HomeMy WebLinkAboutMINUTES - 03072006 - C.49 ,,E•.sE--L ° Contra TO: BOARD OF SUPERVISORS FROM: John Cullen, County Administrator - e i :.;y1„=ry="`'`; Costa DATE: March 7, 2006 `° co "�� County SUBJECT: CONTRACT AMENDMENT WITH CONTRA COSTA COUNTY BAR ASSOCIATION FOR LEGAL REPRESENTATION SERVICES SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract amendment with the Contra Costa County Bar Association, effective March 1, 2006, to increase the payment limit by $100,000 to a new payment limit of$4,100,000 with no change in the two-year term of July 1, 2005 through June 30, 2006, for additional court- ordered legal representation in probate guardianship and conservatorship proceedings. FISCAL IMPACT The $25,000 increase in appropriations for FY 2005/06 is being transferred from the Trial Court Programs appropriation for Court Appointed Counsel. Appropriations for FY 2006/07 will be submitted for approval in the Recommended Budget for FY 2006/07, and subject to cancellation if funding is not approved. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): Since 1983, the County has contracted with the Contra Costa County Bar Association for the provision of conflict defense services. The original contract was in response to the escalating cost of conflict defense services under the old system of court-appointed counsel. Subsequently, in FY 1991/92, the Public Defender created an Alternate Defender's Office to handle conflict cases. The cases referred to the Bar Association generally represent multiple co-defendant cases in which the Alternate Defender's Office can only handle all co-defendants. The current contract includes the costs associated with conflict defense services for representing criminal and delinquency cases referred to the Bar Association through a written affidavit of conflict by the Public Defender and the Alternate Defender. In 2005, the contract added provisions for the County's obligation to pay for legal services in Juvenile Immigration and Guardian Ad Litem cases. The proposed amendment will add provision for the County's obligation for legal representation of minors in probate guardianship proceedings and representation of conservatees in conservatorship proceedings. These services were previously provided by counsel appointed by the Courts and paid for by the County.
