SUBJECT: AUTHORIZE EXECUTION OF A FUNDING AGREEMENT WITH
THE TRANSPORTATION FUND FOR CLEAN AIR (TEFCA) TO
RETROFIT EXISTING HEAVY-DUTY DIESEL VEHICLES

RECOMMENDATION
APPROVE and AUTHORIZE the General Services Director, or designee, to EXECUTE a funding
agreement with the Transportation Fund for Clean Air (TFCA) in which the County indemnifies TFCA.
FINANCIAL IMPACT
The TFCA grant application is for $262,500. The grant has been approved and it will be used to
retrofit existing County heavy-duty diesel vehicles to comply with California Air Resources Board
regulations.
BACKGROUND
The Bay Area Air Quality Management District (BAAQMD), in conjunction with the Department of
Motor Vehicles, collects a $4.00 surcharge on motor vehicle registrations paid within the Air District's
jurisdiction. The surcharge provides funding for the BAAQMD's Transportation Fund for Clean Air.
TFCA funds are distributed to public agencies to implement projects to reduce air pollution from
motor vehicles in accordance with the requirements of State law and the BAAQMD's Bay Area 200
Clean Air Plan and the 2001 Ozone Attainment Plan.
The California Air Resources Board adopted a new regulation that applies to public agency vehicles,
which requires public agency fleets to employ Best Available Control Technology (BACT) to reduce
emissions of diesel particulate matter. The BAAQMD has expressed their willingness to fund diesel
emission reduction strategies on public agency vehicles. The County applied for $262,500 in TFCA
funds to retrofit existing County heavy-duty diesel vehicles to comply with California Air Resources
Board Regulations.

(TEFCA) TO RETROFIT EXISTING HEAVY DUTY-DIESEL
On August 16, 2005, the Board approved and authorized the General Services Director, or designee,
to submit an application for grant monies available through the TFCA and to execute a funding
agreement with the TFCA. The TFCA approved the $262,500 grant application on November 2,
2005. On February 1, 2006, County Counsel approved the funding agreement as to form and
recommended that General Services seek additional authority from the Board to execute the funding
agreement with the TFCA in which the County indemnifies the TFCA.
