RECOMMENDATION(S):
ADOPT Resolution No. 2005/ 396 for Minor Subdivision 66-00089, accepting Deferred Improvement
Agreement as Satisfied for project being developed by James H. Farr and Patricia S.Farr.,Martinez area. (District
II)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The conditions of approval for Minor Subdivision 66-00089 required construction of improvements along Blum
Road. The Public Works Department executed a Deferred Improvement Agreement with James H.Farr and Patricia
S.Farr.,permitting the deferment of construction of the improvements. The Engineering Services division of Public
Works has reviewed the improvements plans for Subdivision 04-08839 and has determined that the Subdivision 04-
0 8 8 3 9 improvements satisfy the improvements described in Exhibit`A'of the Deferred Improvement Agreement for
Minor Subdivision 66-00089.
CONSEQUENCES OF NEGATIVE ACTION:
The Deferred Improvement Agreement will not be erated.

SUBJECT: Accepting Deferred Improvement Agreement as Satisfied for Minor Subdivision 66-
000891 Martinez area. (District II)
On September 10, 1991, the Board authorized the Public Works Director to execute a
Deferred Improvement Agreement with James H. Farr and Patricia S.Farr for improvements along
Blum Road as required by the conditions of approval for Minor Subdivision 66-00089.
The aforesaid Deferred Improvement Agreement was recorded on September 15, 1991 in
Book 16875 of Official Records at page 386 and became an encumbrance against Assessor's Parcel
No. 159-170-004.

The Public Works Director now informs this Board that the requirements outlined in said
agreement have been satisfied by improvements for Subdivision 04-08839.
The Board hereby FINDS that the conditions of the above-mentioned Deferred Improvement
Agreement are satisfied by improvements for Subdivision 04-08839.
NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Improvement
Agreement is EXONERATED.
