SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT Resolution No.2006137 calling an election for the confirmation of the Crockett Reorganization
consisting of formation of the Crockett Community Services District and election of the District's initial
governing board,dissolution of the Crockett-Va.lona Sanitary District,dissolution of County Service Area
P-1,and dissolution of County Sanitation District No.5.
FISCAL IMPACT:
None. If the measure is approved,the Crockett Community Services District will pay for the election. In
the event that the measure is not approved,there is an agreement that the proponent,Crockett-Valona
Sanitary District,will pay for the election.
BACKGROUND:
The attached Resolution is a reorganization initiated by the Crockett-Valona Sanitary District that
primarily consists of the following changes:
1. Formation of the Crockett Community Services District(CCSD);
2. Dissolution of the Crockett-Valona Sanitary District,County Service Area P-1 (Recreation),and
County Sanitation District No.5(Port Costa);and
3. Transfer of the Crockett Community Center to the Crockett Community Services District
pursuant to a subsequent written agreement.
In December 2004,a proposal was submitted to the Local Agency Formation Commission's Executive
Officer requesting the formation of a community services district for the Crockett area. This proposal
included the dissolution of the Crockett-Valona Sanitary District and County Service Area P-1
(Recreation). In addition,the applicants proposed that the Crockett Community Center be transferred
from the County to the newly-formed community services district. On March 9,2005,the Board of
Supervisors requested that the proposal for formation of a community services district and the transfer of
ownership of the Crockett Community Center be referred to the Transportation,Water,and Infrastructure
Committee and to the Finance Committee for study and report back to the Board of Supervisors.
On June 7,2005,the Board of Supervisors declared support for the transfer of the Crockett Community
Center property to the Crockett Community Services District,if formed. Such transfer would be
accomplished through a subsequent written agreement. On June 8,2005,the Contra Costa Local
Agency Formation Commission approved the Crcckett Reorganization consisting of the formation of the
Crockett Community Services District and.dissolution of the Crockett-Valona Sanitary District,County
Sanitary District No.5(Port Costa)and County Service Area P-1. On October 12,2005,LAFCO adopted
Resolution 04-22 requesting a confirmation election.As information,two zones will be created for
sanitation purposes and for expenses and revenues related to,respectively,the Crockett and Port Costa
sanitation facilities. Additionally,the flow of the annual allocation of the Crockett Co-Generation Facility

WHEREAS,this action is taken pursuant to the Cortese/Knox/Hertzberg Local Government
Reorganization Act (Government Code Section 56000.et seq.) and policies of the Contra
Costa Local Agency Formation Commission (hereafter LAFCO); and
WHEREAS,the boundary of the proposed district encompasses 686±acres and consists of
the Crockett-Valona Sanitary District, County Sanitation District No. 5 (Port Costa), and an
additional 25 parcels adjacent to the Crockett-Valona Sanitary District;and
WHEREAS, proceedings for the Crockett Reorganization were initiated by resolution of
application by the Crockett-Valona Sanitary District and filed with the Executive Officer of the
Contra Costa LAFCO on November 23, 2004, proposing the formation of the Crockett
Community Services District and dissolution of the Crockett-Valona Sanitary District and
County Service Area P-1. The Crockett Community Services District is to be formed for the
purpose of creating a locally-accountable public agency to provide community services,
including sewage collection,treatment and disposal,local parks and recreation,street lighting,
landscape maintenance, graffiti abatement and library facilities and services;and
WHEREAS, the reorganization, as approved by LAFCO, includes the dissolution of County
Sanitary District No. 5 (Port Costa) and inclusion of this area within the proposed Crockett
Community Services District; and
WHEREAS, on October 12, 2005,the Commission adopted LAFCO Resolution No. 04-22,
making determinations and approving the proposed reorganization subject to certain
conditions(attached is a copy of LAFCO Resolution No.04-22). These terms and conditions
are substantially:
A. The new agency shall be the Crockett Community Services District.

B. The effective date of the following components of the reorganization shall be as soon
as practicable following an election wherein the majority of voters approve the
reorganization: 1)Formation of the Crockett Community Services District;2)
dissolution of the Crockett-Valona Sanitary District;and 3)dissolution of County Service
Area P-1.
C. The effective date of the dissolution of County Sanitation District No. 5(Port Costa)
shall be the date the Regional Water Quality Control Board or its staff confirms that
the improvements delineated in the Time Schedule Order approved by that Board
have been completed and the Sanitation District has made the final payment(s)to
its contractor(s)for such improvements. Attached is a copy of the Time Schedule
Order.
D. The Crockett Community Services District shall be governed by a five-member Board of
Directors elected at large. 'The terms of office of the governing board shall be four
years,except the two members of the initial Board who receive the fewest number of
votes shall serve two-year terms.
E. The Community Services District shall be authorized to provide the following types of
services: 1)Collection,treatment and disposal of sewage,waste and storm water of
the District and its inhabitants;2)Public recreation including, but not limited to,parks,
playgrounds, swimming pools and recreation/community buildings; 3) Street lighting;
4)Landscape maintenance;5)Graffiti abatement,and;6)Acquire sites,construct and
maintain library buildings and cooperate with other governmental agencies for library
services.
F. The Community Services District is authorized to continue existing employment
contracts,retirement rights and other employee benefits and rights for employees of the
dissolved districts.
G. The Community Services District is authorized to continue to levy and collect general
taxes,fees,charges,assessments and other revenues that are from time to time levied
or received by the agencies being dissolved.
H. The property taxes currently allocated to the agencies being dissolved shall be
reapportioned to the Crockett Community Services District.
I. Special tax assessments received by County Service Area P-1 pursuant to County
Ordinance No.86-24 and other tax revenues allocated for improvement,maintenance
and operation of recreation and park facilities and services within CSA P-1 shall be
reallocated to the Crockett Community Services District.
J. The Community Services District shall include the following properties: 1) Territory
currently within the Crockett-Valona-Sanitary District; 2) Territory currently within
County Sanitation District No.5(Port Costa);3)Kendall Avenue/Vista Del Rio parcels
(720, 725, and 730 Kendall Avenue/2077, 2101, 2105, 2117,2127, 2137, 2158, and
2160 Vista Del Rio); 4) Shoreline Territory including Crockett Marina (including
Nantucket Restaurant), C&FI Sugar Refinery (830 Loring Avenue), Crockett
Cogeneration Power Plant (550 Loring Avenue), and District Wastewater Treatment
Plant and Pump Station;and 5)Assessor Parcel Numbers 368-141-006,368-141-010
and 368-144-011.
K. Two zones shall be created for sanitation purposes. Expenses and revenues related
to, respectively,the Crockett and Port Costa sanitation facilities shall be allocated by
zone in order to assign sewage facility and treatment costs for each community to that
community and to avoid having them being.borne by the other community. The
Crockett Zone shall include the territory within the predecessor Crockett-Valona
Sanitary District and areas to be served by that District. The Port Costa Zone shall
include County Sanitation District No. 5 and areas to be served by that District.

L. On the date of the formation of the Community Services District,or as soon thereafter
as practicable: 1) All assets and liabilities, physical and personal, monies or funds,
including cash on hand and monies due but uncollected, of the Crockett-Valona
Sanitary District shall be transferred to and become the assets and liabilities of the
Crockett Community Services District; 2) All assets and liabilities, physical and
personal,monies or funds,including cash on hand and monies due but uncollected of
County Service Area P-1,for recreation and park purposes held in or to be allocated to
Fund 265100, shall be transferred to and become the assets and liabilities of the
Crockett Community Services District; 3) Fee ownership of the Crockett Community
Center and the underlying assessor parcel(APN 354-103-025-4)shall be transferred to
and become the assets of the Crockett Community Services District provided that the
District is accepting the property and facility"as is,"the transfer includes all assets and
liabilities associated with the Community Center, and prior to the transfer of these
assets the District shall reimburse the County for all fees and costs,including staff time,
associated with the formation of the Community Services District and the transfer of
property to the new District.
M. On the effective date of the dissolution of County Sanitation District No.5,or as soon
thereafter as practicable, all assets and liabilities, physical and personal, monies or
funds, including cash on hand and monies due but uncollected of County Sanitation
District No. 5 held in or to be allocated to Fund 238000 shall be transferred to and
become the assets and liabilities of the Crockett Community Services District.
N. For the purposes of winding up the affairs of the dissolved districts, the Crockett
Community Services District shall be the successor agency.
O. It is intended that the Community Services District and the County of Contra Costa
reach an agreement on the continued, long-term and equitable use of a portion of the
Community Center as office space for the County Supervisor whose Supervisorial
District includes Crockett, and for the occasional use of the Community Center for
County-sponsored community events.
P. It is intended that the Community Services District create Advisory Commissions for
specific services (as identified in Section E of this resolution), the initial members of
which shall be the members of the governing boards or advisory boards of the agencies
being dissolved.
Q. All existing codes, ordinances, rules, regulations, specifications, resolution, fee
schedules and policies of the dissolved agencies shall remain in effect until modified by
the Board of Directors of the Community Services District; and
WHEREAS, on December 14, 2005, LAFCO's Executive Officer conducted a properly noticed
public hearing to receive protests filed against the proposed formation and,following conclusion of
the hearing,found that fewer than 50 percent of the voters residing within the proposed district had
filed written protests against the proposal; and
WHEREAS, the Executive Officer of LAF:,O has mailed to the Board of Supervisors a copy of
LAFCO's Resolution No. 04-22 conditionally approving the District's formation,and the Board of
Supervisors is required to call an election for the purposes of confirming the proposed
reorganization;and
WHEREAS,pursuant to Elections Code Section 10520 and Government Code Section 57150 the
Crockett Community Services District, if approved for formation, is required to reimburse the
County for the election costs incurred in the formation election.
NOW,THEREFORE, BE IT RESOLVED THAT:
1. The Board of Supervisors hereby calls a special measure election for
confirmation of the Crockett Reorganization: formation of the Crockett Community
Services District and election of the initial Board of Directors; dissolution of the

- Crockett-Valona Sanitary District; dissolution of County Service Area P-1; and
dissolution of County Sanitation District No.5. The election shall be held on June 6,
2006 and conducted pursuant to Elections Code Section 1000.
2. The ballot measure shall be substantially the following:
"Shall the Crockett Reorganization, comprised of the formation of the Crockett Community
Services District and dissolution of the Crockett-Valona Sanitary District, dissolution of
County Service Area P-1,and dissolution of County Sanitation District No.5(Port Costa),
be approved subject to the terms and conditions in the LAFCO resolution of approval upon
an affirmative vote by a majority of those voting within the territory shown in Exhibit AT'
3. The County Clerk(Elections Department)shall conduct the election pursuant to Government
Code Sections 57125-57150.
4. The County Clerk(Elections Department) and the Clerk of the Board are authorized and
directed to take all actions necessary or appropriate to implement this Resolution including:
• Publishing, posting, and mailing in a.timely manner the required notices of election.
• Determining and fixing reasonable dates prior to the election for arguments to be submitted.
• Providing notice of the date for submission of arguments and rebuttal arguments.
• Receiving and selecting arguments and rebuttal arguments on the question(s)submitted to
the voters.
• Conducting the election for members of the governing board of the new District.
• Having forms available for declarations of candidacy for District director offices in a timely
manner at least 113 days prior to the June 6, 2006 election.
• Assembling, printing, and mailing the ballot pamphlet.
• Conducting and reporting the canvas of the ballots cast.
5. The proposed reorganization shall not be confirmed and the Crockett Community Services
District shall not be formed unless the proposition is approved by a majority of the voters
voting upon the proposition. If less than a majority of the votes cast at the election is in favor
of confirming the reorganization,the Board of Supervisors shall declare the reorganization
proceedings terminated.
6. Within five days of the adoption of this Resolution,the Clerk of the Board shall transmit by
registered mail written notification of the election call or a certified copy of this Resolution to
the Executive Officer of LAFCO.
7. Pursuant to Elections Code Section 10520 and Government Code Section 57150, the
Crockett Community Services District,if approved for formation,shall reimburse the County
for the election costs incurred in the formation election. Otherwise reimbursement shall be
made as agreed by the Crockett-Valona Sanitary District.

Publishing, posting, and mailing in a timely manner the required notices of election.
Determining and fixing reasonable dates prior to the election for arguments to be submitted.
Providing notice of the date for submission of arguments and rebuttal arguments.
Receiving and selecting arguments and rebuttal arguments on the question(s)submitted to
the voters.
Conducting the election for members of the governing board of the new District.
• Having forms available for declarations of candidacy for District director offices in a timely
manner at least 113 days prior to the June 6, 2006 election.
Assembling, printing,and mailing the ballot pamphlet.
• Conducting and reporting the canvas of the ballots cast.
5. The proposed reorganization shall not be confirmed and the Crockett Community Services
District shall not be;formed unless the proposition is approved by a majority of the voters
voting upon the proposition. If less than a majority of the votes cast at the election is in favor
of confirming the reorganization,the Board of Supervisors shall declare the reorganization
proceedings terminated.
6. Within five days of the adoption of this Resolution,the Clerk of"the Board shall transmit by
registered mail written notification of the election call or a certified copy of this Resolution to
the Executive Officer of LAFCO.
7. Pursuant to Elections Code Section 10520 and Government Code Section 57150, the
Crockett Community Services District,if approved for formation,shall reimburse the County
for the election costs incurred in the formation election. Otherwise reimbursement shall be
made as agreed by the Crockett-Valona Sanitary District.

C. The Crockett Community Services District shall be governed by a five-member
Board of Directors elected at large. The terms of office of the governing board shall
be four years, except the two members of the initial Board who receive the fewest
number of votes shall serve two-year terms.
D. The Community Services District shall be authorized to provide the following types
of services:
1. Collection, treatment and disposal of sewage, waste and storm water of the
District and its inhabitants
2. Public recreation including but not limited to parks,playgrounds, swimming pools
and recreation/community buildings
3. Street lighting
4. Landscape maintenance
5. Graffiti abatement

6. Acquire sites, construct and maintain library buildings and cooperate with other

E. The Community Services District is authorized to continue existing employment
contracts, retirement rights and other employee benefits and rights for employees of

F. Taxes,Charges,Fees and Assessments
1. The Community Services District is authorized to continue to levy and collect
general taxes, fees, charges, assessments and other revenues that are from time to
time levied or received by the agencies being dissolved.
2. The property taxes currently allocated to the agencies being dissolved shall be
reapportioned to the Crockett Community Services District.
3. Special tax assessments received by County Service Area P-1 pursuant to County
Ordinance No. 86-24 and other tax revenues allocated for improvement,
maintenance and operation of recreation and park facilities and services within
CSA P-1 shall be reallocated to the Crockett Community Services District.
G. The Community Services District shall include the following properties:

H. Two zones shall be created for sanitation purposes. Expenses and revenues related to,

zone in order to assign sewage facility and treatment costs for each community to that
community and to avoid having them being borne by the other community.
1. The Crockett Zone shall include the territory within the predecessor Crockett-
Valona Sanitary District and areas to be served by that District.
2. The Port Costa Zone shall include County Sanitation District No. 5 and areas to
be served by that District.
I. On the date of the formation of the Community Services District, or as soon thereafter
as practicable:
1. All assets and liabilities, physical and personal, monies or funds, including cash
on hand and monies due!but uncollected, of the Crockett Valona Sanitary District
shall be transferred to and become the assets and liabilities of the Crockett
Community Services District.
2. All assets and liabilities, physical and personal, monies or funds, including cash
on hand and monies due but uncollected of County Service Area P-1, for
recreation and park purposes held in or to.be allocated to Fund 265100, shall be
transferred to and become the assets and liabilities of the Crockett Community
Services District.
3. Fee ownership of the Crockett Community Center and the underlying assessor
parcel (APN 354-103-025-4) shall be transferred to and become the assets of the
Crockett Community Services District provided that

b. The transfer includes all assets and liabilities associated with the Community
Center
c. Prior to the transfer of these assets the District shall reimburse the County for

K. For the purposes of winding up the affairs of the dissolved districts the Crockett
Community Services District shall be the.successor agency.
L. The intent of the Commission is that the Community Services District and the County
of Contra Costa reach an agreement on the continued, long-term and equitable use of
a portion of the Community Center as office space for the County Supervisor whose
Supervisorial District includes Crockett,and for the occasional use of the Community
Center for County-sponsored community events.
M. The intent of the Commission is that the Community Services District create
Advisory Commissions for specific services,the initial members of which shall be the
members of the governing boards or advisory boards of the agencies being dissolved.
N. All existing codes, ordinances, rules, regulations, specifications, resolution, fee
schedules and policies of the dissolved agencies shall remain in effect until modified
by the Board of Directors of the Community Services District.
8. All subsequent proceedings in connection with this reorganization shall be conducted
only in compliance with the approved boundaries set forth in'the attachments and any
terms and conditions specified in this resolution.
9. The Executive Officer be directed to conduct subsequent proceedings in compliance with
the Commission determinations upon signing of the resolution.

1. This action is fakers pursuant to the Cortese/Knox/Hertzberg Local Government
Reorganization Act (Government Code Section 56000 et seq.) and policies of the Contra Costa
Local Agency Formation Commission(hereafter Commission), and
2. Proceedings for the Crockett Reorganization were initiated by resolution of
application by the Crockett-Valona Sanitary District and filed with the Executive Officer of the
Contra Costa LAFCO on November 23, 2004, proposing the formation of the Crockett
Community Services District, and dissolution of the Crockett-Valona Sanitary District and
County Service Area P-1. The Crockett Community Services District is to be formed for the
purpose of creating a locally accountable public agency to provide community services, including
sewage collection, treatment and disposal, local parks and recreation, streetlighting, landscape
maintenance, graffiti abatement and library facilities and services.
3. The reorganization as approved by the Commission on June 8, 2005, includes the
dissolution of County Sanitary District No. 5 (Port Costa) and inclusion of this area within the
proposed Crockett Community Services District.
4. On June 8, 2005, the Commission adopted Resolution No. 04-22, making
determinations and approving the proposal subject to certain conditions. A true copy of said
Resolution is attached hereto and incorporated by this reference, containing the terms and
conditions of the Conunission's approval of this proposal.
5. Acting on delegated authority from the Commission, as Executive Officer I
conducted on December 14, 2005, a properly noticed public hearing to receive protests filed
against the proposed formation and, following conclusion of the hearing, found that fewer than
50 percent of the voters residing within the proposed district had filed written protests against the
proposal.

6. Finding there are insufficient protests to terminate the proceeding, I hereby
authorize and request the County of Contra Costa to conduct a confirmation election on the
Crockett Reorganization subject to the terms and conditions contained within the Commission's

following,which shall require a majority approval of those voting:
"Shall the Crockett Reorganization, comprised of the formation of the
Crockett Community Services District and dissolution of the Crockett-Valona

TO UPGRADE AND REPAIR ITS WASTEWATER TREATMENT FACILITY
The California Regional Water Quality Control Board,San Francisco Bay Region(hereinafter
Water Board)finds that:
Background
1. The Contra Costa County-Sanitation District No. 5(hereinafter called the Discharger)
operates a wastewater treatment plant(WWTP)that serves the community of Port Costa,
which has a population of about 240 people. The Discharger also owns and maintains a
few miles of sewer collection system. All sewage drains by gravity and/or is pumped to the
WWTP.
2. The WWTP consists of a septic tank,sand filter beds,disinfection system and outfall,and
treats an average of about 17,000 gallons per day(gpd)of primarily domestic sewage. This
is below the WWTP's dry weather design capacity of 33,000 gpd.
3. The sewage collection system conveys wastewater to a septic tank where primary
sedimentation occurs. From the septic tank,wastewater flows by gravity to a wet well
where it mixes with previously treated wastewater. After mixing,the wastewater is
pumped to a dosing structure,which distributes wastewater to a series of four sand/gravel
filter beds. From the sandlgravel filter beds,a portion of the treated wastewater is routed
back to the wet well to mix with the.septic tank effluent. The remaining treated wastewater
flows into a contact chamber,where it is chlorinated,and then dechlorinated before
discharge into the Carquinez Strait. The discharge is through a submerged outfall and
diffuser that provides at least a 10:1 initial dilution.
4. The discharge of effluent from the Discharger's WWTP is regulated by NPDES Permit No.
CA0037885,contained in Water Board Order No.R2-2003-0009,adopted by the Water
Board on January 22,2003.
Treatment Plant Status
5. During a September 24,2002,site visit by Water Board staff,the Discharger indicated that
it no longer used one of its four sand filter beds,as the concrete base of this sand filter bed
leaked.The Discharger indicated that its WWTP can operate efficiently with only one or

two sand filter beds since their current flows were well below the WWTP's design flow.
As a result,Order No.R2-2003-0009 limits the WWTP's average dry weather flow to
25,000 gpd until the Discharger certifies that it has made the necessary repairs to the sand
filter beds. Additionally,the Discharger explained that it needed to have the impacted sand
media on all of its filter beds replaced,but that it lacked construction equipment access to
the WWTP since the railroad crossing to the WWTP was destroyed about five years prior.
6. During a March 24,2004,site visit by Water Board staff,they learned that the one sand
filter bed still leaked and could not be used. The other three beds were used,with the flow
manually switched between them,as the automatic dosing structure was broken.The sand
in all of the filter beds had never been replaced and the base of the operating filter beds had
settled such that the surface distribution pipes were broken,allowing the wastewater to
pond at the inlet to the beds,allowing for poor distribution of the water throughout the bed.
7. After the site visit a decision was made to upgrade the chlorine and bisulfite feed
equipment to an automatic operation,and to provide for emergency power and improved
equipment alarms.
Effluent Violations
B. For the period from January 2001 to June 2003,the Discharger had the following violations
of its effluent limitations:four chlorine residual violations,one 3-sample median acute
toxicity violation,seven daily maximum total coliform violations,and eleven 5-day median
total coliform violations,that are subject to an MMP,pursuant to Section 13385(h)(1)and
.13385(i)of the California Water Code,for a total MMP amount of$57,000,all or part of
which may be spent on a Compliance Project(CP).
9. The Discharger proposed the implementation of a CP. The CP includes a subset of all of
the tasks proposed in their August 9,2005,letter,which identified eleven different
proposed upgrades and repairs to the WWTP,intended to retrofit the plant with updated
technology,which should result in a higher quality effluent. The Discharger is planning to
finance the CP through a combination of a State revolving fund loan,grants and/or a
conventional loan to proceed with the upgrades. The Discharger anticipates securing the
monies by Octobcr 2006,and that-the plant upgrades would be completed by November
2007. The Water Board finds that the proposed CP is acceptable as it is designed to correct
the violations within five years,is in accordance with the State Water Resources Control
Board's February 19,2002,Water Quality Enforcement Policy and the Discharger can
demonstrate that it will have sufficient funding to complete the CP.
10. To ensure that the Discharger takes timely action to fund and complete the necessary
upgrades to the WWTP,the Water Board is issuing this Time Schedule Order.
Authority and Basis for Time Schedule Order
H.. Section 13300 of the California Water Code authorizes the Water Board to issue a time

schedule order when it finds that:a discharge of waste is taking place or threatening to take
place that violates or will violate,requirements prescribed by the Water Board,or that the
waste collection,treatment,or disposal facilities of a Discharger are approaching capacity.
The Water Board may require the Discharger to submit a detailed time schedule of specific
actions that the Discharger shall take in order to correct or prevent a violation of
requirements.
12. The Discharger's WWTP needs repairs,and plant upgrades are necessary to assure future
compliance with waste discharge requirements. This Order establishes a CP to allow the
Discharger to complete necessary actions to the WWTP.
CEQA and Public Notice
13. This action is an enforcement action and,as such is exempt from the provisions of the
California Environmental Quality Act(Public Resources Code, Section 21000 et seq.)in
accordance with section 15321,Title 14,California Code of Regulations.
14. The Water Board has notified the Discharger and interested persons of its intent under
California Water Code Section 13300 to consider the adoption of a Time Schedule Order
for the discharge,and has provided them with an opportunity to submit written comments
and appear at the public hearing. Responses to written comments are hereby incorporated
by reference as part of this Order.
15. The Water Board,in a public hearing,heard and considered all comments pertaining to this
Order.
IT IS HEREBY ORDERED that,in accordance with section 13300 of the California Water Code,
the Discharger shall comply with the tirne schedule and other provisions specified below:

2. The discharger shall submit semi-annual progress reports to describe the progress of the
activities to fulfill the above requirements. Progress reports shall be submitted on February
1 and August 1 of each year witli the first report due on February 1,2006,until the
requirements have been fulfilled..
3. If the Discharger is delayed,interrupted,or prevented from meeting one or more of the time
schedules in this Order due to circumstances beyond its reasonable control,the Discharger
shall promptly notify the Executive Officer with adequate justification. In the event of such
delays,the Water Board may consider modification of the time schedules established in this
Order.
4. If the Discharger fails to comply with the provisions of this Order,the Executive Officer is
authorized to take further enforcement action,or to request the Attorney General to take
appropriate actions against the Discharger,in accordance with sections 13331, 13350,
13385,and 13386 of the California Water Code. This shall include injunctive and civil
remedies,if appropriate,or the issuance of an Administrative Civil Liability for Water
Board consideration.
5. The Discharger shall maintain a copy of this Order at its facility so as to be available at all
times to facility operating personnel.
6. This Order shall be effective on the date of adoption.
