Pursuant to Public Contract Code Sections 22035 and 22050, FIND t at an emergency exists due to recent storm damage caused to roads and channels,that the emergency will not permit a delay resulting from a competitive solicitation for bids, and that prompt action is necessary to respond to the emergency. B. To the extent that a repair project involves the Flood Control District, FIND that the repair work constitutes channel protection, maintenance work, and emergency work, which is exempt from public bidding under Public Contract Code Section 21191. C. AUTHORIZE the Public Works Director/Chief Engineer,or designee,to enter into contracts and take other appropriate actions to repair the storm damage. D. DI RECT the Public Works Director/Chief Engineer,or designee,to submit periodic reports to the Board to enable the Board to review the emergency action, as required by Public Contract Code Sections 22035 and 22050. FINANCIAL IMPACT No impact on the General Fund. The repair projects will be covered by County road funds and Federal Highway Administration funding. BACKGROUND/REASONS FOR RECOMMENDATION(S) Beginning with a severe storm on December 31, 2005 and continuing up to the present, Contra Costa County has been hit by a series of strong winter storms. As a result of the storms and heavy storm runoff, severe erosion has occurred in channels and banks, in some cases undermining adjacent County roadways. The damage has become especially severe within the past few weeks, as continued rainfall and storm runoff have further eroded and undercut banks and roadways that already were damaged in previous storms. To protect public safety at both locations,the Public Works Department found it necessary, as a temporary measure, to close the road down to one travel lane and to install concrete barriers. If expeditious repairs are not made at these two locations,the undermining will likely continue and could result in a complete closure of Alhambra Valley Road. The above-described repairs require substantial work. Atone location,itwill be necessaryto place large rock to fortify the adjacent bank. At the other location,the bank is so steep that it will not be possible to stack rock vertically,and a retaining wall likely will be required. If these repair projects are handled through the design and bidding processes normally used for County or Flood Control District construction projects, the resulting delays potentially would compromise public safety and would result in more extensive damage and increased repair costs. To address the above situation, Public Works staff recommends that the Board declare an emergency pursuant to Public Contract Code Sections 22035 and 22050, making the necessary findings set forth above. The emergency declaration would apply to the channel, bank,and road repairs at the above two locations on Alhambra Valley Road as well as to any additional locations that are severely damaged by the ongoing storms and erosion. To the extent that a repair project involves the Flood Control District,staff recommends that the Board find that the repair work constitutes channel protection, maintenance work, and emergency work, which are exempt from public bidding under Public Contract Code Section 21191(b). CONSEQUENCES OF NEGATIVE ACTION If the request is not approved,the necessary repairs would likely be delayed, potentially compromising public safety, interfering with publictraffic,and resulting in more extensive damage and increased repair costs.
