RECOMMENDED ACTION: APPROVE revisions to the Section 8 Administrative Plan,Chapter 5, Subsidy Standards,for the Housing Authority of the County of Contra Costa,as required by the U.S. Department of Housing and Urban Development(HUD). This action replaces the current Chapter 5 dated"4/2004" with the new Chapter 5 dated"Rev.2/2005"attached hereto and marked"Proposed." II. FINANCIAL IMPACT: The fiscal impact of this action would significantly reduce the amount of Housing Assistance Payments(HAP)made by the Housing Authority and reduce and possibly alleviate the current funding gap for these payments. III. REASONS FOR RECOMMENDATION/BACKGROUND I Due to recent HUD funding changes, Section 8 Voucher HAP are now funded at a fixed dollar level rather than a formula based on the number,family size, and income of number of families assisted. HAP is the amount provided by HUD to the Housing Authority to pay to landlords on behalf of low-income families. At the current level of funding,the Housing Authority cannot continue to support all families now under the program without running a deficit. When these changes were initiated by HUD in April 2004, 1 reported to this Board that the Housing Authority had taken administrative steps to mitigate the projected deficit. These steps included reductions in the payment standards to the lowest allowable level, portability limitations, and limitations on subsidy size increases. Further,appeals were successfully made to HUD to provide additional funding. Unfortunately,these actions were not significant enough to cover the deficit which,to date,has been funded out of i'reserves. The current average HAP for a family under the program is$989. The Housing Authority's reimbursement rate from HUD is$956. The monthly deficit generated by this gap is approximately $225,000($33 per family X 6781 families receiving assistance)and cannot be sustained by the Housing Authority. It has been the goal of the Housing Authority to continue to serve the maximum number of families and not terminate families from the program. Should the savings not be sufficient to eliminate the deficit,other steps should be considered including reducing the number of families served. Chapter 5,Subsidy Standards of the Housing Authority's Section 8 Administrative Plan specifies the maximum number of bedrooms provided by the voucher a family receiving assistance under the program is eligible for. The proposed change replaces Chapter 5 in its entirety(new version attached). Its effect will be that family voucher size will be determined in the following manner: One bedroom will be allocated to the Head of Household. One bedroom each will be allocated for every two remaining family members regardless of age, sex or relationship of these other family members. In some cases,this change reduces the type of voucher a family would receive. For example,a single parent with two children would receive a"two-bedroom"voucher under the proposed plan whereas they would receive a"three-bedroom"voucher under the existing plan. For those effected who are currently under the program,this would result in one,or a combination of both of the following options: 1. The family could choose to remain in occupancy. This would result in either the family paying a larger amount of the rent or the landlord charging a lesser rent;or 2. The family could relocate to a new unit of smaller size and less rent. Upon approval by the Board of Commissioners,existing effected families will be written notice of the change in the voucher and subsidy as quickly as possible indicating that the change will be effective April 1,2005. The proposed changes to the subsidy standards are consistent with HUD regulations governing the Section 8 Program. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect not to approve this revision,the Housing Authority would be unable to implement the proposed changes to the Section 8 Program. s8admin Chapter 5 SUBSIDY STANDARDS [24 CFR 982.54(d)(9)] INTRODUCTION HUD guidelines require that HA's establish subsidy standards for the determination of family unit size, and that such standards provide for a minimum commitment of subsidy while avoiding overcrowding. The standards used for the unit size selected by the family must be within the minimum unit size requirements of HUD's Housing Quality Standards. This Chapter explains the subsidy standards which will be sed to determine the voucher size (family unit size) for various sized fa.r�iil esowhen they are selected from the waiting list, continued eligibility` beterm,ination performed annually, or at any time changes to the subsid>V stand'ards occur in compliance with the administrative plan and�,RIUD regulations. A. DETERMINING FAMILY UNIT 1/OUCHER) SIZE [24 CFR 982.402] The HA does not determine Who shares a bedroom/sleeping room, but there must be at least one personp bedroom on the Voucher. The HA's subsidy standards for determinii u c -er size shall be applied in a manner consistent with Fair Hous .g guidelines. For subsidy standards an adult is a person 18 years or older. All standards in this section relate to the number of bedrooms on the Voucher, not the family's actual living arrangements. The Authority's subsidy (bedroom size) standards are used to determine the maximum rent subsidy that a family assisted under the voucher program will receive. The Authority's subsidy standards have been established in accordance with HUD regulations to provide Section 8 housing assistance to the greatest number of families possible. The Authority's subsidy standards will be applied consistently for all families of like size and composition. A family's voucher size will be determined in the following manner: - Housing Authority of the County of Contra Costa Rev. 2/2005 Admin Plan 5-1 v ➢ One bedroom will be allocated to the Head of Household (and his/her spouse/significant other). ➢ One bedroom each will be allocated for every two remaining family members regardless of the age, sex or relationship of these other family members. A family member who is temporarily away from the home to attend school is considered a member of the family in determining the family unit size. Children who are being adopted, or whose custody is bung obtained, may be considered in assigning subsidy size. Howevethe must be a reasonable assurance that the child or children will join the farnil within 6-months and the family must provide proof that the child�o eh'ildoen joined the family. In cases where a family was given a larger subs'd�size, but the child or children do not join the family, then, the 1ml y's subsidy size will be reduced with a 30-day notice from the Authority. Foster children will be included in deierrn' ing unit size. B. EXCEPTIONS T, SUB�SI'DY STANDARDS [24 CFR 982.407 a) &(b)] The subsidy standards rn,ay .e;Waived for families in need of: A. Live-in attendants will generally be provided a separate bedroom. This will be approvedbased on funding availability. No additional bedrooms are provided for the attendant's family A live-in aide for a family member B. Medical equipment which requires a separate room because of size or function; or C. A documented medical need that necessitates a separate room for a family member. Q4 Housing Authority of the County of Contra Costa Rev. 2/2005 Admin Plan 5-3 i Request for Waiver to Subsidy Standards Families seeking an exception or waiver to the subsidy standards will be required to submit a request for such an exception. The request must meet the Authority's guidelines. In order to obtain a waiver, the family must provide justification for their request and supportive documentation. The Authority may request third party verification to verify the need for a waiver. Waivers are subject to funding availability. If a waiver is granted, the Authority will increase the subsidy / bedroom size appropriately. These are the only three cases in which a waiver may be granted. All other families will. be assigned a bedroom size based on the subsidy standards above. Under the Voucher Program, no unit shall be disapproved on the sole ground that it is too large for the family. Housing Quality Standards: The standards allb.: o persons per living/sleeping room and permit max imun occupar cy levels (assuming a living room is used as a living/sleeping are4)4sshown in the table below. The levels may be exceeded if a roomri addition to bedrooms and living room is used for sleeping. The family may rent a smaller bedroom sl-a unit, provided that the unit meets Housing Quality Standards S) guidelines. UNIT SIZE SELECTED [24 CFR 982.402(c)] The family may select a different size dwelling unit than that listed on the Voucher. There are three criteria to consider: Subsidy Limitation: The family,unit size as determined for a family under the HA subsidy standard for a family assisted in the voucher program is based on the HA's adopted payment standards. The payment standard for a family shall be the lower of: • The payment standard amount for the family unit size; or • The payment standard amount for the unit size rented by the family. Utility Allowance: The utility allowance used to calculate the gross rent is based on the actual size of the unit the family selects, egardless of the size authorized on the family's Voucher. Changes for Participants The members of the family residing in the unit must be approved by the HA. The family must obtain approval of any additional family member before the new member occupies the unit except for additions by birth, adoption, or court-awarded custody, in which case the family must inform the HA within 10 days. The above referenced guidelines will apply. RECOMMENDED ACTION: AWARD contract to Home Depot Supply in the amount of$120,000,for the term commencing January 1, 2006 and ending December 31,2006,with two,one year optional renewals,first renewal period,January 1,2007 and ends December 31,2007,second renewal period,January 1, 2008 and ends December 31,2008, at$120,000 each,for the procurement of Maintenance, Repair, and Operating supplies(MRO)for the maintenance department;and AUTHORIZE the Acting Executive Director to execute said contract. ll. FINANCIAL IMPACT: Funds for this contract are from the U.S.Department of Housing and Urban Development(HUD) for the Housing Authority's Low Income Public Housing program. No County General Funds are required. III. REASONS FOR RECOMMENDATION/BACKGROUND The Housing Authority operates facilities and apartment complexes throughout the entire County. Home Depot Supply is the only County wide supplier of Maintenance, Repair and Operating (MRO) supplies, therefore, the Housing Authority did not go out to bid for this contract. This is a sole source contract that affords the Housing Authority a 16%discount on MRO supplies. The 16%discount applies to the initial term of the contract,as well as the two one year optional renewals. The annual savings to the Housing Authority with the Home Depot Supply discount is estimated at$19,000. Based upon the foregoing, the Housing Authority recommends that Home Depot Supply be awarded this contract. Shop Program: HDS sales representatives in the various markets will be available to cross- reference the Authority properties' products to HDS products. HDS will provide bin labels and an initial supply of bin boxes free of charge,to increase the efficiency of Authority maintenance staff. HDS will also provide our "Rapid Order Fax' form for each property's most frequently purchased items to reduce ordering time. Personalized Service: HDS will provide a team of managers to assist in the service areas of delivery, inventory management, credit and accounting. Should Authority properties need to contact HDS for any of the above issues,they will have direct contact with the HDS Team that will service the Authority. Additionally, HDS will be available for Regional Maintenance Meetings to field any service issues that may arise, as well as to reinforce all services available to Authority properties. Home Depot Partnership: HDS will also work with your management and properties to communicate the benefits offered by HDS and the HDS partnership with the Authority. This discount will be automatically reflected on each invoice for items purchased at HDS's lowest published national catalog price. The discount is not retroactive to previous purchases. The invoice discount only applies to products purchased at HDS's lowest published national catalog price, which excludes special orders, promotional items,contract priced items and other discounted items. This proposal is made based on expected annual purchases of$120,000. If annualized purchase trends indicate that this level will not be achieved, HDS will review the partnership incentive program, and may adjust it based on actual purchases. This proposal is also based on the Authority maintaining a portfolio of approximately 1,500 units. If the Authority's portfolio size changes significantly, HDS will review the partnership incentive program, and adjust as necessary. Property List: The Authority will provide HDS with a complete list of properties to be covered by this agreement within 14 days of signing this agreement. The Authority will provide property changes within 30 days of the change, so HDS is able to maintain an accurate property list. The property information will include property name, address, phone number,fax number, contact name and units. The property list should be provided in an electronic format,whenever possible. Payment Terms: Invoices are mailed daily and payments are due, in full, 30 days from the invoice date. If a property becomes delinquent, HDS will work with the Authority and it's Accounts Payable department to determine a satisfactory payment arrangement. If a property becomes delinquent and no remedy is developed to resolve the situation, HDS will place the property on credit hold until a remedy is developed. A minimum charge of$2.00, or 1.5% per 28 day cycle, 18%per year, is charged on past due invoices. Term: This agreement will be effective until December 31, 2006, with two, one year optional renewals ending December 31, 2007 and December 31, 2008. Either party may terminate this agreement with 30 days written notice to the other party. This agreement is confidential. The signature of a duly authorized representative indicates the acceptance of the terms and conditions of this agreement. 7. Authority's Obligations: The Authority will be responsible for completing the proposal certifications. 8. Compliance with Law: HDS shall be subject to and comply with all Federal, State and local laws and regulations applicable with respect to its performance under this Contract, including but not limited to, licensing, employment, and purchasing practices; and wages, hours and conditions of employment, including nondiscrimination. 9. Nondiscriminatory Services: HDS agrees that all goods and services under this Contract shall be available to all qualified persons regardless of age, sex, race, religion, color, national origin, or ethnic background, or handicap, and that none shall be used, in whole or in part, for religious worship or instruction. 10. Independent HDS Status: This Contract is by and between two independent HDSs, and is not intended to and shall not be construed to create the relationship between the parties of agent, servant, employee, partnership,joint venture,or association. Disputes: Disagreements between the Authority and HDS concerning the meaning, requirements, or performance of this Contract shall be subject to final determination in writing by the Executive Director of the Authority, or his designee, or in accordance with the applicable procedures (if any)required by the State or Federal Government. 12.Access to Books and Records of HDS,SubHDS: Pursuant to Section 1861(v)(1) of the Social Security Act, and any regulations promulgated thereunder, HDS, shall, upon written request and until the expiration of four years after the furnishing of service pursuant to this Contract, make available to the Secretary of Health and Human Services, the Comptroller General, the Authority, or any of their duly authorized representatives,this Contract and books, documents, and records of HDS that are necessary to certify the nature and extent of all costs and charges hereunder. Further, if HDS carries out any of the duties of this Contract through a subcontract, with a value or cost of$10,000 or more over a twelve-month period, such subcontract shall contain a clause to the effect that upon written request and until the expiration of four years after the furnishing of services pursuant to such subcontract,the SubHDS shall make available, to the Secretary, the Comptroller General, the Authority, or any of their duly authorized representatives, the subcontract and books, documents, and records of the SubHDS that are necessary to verify the nature and extent of all costs and charges hereunder. This special condition is in addition to any and all other terms regarding the maintenance or retention of records under this Contract and is binding on the heirs,successors, assigns and representatives of HDS. 13. Reporting Requirements: Pursuant to Government Code Section 7550, HDS shall include in all documents or written reports completed and submitted to Authority in accordance with this Contract, a separate section listing the numbers and dollar amounts of all contracts and subcontracts relating to the preparation of each such document or written report. This section shall apply only if the payment limit under this contract exceeds$5,000.00. 14. Indemnification: The HDS shall defend, indemnify, save, and hold harmless the Authority and its officers and employees from any and all claims, costs and liability for any damages, sickness, death, or injury to persons(s) or property, including without limitation all consequential damages, from any cause whatsoever arising directly or indirectly from or connected with the operations or services of the HDS or its agents, servants, employees or SubHDSs hereunder, save and except claims or litigation arising through the sole negligence or sole willful misconduct of the Authority or its officers or employees. HDS will reimburse the Authority for any expenditures, including reasonable attorney's fees, the Authority may make by reason of the matters that are the subject of this indemnification, and if requested by the Authority will defend any claims or litigation to which this indemnification provision applies at the sole cost and expense of the HDS.
