RECOMMENDED ACTION:
DETERMINE that the West Contra Costal Transportation Advisory Committee (WCCTAC) Sub-Regional
Transportation Mitigation Program (STMP) update activity is not subject to the California Environmental Quality
Act (CEQA); Pursuant to Article 5, Section 115061 (b)(3) of the CEQA Guidelines, and
DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk, and
I
AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to Community Development for
processing, and a $25 fee to the County Clerk for filing the Notice of Exemption

FISCAL IMPACT:
There is no impact to the County General Funld. The cost to administer the program will be funded by Developer
Funds.
REASONS FOR RECOMMENDATIONS iAND BACKGROUND:
The Sub-Regional Transportation Mitigation Program .(STMP) was adopted by the West Contra Costa
Transportation Advisory Committee(WCCTAC),the West Contra Costa County Cities,Contra'Costa County,and
the Contra Costa Transportation Authority(CCTA)in 1997. The existing developer fees that were agreed to in 1997
do not accommodate the impacts associated with new development. The previous fee amounts determined by the
WCCTAC have been collected and most of tile funds have been spent. Additional funds are necessary in support of
future regional transportation growth.
On December 6, 2005, the Board of Supervisors referred the draft update of the West Contra Costa County Sub-
Regional Transportation Mitigation Program(STMP)to the Transportation,Water,and Infrastructure Committee for
review and comment.

On January 10,2006,the Contra Costa County Board of Supervisors approved continents for the West Contra Costa
County Sub-Regional Transportation Mitigation Program (STMP), and authorized County staff to transmit'the
comments to the West Contra Costa Transportation Advisory Committee (WCCTAC) as recommended by the
Transportation, Water, and Infrastructure Committee.

The purpose of this board order is to determine that the action of updating the STMP fees is exempt from CEQA
Guidelines. Once WCCTAC approves the Master Cooperative Agreement for the STMP update, it will be
presented to the Board of Supervisors for approval. Subsequently,the Board of Supervisors will be presented with
urgency and regular ordinances to adopt the new STMP fee. Any future construction activities associated with the
STMP will require independent CEQA analysis.
It can be seen with certainty that there is no possibility that the activity may have a significant adverse effect on the
environment.

It can be seen with certainty that there is no possibility the activity may have a significant effect on
the environment.
DESCRIPTION OF THE ACTIVITY:
The Sub-Regional Transportation Mitigation Program (STMP) was adopted by the West Contra
Costa Transportation Advisory Committee(WCCTAC),the West Contra Costa County Cities,Contra
Costa County, and the Contra Cos ita Transportation Authority (CCTA) in 1997. The existing
developer fees that were agreed to in 1997 do not accommodate the impacts associated with new
development. The previous fee amounts determined by the WCCTAC have been collected and
most of the funds have been spent.1 Additional funds are necessary in support of future regional
transportation growth.
The purpose of this activity is to: 1) update existing STMP fees by increasing fees for new and
future development to mitigate the impacts of new trips generated by each development, 2) raise
funds in support of regional transportation projects in West County, and 3) adjust the traffic
mitigation fee program, as necessary.
The WCCTAC fee will be collected from new development within the fee area (Figure 1). All of the
roadways proposed for improvement under this program are contained in or in the process of being
incorporated into the circulation element of the County general plan and regional planning
documents for the fee area. Each project funded either wholly or in part by this fee will be analyzed
under a project-specific CEQA dociment.

LOCATION: The WCCTAC/STMP fee area includes the cities of EI Cerrito, Hercules, Pinole,
Richmond, San Pablo, and unincorporated Contra Costa County.
