SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACK-ROUND AND JUSTIFICATION RECOMMENDED ACTION: CONSIDER the report filed with the Boprd of Supervisors by the Public Works Director specifying that sidewalk repairs fronting multiple parcels of real property have been made costing a total of$40,000 and proposing that the Board of Supervisors APPROVE an assessment be levied against each parcel of real property for the cost of the sidewalk repairs made fronting each parcel of real property listed in the report (including property tax roll collection fee), that the lien be turned over to the Assessor and Tax Collector so that the assessment can be added to the next regular bill for taxes levied against said properties, and indicating that timely notice of a hearing on this date before the Board of Supervisor was provided to the real property owners listed in the report in the manner required by law. DATE: March 21, 2006 PAGE: 2 of 2 At the time fixed for the hearing on this date, the Board of Supervisors heard the report of the Public Works Director and any objections or protests by the involved property owners and other interested persons and closed the hearing. The Board of Supervisors hereby, finds, determines, confirms and orders that: 1. It has considered and passed upon the Public Works Director's report and.any objections or protests made. 2. The said report is confirmed and that cost of the sidewalk repair fronting each parcel of real property listed in the report be assessed and levied against each of those parcels of real property. 3. If the above specified assessed sum is not paid within five (5) days of this date to the Public Works Department, it shall constitute a special assessment against said parcel(s) of real property, and shall be a lien thereon (together with administrative fees, interest, and penalties due) until it is paid, or until it is discharged of record. 4. The Public Works Director shall cause a notice of lien for the above specified and unpaid assessment lien to be prepared and completed pursuant the California Streets and Highways Code, Chapter 22, Section 5626 and; a. Delivered to and filed for recordation in the County Recorder's office a completed and executed original copy of said notice of lien, and b. Turn over completed copies of the said notice of lien to the County Assessor, Auditor and Tax Collector for tax roll collection pursuant to the California Streets and Highways Code, Chapter 22, Sections 5628 and 5629. 5. Upon completed payment of the assessment(including any administrative fees, penalties and interest due thereon), the Public Works Director is authorized on behalf of the County to execute any necessary and appropriate release or satisfaction of lien proposed by the involved property owners. FISCAL IMPACT: None REASONS FOR RECOMMENDATIONS AND BACKGROUND: To recuperate funds spent by the Public Works Department to repair damaged sidewalk that should have been repaired by the fronting property owner at the fronting property owner's cost. CONSEQUENCES OF NEGATIVE ACTION: Public Works Department funds spent to repair damaged sidewalk will not be recuperated. i ADDENDUM TO ITEM SD.2 March 21, 2006 i On this day, the Board of Supervisors considered conducting a Hearing to consider accepting the Sidewalk Hazard Abatement Program Report on the sidewalk repair costs of 30 specified properties throughout the County and approving a parcel assessment to recover the costs. Henry Finch of the Public Works Department requests the Board conduct the public hearing to approve levying an assessment against each parcel of real property(as listed in the report that accompanied this item) for the cost of said sidewalk repairs made fronting each parcel (including property tax roll collection fee), that the lien be turned over to the Assessor and Tax Collector so that the assessment can be added to the next regular bill for taxes levied against said properties, and indicating that timely notice of a hearing on this date before the Board of Supervisors was provided to the real property owners listed in the report in the manner required by law. Supervisor Gioia asked about the approach used when informing residents of needed sidewalk repairs; in the past he was aware the approach may have been aggressive, and he asked Mr. Finch if a softer touch could be used when enforcing this program. Supervisor Gioia also asked for a copy of the most recent standard letter sent to residents to inform them of needed repairs. Supervisor Gioia asked Mr. Finch if there are other properties in addition to the 1500 addressed thus far. Mr. Finch said it is an ongoing process. Supervisor Uilkema asked if these assessments are added to a person's regular taxes, and if it would be possible to defer these costs until the time of sale or possible refinancing. Silvano Marchesi, County Counsel, confirmed this is exactly the structure of a lien. He said the lien will stay on the property until the owner wants to sell or refinance, and then the debt can be paid from that transaction. Supervisor Uilkema commented that people on fixed incomes, such as the elderly, may not be able to afford these repairs. She suggested examining the program to make sure it is compatible with people's ability to maintain independent living. The Chair opened the public hearing and called for comment. The following person provided testimony: Michael Berger, Clyde homeowner, stated that he did not get a notice,just an invoice. Chair Gioia asked staff about the notification process. Mr. Finch responded that two notifications are sent to the property owners via certified mail. He said that in the case of Mr. Berger,both notices came back unclaimed. Staff then posted a notice i March 21, 2006 SD.2 Page 2 of 2 i at Mr. Finch's rental property and told the tenant that the owner needed to be informed of the notice. Since then, staff had discovered an alternate address for Mr. Berger at which they were able to contact him. Chair Gioia asked if the Board could approve parcel assessments for the list of specified properties without approving item number two (Mr. Berger's property), which, if there is a need, could be returned to the Board for action at a future meeting. Supervisor Glover suggested the right course of action might be for Mr. Berger to have this conversation with the Public Works staff. Mr. Berger could then get resolutions to some of the questions he brought forth today, such as whether or not root barriers were installed when the County did the repair. Mr. Finch noted that six property owners have already paid and should also be excluded from the Board's action: Number 3 on staff's list, 600 Alhambra Number 4, 1445 Havel Number 20, 400 Yale Number 18, 6356 Kensignton Number 21, 6266 Highland Number 24, 312 Rodeo Number 27, 3011 Ferndale By a unanimous vote with Supervisor Piepho absent, the Board of Supervisors took the following action: i CLOSED the Public Hearing; ACCEPTED the Sidewalk Hazard Abatement Program Report on the sidewalk repair costs of 30 specified properties throughout the County; and APPROVED a parcel assessment to recover the costs, excepting number 2 on the staff report(the property owned by Michael Berger)to allow time for the property owner and Public Works to have a conversation to address concerns raised this day. i PUBLIC WORKS DEPARTMENT Contra Costa County 255 Glacier Drive Martinez, CA 94553 (925) 313-2000 (925) 313-2333 fax DATE: March 7, 2006 TO: Members of the Board of Supervisors FROM: Maurice M. Shiu, Public Works Director X4 SUBJECT: Report on Sidewalk Hazard Abatement Countywide This report is in reference to the March 2 I, 2006, hearing on the confirmation of the sidewalk repair costs for the hazard abatement at 30 properties County wide. In accordance with Public Works Department's .lune 30, 2004 "Maintenance of Sidewalks, Curbs and Gutter" policy,the Department's Maintenance Division has performed a sidewalk survey throughout unincorporated Contra Costa County identifying damaged sidewalk that presents a potential hazard to the public. I Those property owners who had sidewalk damage fronting their property were notified by the Department as outlined in Chapter 22, "Maintenance of Sidewalks," Sections 5611 through 5614 of the California Streets and Highways Code (S&H Code) of the need for tic property owner to repair the sidewalk fronting their property. Ol'approximately 1,500 property owners inotified by the Department to make the sidewalk repair fronting their property, 160 property owners did not perform the repairs as requested. The Department performed the repairs pursuant to Section 5615 of the S&H Code after additional notification to the property owners requesting them to make the sidewalk repairs went unheeded! In October 2005 and January 2006, the Department mailed invoices requesting payment within 30-days for the sidewalk repairs made lronting the 160 properties.To date 30 property owners have not paid the invoice sent them. Please refer to the enclosed property listing for a breakdown of the sidewalk repair costs at each property. I Pursuant to the S&H Code, Sections 5625 through 5629 the Department is recommending that the cost of the sidewalk repair together with a property tax roll collection fee of$250.76 be assessed against each of the properties included in this report as a lien on said properties,and that the lien be turned over to the Assessor and Tax Collector so that the assessment can be added to thei next regular bill for taxes levied against said properties.
