Authorize the Sheriff to proceed with enforcement of Co. Ord. 95-2 requiring the removal of
inoperable vehicles or parts thereof from private property located at 1547 Bayo Vista Ave.,
San Pablo, APN:41971=-0
011-3. The Sheriff requests the Board deny the Appeal and direct
the Sheriff to proceed with the abatement action as scheduled.

11 BACKGROUND/REASONS FOR RECOMMENDATIONS:
On January 24, 20051 the site was inspected by Vehicle Abatement Officer, Gene Haney.
Officer Haney identified (1) vehicle that was dismantled, wrecked or inoperable and fit the
parameters of the Abandoned Vehicle Program. Notice of Intent to Abate Abandoned
Vehicles, per County Ordinance 95-2, were mailed to all interested parties on January 25,
2005.
On February 20, 2005, Tenant Christ Kiteas III requested an Appeal Hearing before the
Zoning Administrator based on his intentions to repair the vehicle. Mr. Kiteas stated., "That he
and his wife use the vehicle during the summer months, and that they have not used the
vehicle-in a while since we now have three children and we do not all fit in the vehicle. The
vehicle runs and all glass and safety equipment is intact. We plan to use this vehicle more
often when our children are grown."
On March 23 and 25th, and then inspected again, on Apri14"', 2005, Officer Haney
reinspected the site and found the vehicle had appeared to be in the same state of disrepair.
On March 28, 2005, an Appeal Hearing was held in Mr. Kiteas' absence before the Zoning
Administrator. The Zoning Administrators decision was that the vehicle be removed within 10
days. Mr. Kiteas was made aware of this decision by mail on March 29, 2005. On April 4,
2005, Mr. Kiteas requested a hearing before the Board of Supervisors.

The staff report on the appeal of the vehicle abatement was given by Gene Haney, Specialist, Abandoned
Vehicle Abatement Officer, Sheriff's Department.
Mr. Haney indicated that the vehicle was inoperable and had not been registered with the Department of
Motor Vehicles for five years.
Supervisor Gioia noted that he had been to the property site. He agreed the vehicle did not appear
operational. He noted that it was not clearly visible from the street when the property gate is closed. He
suggested that if the owner constructed a barrier with vegetation, it would not be visible looking down the
driveway and recommened a continuance of the matter to afford the owner time to make.
Sheriff Rupf recommended the ordinance be modified to address incidences such as the current matter,
should this isolated type of case become a trend.
The Chair opened the public hearing. There were no requests to speak on this matter. Supervisor Gioia
stated that he had spoken to the property owner the previous day, and had indicated that he did not need to
attend.
By motion made by Supervisor Gioia, and seconded by Supervisor DeSaulnier,the hearing was
continued for four months, with direction to the property owner(s)to install the appropriate lattice shield
in front of the vehicle, and to repair the vehicle.

SECTION III. Chapter 430-b of the County Ordinance Code is amended, to designate
the She as the County official responsible for administering the provisions of Division
430, Abandoned Veh!cJe Ordinance, and to delete all references to the Director of
Building Inspection., to read:

ADMINISTRATION AND ENFORCEMENT
430=6,002 Enfo rmnt Authority. The Sheriff. is designated the enforcement
officer for this division. The She and his regularly salaried full-time employees shall be
responsible for enforcing and administering this division pursuant to Vehicle Code Suction
22663. In the enforcement of this division, such employees and other persons duly
authorized by the She may enter upon private or public property to examine a vehicle
or parts thereof, obtain info allon as to the identity of a vehicle and to remove or use
the removal of an abandoned vehicle,, (Oros. 95-2 31 86-58 §3, 77-1 12.)
430-6.004 Abatement The enforcement officer may have abandoned vehicles
abated and/or removed in a rdan with the procedure pres, "bed in this division.

SECTION VI. Section 430-10.006 of the County Ordinance Code is emended to delete
the reference to the "Director of Building Inspection" and to substitute "enforcement
offjce', to read:

written account of his or her expenses incurred to abate the nuisance where It is
proposed to collect costs pursuant to Chapter 430-12. Until such report is completed, no
abatement costs(including administration)wilt be placed as a special assessment against

SECTION VII. Section 430-m12-.004 of the County Ordinance Codels amended to delete
the reference to the "Director of Building Inspection" to "enforcement offjcer," to read:

Background:
On January 24, 2005, an inspection was made of 1547 Bayo Vista Avenue, San Pablo and (1)
vehicle was identified as abandoned, 'wrecked or dismantled. The vehicle was tagged and the
property and vehicle owner was mailed a Notice of Intent to Abate Abandoned Vehicles. On
February 10t', 2005, property owner, Chris Kiteas 111, requested an appeal. Mr. Kiteas stated in
his written request for an appeal that the Volkswagon Bus, license#2UAF074, only gets used
during the summer months; on weekends to go camping, and that they have not used it in a while
since they now have three children and do not all fit in the vehicle. Mr. Kiteas did not request an
inspection on the vehicle in which he could prove that it was in operating con "tion.

Authonty.
Section 22660 of the California Vehicle Code allows the County to adopt and ordinance
establishing procedures for the abatement and removal, as a possible nuisances, Of abandoned,
wrecked, dismantled, and/or inoperative vehicles or parts thereof from private property.
Contra Costa County adopted County Ordinance 86-58,establishing local abatement procedures
for the removal of abandoned, wrecked, dismantled, and/or inoperative vehicles or parts thereof
from private property. The ordinance was amended under County Ordinance 95-2 to make the
Office of the Sheriff the agency responsible for the enforcement of the provisions of the
Abandoned Vehicle Abatement Program.
Recommendation:
Allow the Sheriffs Office to proceed with this abatement action

Vehicle(s)were observed by this Department, (see attached inventory on property owned
by or under your control), in an abandoned condition. County Ordinance 95-2 requires
the removal, as a public nuisance, of abandoned, wrecked, dismantled!, or inoperative
vehicle(s), or parts thereof from public or private property. Said vehicle(s) are in
violation of this Ordinance and must be removed. If you do not remove these vehicles,
the Sheriirs Office will remove the vehicle(s) and a minimum cost of$115.00 per
vehicle will be billed to you. Failure to pay the bill will result in a special assessment to
the owner of the land as shown on the last equalized assessment roll.
HEARING RIGHTS
If you contend that these vehicle(s) are not subject to 'abatement you-are entitled to a
hearing. You may request a hearing by contracting the Contra Costa County Sheriffs
Office, in writing, stating the reason for a denial, within 10 days of the postmarked date

of this notice. Your presence is not required at the hearing. If you do not own the
vehicle(s)and they were placed. on your property without your consent,, they will be
removed by the Sheriffs Office at no expense to you. If the vehicle(s)belong to a tenant
residing on your property, you are responsible for the property and will be billed
accordingly. If you wish to remove the vehicle(s)yourself, contact the Abandoned
Vehicle Abatement Program. If you have any questions regarding this letter, contact the
Abandoned Vehicle Abatement Program at (925)313-2659.

IMPORTANT NOTICE
If you contend that your vehicle(s) are operable, you must contact
the abatement officer and schedule an appointment to prove that
vehicles) are in running condition. An operable vehicle must be
started using its electrical system, move forward and reverse us g
its transmission and stop using its braking system; all legal glass
must be intact..
Vehicles removed from private property under this Program cannot
be returned to the property or registered owner and will be
dismantled per California Vehicle Code Section 22661(fl, which
states:
The requirement that after a vehicle has been removed, it
shall not be reconstructed or made operable, unless it is a
vehicle that qual des for either horseless carriage license
plates or historical vehicle license plates, pursuant to Section
5004, in which case the vehicle tnay be reconstructed or
made operable.
