RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director,or designee,to enter into negotiations with the three ranked responders, as specified, related to the development of approximately nine acres of County- owned land on the southwest side of the Buchanan Field Airport and south of the Airport Offices. II. FINANCIAL IMPACT: There is no negative impact on the General Fund. The Airport Enterprise Fund could realize lease and other revenues and the County General Fund could realize sales tax and other revenues if a lease is successfully negotiated. REASONS FOR RECOMMENDATION/BACKGROUND: The southwest development site is approximately 9 acres of land owned by the County and located south of the County Airport offices as shown on the attached parcel page. The parcel is proximate to the Buchanan Field runways and adjacent to other aviation uses. The parcel is designated for aviation use on the Buchanan Field Master Plan.The parcel is under the jurisdiction of the Buchanan Field Airport and entirely within the unincorporated County. On August 16, 2005, the Contra Costa County Public Works Department —Airports Division received a letter of interest from a private party to develop the approximate 9 acre project on the subject site. Per the Federal Aviation Administration's (FAA) Airports District Office (ADO) regarding development at Buchanan Field, the County notified existing commercial tenants at Buchanan Field and Byron Airport to solicit other competitive interest in the property. The County also published a solicitation advertisement in the Contra Costa Times September 16,2005,edition to broaden the solicitation of competitive interest.The development solicitation letter and publication process provided a response deadline of October 7,2005,for all competitive interests in the approximate 9 acre parcel to be submitted to the County Airport Office. The County received five (5) additional letters of interest in developing this property. On October 25, 2005, the Board of Supervisors authorized staff to convene a Selection Committee, consisting of County staff and representatives from the Airport businesses and surrounding neighborhood (members of the Aviation Advisory Committee), to assist Airport staff in the review, interview (if deemed necessary) and selection of the preferred Master Developer. Airport staff subsequently sent the six interested parties a request for further information that included a requirement for a $25,000 development deposit and a response deadline of December 23, 2005. The County received three information packets and development checks from Airport Partners, Silver Pacific Aviation and Aviation Development Group. A financial consultant was retained to also assist in the selection process. Airport staff and the Selection Committee reviewed the additional submittals, financial consultant's information and then interviewed all three proposal teams. All teams were excellent and worthy of consideration which made the ranking determination difficult for Selection Committee members. The proposal ranking outcome was determined by the following factors: • Project concept (rental versus condominium approach) • Project design and associated level of proposed investment • Schedule and timing for construction of improvements and infrastructure • Ability to address local pilot and adjacent community concerns Applying the above factors, the proposal submitted by Aviation Development Group (ADG) was top ranked by the Selection Committee. The concept of an aviation condominium approach is new to Contra Costa County but, upon further research, we have learned that this is highly valued approach and will provide financial and business advantages for the County. Airport Partners was ranked second and Silver Pacific Aviation was ranked third. SUBJECT: Approve Selection of Master Developer for a 9-Acre Parcel, Buchanan Field Airport DATE: March 7, 2006 PAGE: 3 Negotiation of lease terms would expand economic development activity at the Buchanan Field Airport, provide additional revenues to the Airport Enterprise Fund,and allow Contra Costa County expand aviation related business available at the airport.A business proposal must be consistent with the Airport Master PIan and General Plan for consideration. The proposed aviation development is consistent with the existing Buchanan Field Airport Master Plan. Additionally, the proposed development is also consistent with the analysis and needs assessment being performed for the updated Airport Master Plan. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of developing vacant land at Buchanan Field Airport and may negatively impact the Airport Enterprise Fund and County General Fund. ADDENDUM TO ITEM C.8 March 7, 2006 On this day, the Board of Supervisors considered approving and authorizing the Public Works Director, or designee,to enter into negotiations with the three ranked responders, as specified, related to the development of approximately nine acres of County-owned land at the Buchanan Field Airport, Pacheco area, and return to the Board with final recommendations. (District IV) This item, Consent Calendar item C.8, was removed from the Consent Calendar for discussion under agenda item SD.1. Supervisor DeSaulnier opened the discussion suggesting that his inclination is to form an Airport Subcommittee and refer this matter to that subcommittee in a manner that could allow for public input while not slowing down the process. He proposed the matter be returned to the Board in 30 to 60 days. Chair Gioia established that the subcommittee would be comprised of Supervisors DeSaulnier and Picpho. Supervisor Piepho asked if the recommendation in the Board Order is to negotiate with one responder or with all three. Keith Freitas, Public Works Department, responded that staff proposes to negotiate with the top- ranked firm, and that if terms cannot be met, negotiations would then begin with the nest ranked fi rm. The Chair called for public comment. The following people spoke: ■ John Stucke, Pacheco resident, said the structure proposed by the finalist would be an asset to the community; ■ Craig Anderson, representing Airport Partners, concurred with Supervisor DeSaulnier's recommendations, saying he would like the opportunity to respond to any issues that may have been raised; ■ Russell Roe, Martinez resident, suggested the Board consider going forward with a local company, and further suggested that the process ensure that airport clubhouse tenants are not disturbed until the last possible time; ■ David Evans, speaking for the Mount Diablo Pilots Association, said lie sees development of these nine acres as a positive step for the airport but has concerns about the displacement of current tenants. He suggested the subcommittee address the issue to make sure the current tenants are given the optimum possible arrangements; ■ Vincent Siebern, representing the Mount Diablo Pilots Association, suggested preference be given to a local developer; ■ Richard Roberts, speaking for the Airport Partners, thanked the Board for making sure this will proceed in an orderly fashion,and said lie would reserve his comments for the subcommittee meetings; March 7, 2006 C.8 Page 2 of 2 ■ Michael Dunn, representing the Aviation Development Group, said he welcomes and looks forward to being part of the process. Supervisor DeSaulnier said that while he has the utmost respect for the work done by Keith Freitas, obviously there is an interest in more discussion and a report back on this subject. By a unanimous vote with Supervisor Clover absent, the Board of Supervisors took the ,following action: ESTABLISHED an Airport.Subcommittee consisting of Supervisors DeSaulnier and Piepho, and DIRECTED that the Airport Subcommittee meet with stakeholders and return to the Board with a report on this matter within 60 days. As a general aviation pilot who fly out of Concord I believe a pending decision about developing the airport should not be left up to developers from outside our area of influence. Outside developers have no concern about MDPA, EAA&Civil Air Patrol and the need for an affordable hangar or building to hold our meetings. I know that MDPA does not have enough money to rent a hangar let alone buy a high priced hanger. Therefore these pilot groups would loose their current clubhouse! meeting place if an outside developer is allowed to move in and dominate the airport development process! I believe only a local developer would provide the klnd support and concern for our longstanding service in general aviation at Buchanan Field. I am concerned that outside developers will pressure county airport management into trying to displace these three groups of pilots from their facilities and then not any equal and affordable place for the clubs to meet. I am the president of the Mount Diablo Pilot9 Association (MDPA) and am writing to ask you to direct the airport manager to negotiate with the local developer, Airport Properties (AP)first, then with the Colorado developer, ADG. I do this for the following reasons: Keep local tax dollars in the local community AP, the local developer, has a long history at the airport. He has built hangars on the field years ago. We know what kind of job he will do, we don't know what ADG will do. When the project is done the local developer, AP, will still be here to fix things. No matter who is selected we request the following items be part of the negotiations. MDPA should be part of the committee to establish what the community building will be. Currently MDPA is the only group on the airport to rent a building similar to the proposed community building. We have rented the MDPA clubhouse from the airport for about fifteen years. We ask that MDPA and other airport groups (EAA, 99s, CAP, and the Concord flying club) be granted a long term use agreement of the new community building that we can afford. We currently pay 51,000.00 per month for the clubhouse. " We ask that we be allowed to stay in our building until construction begins. We don't want to be forced out while environmental studies are conducted and then have no place to meet. ` Lastly, we ask that the airport management help find us a place to meet while construction is taking place. We currently meet twice a month, once for dinner and once for breakfast. Thank you for your consideration.
