Weir, County Clerk-Recorder Costa, - .- z � - = DATE: January 4, 2006 °STq �eox��' County SUBJECT: APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a contract to apply for and accept Federal Help America Vote Act (HAVA) grant funding, authorized by the Secretary of State, in an amount not to exceed $7.1 million for equipment, software and related costs necessary to meet State and Federal voting requirements SPECIFIC REQUEST(S) OR RECOMMENDATION(S)AND BACKGROUND AND JUSTIFICATION Recommended Action: APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a contract to apply for and accept Federal Help America Vote Act (NAVA) grant funding, authorized by the Secretary of State, in an amount not to exceed $7.1 million for equipment, software and related costs necessary to meet State and Federal voting requirements. Financial Impact: There is no County match requirement for this grant. Reasons for Recommendation/Background: The October 2002 Help America Vote Act (NAVA) requires that the County must have a system that: • Permits voter to verify votes privately and independently • Notifies voter of"over votes" (when voter has selected more candidates than is permitted) • Produces a permanent paper record with manual audit capability • Is accessible to voters with disabilities in a manner that provides the same opportunity for access and participation • Meets the alternative language requirements of the Voting Rights Act of 1965 The Board authorized the,purchase of new a new voting system in January 2005 that meets these requirements. .✓ CONTINUED ON ATTACHMENT: ® Yes SIGNATURE: _,,.-RECOMMENDATION OF COUNTY ADMINISTRATOR _ RECOMMEND TION OF BOARD COMMITTEE ✓APPROVE _OTHER SIGNATURE(S): ACTION ON BOA ON / APPROVED AS RECOMMENDED OTHER_ VOTE OF SUPERVISORS. _ UNANIMOUS (ABSENT: _ ) I HEREBY CERTIFY THAT THIS IS A TRUE AND CORRECT COPY OF AN ACTION TAKEN AND AYES: NOES: ENTERED ON THE MINUTES OF THE BOARD OF ABSENT: ABSTAIN: SUPERVISORS ON THE nDATE SHOWN. The Department of Justice is aggressively cracking down on California counties that fail to address these new voting laws. Failure to approve this action will require Contra Costa County to fund this new voting system. Note: The State of California requires that the County indemnify, defend and save harmless the State from any and all claims and losses resulting from the performance of this agreement. SLW:ceb
