2003, the. Department responded to 153 calls for service. The majority of RB:tll 9-13-05 these calls related to a variety of criminal violations including trespassing, vandalism, littering, arson and discharging firearms. During the same period, the Sheriff's Department reported 25 calls for service related to vandalism, trespassing, stolen vehicles, assaults and littering. The Fire District reported 21 calls for service that were generally related to grass and brush fires and. some structure fires contained within the Feed Lot/Concert Barn property. Additionally, the Fire District also responded to 8 accidents in this area. More recent numbers show the Police Department had. 75 calls for service from May 2004 until May 2005. The Police Department has also conducted several directed enforcement operations where officers would watch and wait for criminal offenses in the areas of the Feed Lot/Concert Barn property. These enforcement activities resulted in citations for trespassing, vandalism and parking. Illegal dumping has become a significant and costly problem for the City. Locations such as Empire Mine Road are particularly attractive for illegal dumpers because of its isolated location and lack of street lighting. From July 2004 until July 2005, the Public Works Department streets crews spent $3,940 picking up debris and garbage dumped along .Empire Mine Road. At a cost of $2,013, eleven No Parking signs were also installed along this road to discourage vehicles from parking near Gates of Hell and the Feed Lot/Concert Barn. As a result of these problems, some of the neighboring property owners have requested the road be closed. Attached are letters to the City from adjoining property owners including The Golf Club at Roddy Ranch and Richland Development Corporation. The owners of the Golf Club at Roddy Ranch have agreed to construct the gates and turn arounds at the gates aspart of the temporary road closure process. City staff has contacted the County since they own and maintain the road from Deer Valley Road to the City limits 2600' to the west. Staff at the County Public Works Department has indicated their intention to take an item to their Board of Supervisors that would authorize the closure of the County's portion of the road. Should the City Council authorize the temporary closure of the road, staff recommends the action not take affect until the County has made a similar decision (or not if they so choose). Additionally, the attached letters from the Contra Costa County Sheriff's office and the Contra Costa County Fire Protection District also submitted letters recommending the road be temporarily closed. There have been several requests from the public to keep the road open to bicyclists and pedestrians. Neither the Chief of Police nor the City Attorney believes honoring that request will create significant issues for the City. For this reason, staff is recommending the road be closed to all through vehicular traffic with provisions for access maintained for the residents on the Higgins property, City and County Public Works workers, emergency response personnel as well as pedestrians and bicyclists. The City Attorney has recommended the use of Vehicle Code section 21101.4 which authorizes the temporary closure of roads due to .criminal activity. As stated in the attached resolution, seven findings must be made by the City Council in order to temporarily close the road for an initial period of 18 months. The closure may be extended for five additional 18 month periods with each time.extension requiring a public 2 hearing. All property owners adjacent to the road have been given notice of the public hearing. As evidenced by the letters of support; most of the property owners fronting on Empire Mine Road are in favor of the temporary closure. FINANCIAL IMPACT The cost of installing the two gates and turn-around at the City Limits is approximately $10,000. The owners of The Golf Course at Roddy Ranch have indicated they will fund and construct the installation. In the event these owners or the.other property owners benefiting from the road closure do not construct the improvements, the City could fund part or all of the improvements from Street Maintenance or General Fund. If the County approves the closure of the 2600' portion of Empire Mine Road between the City. limits and Deer Valley Road, they would be responsible for designing and funding the closure of the road at this location. OPTIONS The City Council may choose to not approve the temporary closure of the road to vehicles. This is not recommended by staff. In addition to temporarily closing the road to vehicles, the. City Council may choose to prohibit bicycle and pedestrian traffic as well. The City Council may make the temporary closure of Empire Mine Road conditioned upon the owners of The Golf Course at Roddy Ranch funding of the construction of the gates and turn-around at both ends of the closure. A duly-noticed public hearing was conducted by the City Council on September 13, 2005, at which all interested persons were allowed to address the Council. Notice was mailed to all residents and owners, as shown on the last equalized assessment roll, of property adjacent to Empire Mine Road; 2. The Police Department recommends closure of the road. Field Services Division commander Stephen J. McConnell has authored a memorandum dated July 13, 2005, on file with the Office of the City Attorney, which the City Council incorporates by reference. In summary, Capt. McConnell reports the following: a. Empire Mine Road is an attractive nuisance due to its rural, undeveloped and isolated location. The private property owners on both sides of the road have submitted "no trespass letters" to the Police Department and have posted their property as. "no trespassing", but the signs are removed almost as quickly as they are posted; b. Two points of interest, the "Feed Lot/Concert Barn" and the "Hell's Gates" have attracted both juveniles. and adults as sites for drinking and drug use. Other crimes reported in these areas are robbery, assaults, littering, vandalism, trespassing, arson, traffic accidents, discharging of firearms, and killing of livestock. c. There is a web site devoted to perpetuating urban myths related to Empire Mine Road. This site urges readers to go to the area, but to watch out for police. This web site has attracted even more interest and encouraged people from outside the Antioch area to flock to the area; d. Empire Mine Road has experienced-an inordinate number of calls for service from the Antioch Police Department, the Contra Costa Sheriff's Office, and the Contra Costa County Fire Protection District. The Contra Costa County -Sheriff's Department and the California Highway Patrol have recommended closure of Empire Mine Road in respect to the segment of the roadway traversing through unincorporated territory, due to serious and continual criminal activity; 4. From the foregoing, the Council concludes that Empire Mine Road experiences serious and continual criminal activity, and temporary closure will substantially reduce or eliminate such criminal activity; 5. .Empire Mine Road has not been designated as a through highway or arterial street; 6. Vehicular traffic on the road contributes to the criminal activity; 7. The closure will not substantially adversely affect the following: a. traffic flow or traffic safety on adjacent streets or surrounding neighborhoods, because Empire Mine Road does not have any public cross streets along its length and is not necessary to travel to any other neighborhoods; b. operation of emergency vehicles, because other routes provide better linkages to destinations of emergency vehicles. Gates used to close the road will be equipped with lock types that can be removed by emergency responders if it is necessary for response along Empire Mine Road itself; c. performance of municipal or public utility services, since no such services are provided along this roadway; d. delivery of freight by commercial carriers, as other routes provide better linkages to destinations of commercial freight carriers. BE IT FURTHER RESOLVED that pursuant to Vehicle Code §21101.4, the Council hereby determines that Empire Mine Road shall be temporarily closed for a period of 18 months. This temporary closure order may be extended for the periods, and by the procedures, specified in Vehicle Code §21101.4 or successor legislation. BE IT FURTHER RESOLVED that closure shall be physically accomplished by the erection of gates with access points for pedestrians and bicyclists on both ends of the roadway. Gates may be installed either by the adjacent property owners or by the City Engineer. If privately installed, the gates shall be of a type and specification approved by the City Engineer. The gates and gate locks shall be of a type approved by the Chief of Police, the Contra Costa County Sheriff's Department, and the Contra Costa County Fire District. . The gates shall have signs affixed indicating "Road Closed" or words to that effect as approved by the City Engineer. Pedestrians and bicyclists shall have the right to travel on the closed roadway and shall be required to use access points provided. .
