SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JLJSTIFICA"PION
RECOMMENDED ACTION:
A. DETERMINE that the activity is exempt from the requirements of the California Environmental Quality Act
(CEQA)pursuant to Article 5,Section 15061(b)(3)of the CEQA Guidelines and FIND that the project will not
have a significant effect on the environment.
B. ADOPT Resolution approving the vacation of a Grant Deed of Development Rights for Lot 3, Subdivision
7641.
C. DIRECT the Community Development Director to file a Notice of Exemption with the County Clerk, and
D. DIRECT the Public Works Director to arrange for payment of the$25.00 handling fee to the County Clerk.for
filing and a$25.00 fee to Community Development for processing of the Notice of Exemption/Determination.
E. ORDER the Real Property Division to record a certified copy o the Resol(tion in the office of the County
Recorder.

REASONS FOR RECOMMENDATION/BACKGROUND:
The County obtained a grant deed of development rights for a 60 foot roadway curve within lot 3 in Subdivision 7641
which is no longer needed. The property owner requested that the encumbrance be removed.
CONSEQUENCES OF NEGATIVE ACTION:
The County would prevent future development in the area of the 60 foot curve which is no longer necessary right of
way.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
The Board hereby DETERMINESthatthe activity isexemptfromthe requirements of
the California Environmental Quality Act(CEQA)pursuant to article 5, Section 15061(b)(3)
of the CEQA Guidelines.
The Board DIRECTS the Community Development Director to file a Notice of
Exemption with the County Clerk, and DIRECTS the Public Works Director to arrange for
payment of the $25.00 handling .fee to the County Clerk for filing and a $25.00 fee to
Community Development for processing of the Notice of Exemption
/Determination.
This vacation request is for a grant deed of development rights no longer required
for public use (Government Code Section 25367). A description of the area to be vacated

HEREBY ORDERED VACATED subject to any reservation and exception described in
attached Exhibit "A". From and after the date this Resolution is recorded, the portion
vacated no longer is subject to the grant deed of development rights recorded in the office
of this County's Recorder on December 4, 2000 as instrument No: 2000-0270385-00.
The Real Property Division is ORDERED to record a certified copy of this Resolution
