Ord. 95-2 requiring the removal of inoperable vehicles or parts thereof from private property located at 1547 Bayo Vista Ave., San Pablo, APN:41971=-0 011-3. The Sheriff requests the Board deny the Appeal and direct the Sheriff to proceed with the abatement action as scheduled. 11 FISCAL IMPACT: No impact 11 BACKGROUND/REASONS FOR RECOMMENDATIONS: On January 24, 20051 the site was inspected by Vehicle Abatement Officer, Gene Haney. Officer Haney identified (1) vehicle that was dismantled, wrecked or inoperable and fit the parameters of the Abandoned Vehicle Program. Notice of Intent to Abate Abandoned Vehicles, per County Ordinance 95-2, were mailed to all interested parties on January 25, 2005. On February 20, 2005, Tenant Christ Kiteas III requested an Appeal Hearing before the Zoning Administrator based on his intentions to repair the vehicle. Mr. Kiteas stated., "That he and his wife use the vehicle during the summer months, and that they have not used the vehicle-in a while since we now have three children and we do not all fit in the vehicle. The vehicle runs and all glass and safety equipment is intact. We plan to use this vehicle more often when our children are grown." On March 23 and 25th, and then inspected again, on Apri14"', 2005, Officer Haney reinspected the site and found the vehicle had appeared to be in the same state of disrepair. On March 28, 2005, an Appeal Hearing was held in Mr. Kiteas' absence before the Zoning Administrator. The Zoning Administrators decision was that the vehicle be removed within 10 days. Mr. Kiteas was made aware of this decision by mail on March 29, 2005. Mr. Haney indicated that the vehicle was inoperable and had not been registered with the Department of Motor Vehicles for five years. Supervisor Gioia noted that he had been to the property site. He agreed the vehicle did not appear operational. He noted that it was not clearly visible from the street when the property gate is closed. He suggested that if the owner constructed a barrier with vegetation, it would not be visible looking down the driveway and recommened a continuance of the matter to afford the owner time to make. Sheriff Rupf recommended the ordinance be modified to address incidences such as the current matter, should this isolated type of case become a trend. The Chair opened the public hearing. There were no requests to speak on this matter. Supervisor Gioia stated that he had spoken to the property owner the previous day, and had indicated that he did not need to attend. By motion made by Supervisor Gioia, and seconded by Supervisor DeSaulnier,the hearing was continued for four months, with direction to the property owner(s)to install the appropriate lattice shield in front of the vehicle, and to repair the vehicle. Mr. Kiteas stated in his written request for an appeal that the Volkswagon Bus, license#2UAF074, only gets used during the summer months; on weekends to go camping, and that they have not used it in a while since they now have three children and do not all fit in the vehicle. Section 22660 of the California Vehicle Code allows the County to adopt and ordinance establishing procedures for the abatement and removal, as a possible nuisances, Of abandoned, wrecked, dismantled, and/or inoperative vehicles or parts thereof from private property. Contra Costa County adopted County Ordinance 86-58,establishing local abatement procedures for the removal of abandoned, wrecked, dismantled, and/or inoperative vehicles or parts thereof from private property. The ordinance was amended under County Ordinance 95-2 to make the Office of the Sheriff the agency responsible for the enforcement of the provisions of the Abandoned Vehicle Abatement Program.
