McKinney-Vesta Application for the Serial Inebriates Funding.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
A. APPROVE AND AUTHORIZE the Director of the Health Services Department or his designee to
execute and transmit, on behalf of the County, an application for the 2005 HUD Serial Inebriates
funding g alon with the necessary certifications and assurances to the Department of Housing and
Urban Development.
B. AUTHORIZE the Director of Health Services or his designee, if awarded, to accept up to $1.0M
in HUD Mc-Kinney-Vento funding and enter into a contract with the Dept. of Housing and Urban
Development to perform all responsibilities in relationship to receipt of the funding and contracted

provisions for FY 05/06 -- FY 09/10.
FISCAL IMPACT
This application seeks funding to enhance Contra Costa County's Project Coming Home (PCH), a

Chronic Homelessness Initiative-funded project that provides integrated outreach, treatment,
housingand support services for people who are chronically homeless. This enhancement /pP

AddressingAddictions to Alcohol (AAA) will target housing and services to chronically homeless
individuals who have a long- term addiction to alcohol and will strengthen and formalize PCH,s
linkages with the County's law enforcement and court system. This application requests funding for

rental subsidies for scattered-site, one-bedroom apartments throughout Contra Costa County.
PCH-AAA includes: 1) identification of chronically homeless serial inebriates through outreach to
encampments and through collaboration with law enforcement agencies and the courts; 2)
assessment and stabilization. of chronically homeless serial inebriates on a case-by-case basis

through rams such as residential treatment, detoxification or jail diversion programs; 3) client
programs
placement into permanent housing; and 4) provision of appropriate supports including alcoholism
treatment services, assistance in accessing mainstream benefits, and other relevant services.

RECOMMENDATIONS
APPROVE and AUTHORIZE the Deputy Director,Redevelopment or his designee to execute a contract
with Goldfarb&Lipman in an amount of$50,000 to provide legal services related to affordable housing
and economic development loans made with Community Development Block Grant(CDBG),HOME
Investment Partnership Act (HOME), and Housing Opportunities for Persons with AIDS (HOPWA)
funds for the period July 1, 2005 through June 30, 2006.
FISCAL IMPACT
No General Fund impact.HOME and CDBG funds are provided to the County on a formula allocation
basis through the U.S.Department of Housing and Urban Development(HUD).Funding of$50,000 will
come from administrative funds currently allocated to each program(approximately$25,000 each from
HOME and CDBG).
BACKGROUND/REASONS FOR RECOMMENDATIONS
Contra Costa County receives an allocation of approximately$5 million in federal CDBG,HOME and
HOPWA funds for use in developing housing affordable to lower income households i he County.

These funds are typically provided to affordable housing developers in the form of a subsidized loan.
The County's funds are secured against the property by a deed of trust and specific affordability and use
restrictions are incorporated into a loan and regulatory agreement between the County and project
developer. In addition to housing, approximately $500,000 in CDBG funds is allocated on an annual
basis to economic development projects designed to create jobs for low-income persons.These funds are
also typically secured against the project property through a deed and loan agreement. The law firm of
Goldfarb and Lipman has previously provided the County with legal assistance in negotiating loan terms
and drafting the required legal documents for CDBG and HOME projects.The proposed contract would
be a continuation of this relationship.

FOR PROVISION OF CRIMINAL CONFLICT DEFENSE SERVICES

RECOMMENDATION:
APPROVE and AUTHORIZE the County Administrator, or designee, to execute a two year
contract with the Contra Costa County Bar Association, in an amount not to exceed
$2,000,000 annually to continue to provide mandated criminal conflict defense and other
legal services for the period July 1, 2005 through June 30, 2007.
FISCAL IMPACT
The provision of conflict defense services by the Bar Association is contingent upon
appropriation of funds in the Final Budget. Appropriations for FY 2005/06 will be
submitted for approval in the Final Budget for FY 2005/06, and subject to cancellation if
funding is not approved. Funding for the second year of the contract will be recommended
for FY 2006/07 with the contract subject to cancellation if not approved as part of the Final
Budget for FY 2006/07.
BACKGROUND/REASON(S) FOR RECOMMENDATIONS):
Since 1983, the County has contracted with the Contra Costa County Bar Association for
the provision of conflict defense services. The original contract was in response to the
escalating cost of conflict defense services under the old system of court-appointed
counsel. Subsequently, in FY 1991-92, the Public Defender created an Alternate
Defender's Office to handle conflict cases. The cases referred to the Bar Association
generally represent multiple co-defendant cases in which the Alternate Defender's Office
can only handle all co-defendants.

The contract includes the costs associated with conflict defense services for representing
criminal and delinquency cases referred to the Bar Association through a written affidavit
of conflict by the Public Defender and the Alternate Defender. Additionally, the contract
will include provision for the County's obligation to pay for legal services in Juvenile
Immigration and Guardian Ad Litem cases.
The contract does not include provision for costs of representation of dependency cases.
These cases have been excluded from the County's contract since the Lockyer-Isenberg
Trial Court Funding Act of 1997 placed the responsibility for payment of costs associated
with such cases within the Courts' State Trail Court Funding budget. It is no longer a
County financial obligation.
The contract will include a new fee schedule for cases appointed after July 1, 2005. The
Bar Association contract has not had an increase in the fee schedule since July 1, 2001.
The proposed fee schedule would increase attorney rates by 5%, and results in an
estimated increase of$90,000 in annual costs. Additionally, $70,000 is included in the
contract for Juvenile Immigration and Guardian Ad Litem cases that were previously paid
by the Courts and reimbursed by the County, but will now be paid directly by the County
through this contract.
CONSEQUENCES OF NEGATIVE ACTION:
Payment of criminal conflict attorney services is a mandated County cost. If the
recommended action is not approved, the contract with the Bar Association will terminate
June 30, 2005. The appointment and payment of private attorneys for conflict cases that
cannot be handled by the Alternate Defender's Office will revert to the court-appointed
method used prior to the Bar Association contract. All active and new criminal and
delinquency conflict cases would be referred to the courts for appointment of defense
counsel.

I. RECOMMENDATION:
APPROVE and AUTHORIZE the Sheriff, or his designee, to execute a contract on behalf
of the County with Hunter Research, Incorporated, in an amount not to exceed $800,000.00,
to complete software design, development and programming service for the Contra Costa
County Integrated Justice Information System for the period July 1, 2005 through June 30, 2008.
li. FINANCIAL IMPACT:
NONE. Funding sources will be from the DOJICOPS Earmark Grant and designated State
Homeland Security Grant funds.
111. BACKGROUND:
The proposed contract with Hunter Research, Inc., provides the continuity in the three year
strategic plan developed by Automated Regional Information Exchange System (ARIES)
Operations Committee and adopted by the County Justice Automation Advisory Committee
(JAAC) for countywide justice and law enforcement systems integration and information sharing.

FINANCIAL IMPACT:
The projects above are part of the continued operation of the County Justice System Projects
component of the State Realignment Program and reflect a continued maintenance of effort
based upon approved FY 2004-05 amounts. All of these projects are included in the County
Administrator's Recommended Budget for FY 2005-06.
REASONS FOR RECOMMENDATION/BACKGROUND:
All of the projects provide the justice system with an integrated approach to justice system
processing of juvenile cases. The East County Youth and Family Services (Brentwood Police
Department) and the West Contra Costa Youth Service Bureau both provide diversion projects
to law enforcement and school districts that assist in decreasing the referrals to Juvenile Hall
and Juvenile Court. STAND receives funding to support their Batterer's Abatement Program.
All three of these projects require continuation of existing contracts.
Additional revenues from the State Realignment Program support the District Attorney, Public
Defender and Probation Department projects that are State mandated programs related to the
prosecution, adjudication and supervision of delinquent juveniles.
