RECOMMENDATIONS
ACCEPT recommendations of the Fish and Wildlife Committee regarding the awarding of grants from the Fish
and Wildlife Propagation Fund;
DIRECT the Auditor/Controller to release a total of$90,081 from the Fish and Wildlife Propagation Fund to the
following organizations to support projects benefiting the fish and wildlife resources of the County: $11,000 to the
Walnut Creek Open Space Foundation, $10,000 to the Contra Costa Sheriff's Dept., $10,000 to EBMUD
(Lafayette Reservoir), $8,951 to the Contra Costa Resource Conservation District, $8,500 to the Contra Costa
Watershed Forum (c/o Contra Costa County Community Development Dept.), $7,500 to the Regional Parks
Foundation for the East Bay Regional Park District,$7,500 to EBMUD(Pinole and San Pablo Watershed),$5,600
to the Watershed Project, $5,000 to the Walnut Creek Open Space Foundation, $4,500 to Lindsay Wildlife
Museum, $4,000 to Friends of Pinole Creek Watershed, $2,300 to Friends of Five Creeks,$2,000 to Friends of
the SF Estuary/Creek Keepers,$1,500 to EBMUD(East Bay Hills),$1,250 to Friends of the Creeks,and$480 to
Mt. Diablo Audubon.
FINANCIAL IMPACT
No impact to the general fund. A portion of the fines collected from violations of fish and game regulations in the
County is deposited in the Fish and Wildlife Propagation Fund, which has a current balance of approximately
$155,000. State law defines how money in this fund may be spent, but the Board of Supervisors is responsible
for authorizing specific expenditures. The 16 projects recommended to receive funding are consistent with the
expenditure criteria established by State Law.
REASON FOR RECOMMENDATION/BACKGROUND
Since 1996,the Fish and Wildlife Committee(FWC)has implemented a structur process for reviewing funding
requests. The intent of this structured review process was to replace case-by a e decision-making (such as
occurred previously and such as is the norm with most other Fish and Wildlife o i i grant process
that enables comparative and efficient review of applications.

The FWC developed a grant application packet (attached) which included a cover letter to explain the grant
process and funding priorities,an application to solicit relevant information about the project,and a copy of the
expenditure criteria established by California law for the Fish and Wildlife Propagation Fund. In the fall of
2004, application packets were sent to the Fish and Wildlife Committee mailing lists and to anyone who
requested one. A press release was issued on the availability of funding for fish and wildlife projects. A total of
40 funding applications requesting a total of $351,322 were received during the application period, which
ended December 31,2004.This was the highest number of applications and highest cumulative dollar request
received by the FWC in its history. The Fish and Wildlife Committee discussed the funding applications at its
January, February and April 2004 meetings. Some applicants came to our meetings to talk about their
applications during the public comment section of the agenda. One applicant was invited to the March meeting
to answer questions that were raised by the FWC members. The FWC acknowledges the hard work that went
into all received applications and appreciates the commitment to improving the resources of the County
demonstrated by these applications.
The amount of funds currently in the Fish and Wildlife Propagation Fund is much larger at present than in
years past. The increase may be partially due to increased awareness among agencies enforcing fish and
game regulations and that the Fish and Wildlife Propagation Fund is an appropriate account to deposit fine
a,
monies resulting from negotiated settlements of regulation violations.
On April 20, 2005 the Fish and Wildlife Committee approved the following recommendations to the Board of
Supervisors regarding applications for funding from the Fish and Wildlife Propagation Fund(each was voted
on independently and the results of these votes are listed for each recommendation):
1) Require three general commitments from all projects receiving funding from the Fish and
Wildlife Propagation Fund: a) return funds if the project is not performed; b) provide
documentation and/or accounting to show that funds were spent for the purpose described in
applications;and c)provide a brief summary report on the progress or results of the project by
December 31, 2005 [unanimous (6 ayes/0 noes)]
2) Appropriate$11,000 to Walnut Creek Open Space Foundation for Heather Farm Park Nature
Area Restoration Project. [unanimous]
3) Appropriate $10,000 to Contra Costa Sheriff's Department for CA Delta Fish/Game
Enforcement [unanimous].
4) Appropriate $10,000 to EBMUD Lafayette Reservoir for Lafayette Reservoir Fish Spawning
Habitat Enhancement. [5 ayes/1 abstention (Abbors)]

No action was taken on an application from the Contra Costa Mosquito and Vector Control District
for$4,390 for Evaluation of Stocking Success of Sacramento Perch Using Three Life History Stages
because two members(Pellegrini and Belleci)abstained and the remaining four members present
recommended funding. However, five votes are required to make a recommendation. This
application will be reconsidered at the May FWC meeting.
The Fish and Wildlife Committee did not recommend funding for the following applications(a brief,
partial explanation is provided below):
• Wildlife Education Monarch Butterfly Rearing and Release Project,proposed by Carquinez
Regional Environmental Education Center. The Committee has funded this project
several times in the past. It recommends using a different kind of plant to raise larvae to
make the operation of the project more sustainable. [0 ayes/6 noes]
• Pampas Grass Eradication Campaign Project, proposed by San Pablo Watershed
Neighbors Education and Restoration Society. The proposed project focuses on privately
owned properties and it was felt the project would not convey as much benefit to public
resources as the recommended projects. [0 ayes/6 noes]
• Mira Vista Field proposed by Mira Vista Neighborhood Association. The proposed project
would provide benefit to the homeowners association, but benefits to the greater public
were not as significant as for other applications. [0 ayes/6 noes]
• Fernandez Ranch Clean-up proposed by Muir Heritage Land Trust. The proposed site has
a history of illegal dumping. The County has spent significant funds and resources to
remove the refuse. The Committee felt that it is as important to patrol the site to prevent
illegal dumping from happening as it was to cleaning up the site after illegal waste
accumulates. The proposal lacked information on how the organization plans to prevent
future illegal dumping.The Committee felt other proposals would provide more benefit to
the fish and wildlife of the County. [0 ayes/6 noes]
• Upper Wildcat Creeks at Tilden Regional Park Golf Course Revegetation by Urban Creeks
Council. The proposed property is maintained by the American Golf Course Corporation.
The Committee felt that there may be an opportunity to use funds from the Corporation to
restore the site and therefore favored other applications over this one. [0 ayes/6 noes]
• Wild Bird Discoveries by Native Bird Connections. The Committee has funded this same
project several times in the past and felt the project would not convey as much benefit to
public resources as other proposals the Committee decided to recommend for funding [0
ayes/6 noes]
• Salmon Acclimation by Fishery Foundation of CA. The Committee felt that the proposed
project does not significantly improve fish habitat, compared to other proposals that have
been reviewed. [0 ayes/6 noes]
• Museum Display by Diablo Valley College. The proposal did not include information on
how this display would be accessible to K-12 children--a key segment of the target
audience. Other non-profit organizations already have similar kinds of wildlife education
programs in central Contra Costa County. The Committee felt other proposals would
provide more benefit to the fish and wildlife of the County. [0 ayes/6 noes]
• Bardados Slide Repair and Erosion Control by City of San Ramon. This is a cost sharing
maintenance project between the homeowners association and the city. The proposal
lacked information on how the greater public would benefit from the project. The
Committee felt other proposals would provide more benefit to fish and wildlife resources in
the County. [0 ayes/6 noes]
• Incubation Project to Establish Swainson's Hawk Habitat Along Kellogg Creek by the
Agricultural Trust of Contra Costa County. The proposal lacked information on project
readiness. Other proposals that the Committee recommends for funding are more ready
for implementation. [0 ayes/6 noes]
• Enhancing Watershed Outreach and Education Efforts in the Southern Suisun Bay
Watershed and Marsh Creek Watershed by the Contra Costa Resource Conservation
District. The proposal lacked sufficient information on target population and how people
and natural resources would benefit from using the proposed education materials. Other
applications for public education projects were judged to carry greater benefits. [0 ayes/6
noes]
• Marsh Creek Fish Passage Project by Natural Heritage Institute. The proposal lacked
information on how the project intends to improve the upstream habitat for the survival of
fish after the fish cross the blocked fish passage area. [0 ayes/6 noes]
• Native Plant Garden by Diablo Valley College. The proposal lacked information on how
this project would provide a habitat for fish and wildlife for the greater public. Other
proposals were deemed to convey more benefit to public resources. [0 ayes/6 noes]
• Service Learning Traditional Ecological Knowledge by Diablo Valley College. The
proposal lacked information on service learning. The proposed signage does not include
any environmental education information. The Committee felt other proposals would
provide more benefit to the fish and wildlife of the County. [0 ayes/6 noes]
• Pond Aeration Project by Diablo Valley College. The proposal lacked information on how

this project would contribute in a significant way to the habitat resources of the County.
The Committee felt other proposals would provide more benefit to the fish and wildlife of
the County. [0 ayes/6 noes]
• McNabney Marsh Viewing Platform Blind by Mt. View Sanitary District. The proposal
lacked information on how many people would.visit the platform every year to learn about
birds in the area. The Committee felt other proposals would provide more benefit to the
fish and wildlife of the County. [0 ayes/6 noes]
• Gardens at Heather Farm Native Plant Propagation Project by Gardens at Heather Farm.
The proposed project lacked information on how the greater public can be benefited from
the project. Other proposals were judged to convey more benefit to public resources. [0
ayes/6 noes]
• Alhambra Creek Restoration Projects with Contra Costa Students—A Project of the Earth
Team Restoration Initiative by Earth Team. Other similar environmental education
programs are already available in the central County. Consequently, the Committee felt
other proposals would provide more benefit to the fish and wildlife of the County. [0 ayes/6
noes]
0 Martinez Unified School District. The project proposal lacked project readiness. Other
proposals that the Committee recommends for funding are more ready for implementation.
[0 ayes/6 noes]
• Construction of an Outdoor Aviary to House a Great Horned Owl by Corvid Connection.
Committee felt that it was not appropriate to use the Propagation Fund to build a fixture to
take care of one injured bird at a private residence. The Committee felt other proposals
would provide more benefit to the fish and wildlife of the County. [0 ayes/6 noes]
• Vegetation Management Video Project by The Cannonball Express. The Committee
concluded that the focus of the video on fire management to protect homes was not
consistent with the eligibility criteria established by state law for expenditures from the
Fund. [0 ayes/6 noes]
• Invasive Plants — Identification, Early Detection and Management by Alameda, Contra
Costa Weed Management Area (MOU between many entities in CCC and Alameda
County, including Depts. of Agriculture, Farm Bureaus, Public Works Depts., Resource
Conservation Districts, Cattleman's Association, EBMUD, EBRPD, CA Native Plant
Society. The Committee felt that government agencies are already responsible for
educating the public and employees about preventing the spread of invasive species and
therefore there may an opportunity to use other, internal sources of funds. The Committee
felt other proposals would convey more benefit to the fish and wildlife of the County. [0
ayes/6 noes]
• State of the Estuary Conference by SF Estuary Project(SFEP). The proposed project has
a Bay Area wide scope and does not directly benefit the fish and wildlife of Contra Costa
County. The Committee felt other proposals would provide more benefit to the fish and
wildlife of the County in a more direct way. [0 ayes/6 noes]

The Contra Costa County Fish and wildlife Committee is pleased to announce the availability of funds from the
Contra Costa County Fish and Wildlife Propagation Fund. The Fish and Wildlife Committee requests the
submission of completed Funding Applications(attached)by December 31, 2004. Recommendations of the Fish
and wildlife Committee will be forwarded to the Contra Costa County Board of Supervisors,which maintains final
decision-making authority for expenditures from the Fund. Successful applicants may anticipate receiving:funding
awards by the spring of 2005.
The Contra Costa County Fish and Wildlife Propagation Fund is entirely supported by fine revenues which result
from violations of the Fish and Game Code and Title 14 of the California Code of Regulations in Contra Costa
County. Expenditures made from the Fund must benefit the fish and wildlife resources of the County. Projects
awarded funds from the Fish and wildlife Propagation Fund must meet the requirements of Section 13103 of the
Fish and Game Code (attached) which describes the types of projects that may be eligible. Though all projects
which meet the requirements of Section 131.03 will be considered, the Fish. and Wildlife Committee strongly
encourages applications relating to activities to protect and conserve fish and wildlife,including improvement offish
and wildlife habitat,public education about fish and wildlife conservation,and scientific fish and wildlife research in
Contra Costa County. The Fish and wildlife Committee generally does not recommend funding for operating costs
and overhead. The fund also needs to be expended by December 31, 2005.
The Committee expects to recommend awards to several applicants. However, it is possible that a particularly
excellent proposal will be recommended to receive a large portion of the total available funds. Awardees will be
asked to provide a summary of the outcomes of the project and an explanation of how awarded funds were spent.
During the 2003/2004 grant cycle a total of$70,263 was awarded to 12 projects.The awards ranged from$1,800 to
$12,000. The Fish and wildlife Committee appreciates your interest in this opportunity to improve the fish and

13103. Expenditures from the fish and wildlife propagation fund of any
county may be made only for the following purposes:
(a) Public education relating to the scientific principles of fish and wildlife
conservation, consisting of supervised formal instruction carried out pursuant to a
planned curriculum and aids to education such as literature, audio and video
recordings, training models, and nature study facilities.
(b) Temporary emergency treatment and care of injured or orphaned wildlife.
(c) Temporary treatment and care of wildlife confiscated by the department as evidence.
(d) Breeding, raising, purchasing, or releasing fish or wildlife which are to be released
upon approval of the department pursuant to Sections 6400 and 6401 onto land or
into waters of local, state,, or federal agencies or onto land or into waters open to the
public.
(e) Improvement of fish and wildlife habitat, including, but not limited to, construction
of fish screens, weirs, and ladders; drainage or other watershed improvements;
gravel and rock removal or placement; construction of irrigation and water
distribution systems; earthwork and grading; fencing; planting trees and other
vegetation management; and removal of barriers to the migration of fish and
wildlife.
(f) Construction,maintenance, and operation of public hatchery facilities.
(g) Purchase and maintain materials, supplies, or equipment for either the department's
ownership and use or the department's use in the normal performance of the
department's responsibilities.
(h) Predator control actions for the benefit of fish or wildlife following certification in
writing by the department that the proposed actions will significantly benefit a
particular wildlife species.
(i) Scientific fish and wildlife research conducted by institutions of higher learning,
qualified researchers, or governmental agencies, if approved by the department.
(j) Reasonable administrative costs, excluding the costs of audits required by Section
13104, for secretarial service, travel, and postage by the county fish and wildlife
commission when authorized by the county board of supervisors. For purposes of
this subdivision, "reasonable cost" means an amount which does not exceed 3
percent of the average amount received by the fund during the previous three-year
period, or three thousand dollars ($3,000) annually, whichever is greater, excluding
any funds carried over from a previous fiscal year.
(k) Contributions to a secret witness program for the purpose of facilitating enforcement
of this code and regulations adopted pursuant to this code.
(1) Costs incurred by the district attorney or city attorney in investigating and
prosecuting civil and criminal actions for violations of this code, as approved by the
department.
(m) Other expenditures, approved by the department, for the purpose of protecting,
conserving,propagating, and preserving fish and wildlife.

Description of Project:
Kellogg Creek is one of only two creek areas in Eastern,Contra Costa County where an appropriate riparian
habitat(bordering on productive agricultural areas)suitable to Swainson's hawk nesting and breeding can
potentially be re-established. Applicant(Agricultural Trust of Contra Costa County, or"ATCCC")currently
holds a conservation easement on one land parcel boarding Kellogg Creek and is in late-stage negotiation on a
second parcel in close proximity. Landowners of both parcels are committed to conservation and supportive
of planned measures to enhance the conservation value of their properties in perpetuity. Further, these
landowners are supportive of research and educational programs to advance awareness,understanding and
involvement in all aspects of conservation in Contra Costa County,where habitat conservation efforts are only
recently beginning to receive broad-based support. They have undertaken programs to increase the
conservation value of their properties and this project is intended to leverage those accomplishments and the
unique location of their properties to establish a much larger,co-operative research,educational and
conservation program specific to Swainson's hawk. Such a project will:
I- memorialize the conservation easements these landowners have granted on their properties;
2. initiate a broad,,co-operative effort involving these landowners,other conservation organizations,
researchers,local school districts and individual supporters in support of habitat conservation and
enhancement; and
I become a launching point for other,broader co-operative efforts to promote habitat conservation in the
rapidly developing East County area.
Applicant believes this project meets the requirements of Section 13103 of the Fish&Game Code in these
ways;
Item(a): public education relating to wildlife conservation through a supervised formal instructional
program carried out pursuant to a planned curriculum;
Item(c) improving wildlife habitat through watershed improvements,including clearing and
restoration of portions of Kellogg Creek, and the planting of trees and other native vegetation
compffinentary to Swainson's hawk nesting and breeding habitat;
