SUBJECT: APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a 5-Year Lease
with Option to Purchase, Settlement Agreement & Mutual Release and a Memorandum of Option
to Purchase for property located at 75 Bliss Avenue. Pittsburg area. District V.
Project No. 4660-6X4287 Task No. ACQ Account No. 3540
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action;
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a 5-year Lease with
Option to Purchase, Settlement Agreement& Mutual Release and a Memorandum of Option to Purchase
between Contra Costa County and U-Haul Co. of California (U-Haul) for 75 Bliss Avenue, Pittsburg, APN
088-171-027.
Financial Imnant:
The 5-year (60 months) Lease calls for a monthly rent payment of $5,000. U-Haul shall receive from
County a rent credit in the amount of $5,000 for each of the first thirty (30) months of the term of the
lease.
Roasons for Recommendations and Elar-karound:
The property which is the subject of this lease is located at 75 Bliss Avenue in Pittsburg and was acquired
by the County with Contra Costa Transportation Authority (CCTA) funds for the State Route 4 East
Project. The property is not needed for the project. At the time the County acquired the property, U-Haul
was a tenant. After it acquired the property the County required that U-Haul vacate the premises. U-Haul
filed an inverse condemnation claim challenging its removal from this property. As part of the inverse
condemnation settlement, U-Haul will be put back into possession of the property under a 60-month lease
with an option to purchase. U-Haul will be responsible for recording the Memorandum of Option to
Purchase. Possession by the tenant is intended to begin on or about July 1, 2005, following the
completion of certain repairs.
Tenants ability to exercise the Option to Purchase will expire on or about July 1, 2007, two years from
possession date. The Option to Purchase price shall be the fair market value of the property at the time
the Option is exercised, as determined by an appraisal.
