Ill. BACKGROUND
On February 22, 2005, the County Planning Commission unanimously voted to recommend
that the Board of Supervisors approve a P-1 rezoning and final development plan for a 15-lot
single family residential development on 20 acres in the Walnut Creek/North Gate area, as
recommended by staff, subject to minor modifications.
The Commission also approved the related subdivision application, contingent on conforming

the rezoning and final development plan recommendations; no appeal was

filed on the Commission approval of the subdivision, so it has become final.
IV. INITIAL BOARD HEARING
The Board of Supervisors opened the hearing on the Commission's recommendation on June
149 2005. At that time, several neighbors expressed concern regarding the drainage
requirements for the project. The Board indicated that it wished to see if the interested parties
could try to resolve their concerns prior to Board action on this project. Consequently, the
Board continued the hearing to allow the interested parties to discuss their respective concerns.
V. DISCUSSION
Subsequent to the Board hearing, Public Works Department staff has met separately with the
Applicant, and with a neighbor. However, at the time of preparation of this report,there was no
evidence of any substantive communications between the Applicant and neighbors on the
concerns of the neighbors.
Due to the apparent unresolved status of the issues previously presented to the Board, it
appears that more time is needed by the interested parties to try to resolve these matters.
Accordingly, the hearing on this project should be continued again.
