EASEMENT ON THE NORTH GATE ROAD PROPERTY (DISTRICT III)

1. Recommended Action:
APPROVE a three-month extension of time to the East Bay Regional Park District to June 21, 2006 to
complete the conservation easement document and funding on the 36-acre parcel owned by the Flood
Control District adjacent to the Milton F.Kubicek(Pine Creek)Detention Basin located on North Gate Road
in the Walnut Creek area. (District III)

H. Fiscal Impact:
The Flood Control &Water Conservation District(District)will receive$1.559 million for a conservation
easement on a parcel the District owns on North Gate Road. Pursuant to an agreement with the State
Department of Water Resources, all revenue generated from the conservation easement must go towards
Flood Control infrastructure improvements in the Walnut Creek watershed. IThere is no interest provision
for delays in securing the funding.
III. Reasons for Recommendations and Background:
The Board has considered several extensions of time for the execution of the conservation easement,and due to
the importance of this project has approved them all.
The conservation easement document has been finalized between the Costal Conservancy,the Park District and
the Flood Control District. The document is currently under review by the State iDepartment of Conservation in
relation to an agricultural contract cancellation on the Humphrey's property.
A large part of the funding package for the conservation easement is from an agricultural contract termination
exchange on the Humphrey's property in the Alamo area. The Board of Supervisors has approved the proposed
project on the Humphrey's property and the cancellation of the agricultural contract. The cancellation of the
agricultural contract process is nearing completion. Other funding for the easement is from the Park District and
the City of Walnut Creek. Funding from the Park District was approved by their Board on The
City of Walnut Creek is ready to approve their portion of the funding once the Department of Conservation signs
off that the easement satisfies their agricultural contract termination requirements.
On December 20,2005,the Board approved the fourth extension of time to complete the conservation easement
until March 21, 2006. It appears that the Department of Conservation will not complete their review before
March 21, 2006 and an extension for three months to June 21, 2006 is needed to allow the Department of
Conservation to complete their review.
IV. Consequences of Negative Action:
The conservation easement deadline would not be extended.
