IN THE MATTER OF REQUESTING THE CALIFORNIA EPA TO RESOLUTION NO.2005/285
UNIFY LEAD AGENCY OVERSIGHT CONTROL IN THE
DEPARTMENT OF TOXIC SUBSTANCES CONTROL FOR THE
HAZARDOUS SUBSTANCE CLEANUP AT THE U.C.FIELD
STATION AND ZENECA SITES IN RICHMOND
Whereas,there is currently underway the clean-up of the Zeneca toxic site(known as the Meade Street Operable Unit
located on the Zeneca/Simeon-Cherokee property)and the UC Field Station site in the City of Richmond, Contra Costa
County, and approximately 1,300 residential units and other types of development are proposed on these sites; and
Whereas,chemical manufacturing industries were active on these sites for nearly a century,and contaminants include
large quantities of buried acidic iron pyrite residues, as well as a variety of heavy metals, volatile organic compounds,
PCB's, and pesticides, making these sites among the more complex sites that have been addressed in Contra Costa
County; and
Whereas,over the past 20 years,ahe Department:of Toxic Substances"Control(DTSC)has been the lead agency in the
remediation of all toxic sites in Contra Costa County that have::been this complex;and
Whereas, a Joint PubliC.:Hearing of the Assembly Committee on Environmental Safety&Toxic Materials and the

Select Committee on Environmental Justice was held on November-6 2004`to:review the oversight of the
Zeneca/Simeon-Cherokee property and concluded that community safety woul 'be bests"e:rved with total DTSC
jurisdiction over this clean*up project;and
Whereas, on NO:`vvember 8,2004,Cal EPA agreed to facilitate a split jurisdiction with DTSC' jurisdiction limited to
the Zeneca/Cherokee-Simeon_``upland"property and the San Francisco lay Reg1on-Water'Qualty Control Board
(SFBRWQCB conti iuing cleanup oversight of the Zeneca/Clerokee-Simeon marsh property; and
Whereas,the UC Field Station is also undergoing..cleanup,contains 00ntaininants s mi ar tlo tosd on the
Zeneca/Cherokee-Simeon site, also has plans for long term redeveloplerit, and:,9,C.urree.".ntl.y under the lead agency
jurisdiction 10fithe SFBRWQCB;::and:;
Whereas,the UC Field Station:aiideneca/Cherokee-Simeon-sites have:-connected.use:and po 1u a" histones, and
continued split lead agency jurisdiction has led to gaps.and perceived risks,.:aild a unified lead agency jurisdiction can
achieve consistency and coordination witht�ut losing the.consultative expex#ise o-f the other`agency; and
Whereas, Contra Costa:. -County's Public Health Directors Bendel;Brunner, has previously requested the California
Environmental Protection.Agency("Cal EPA")to designateTC'as:the load agency to oversee the hazardous
substance cleanup of these s tes and that such'transfer ol"jurisdiction is in he public mterest;'and
Whereas,the City of Richmond has also requested that Ca1EPA designate DTSC as the lead agency to oversee the
hazardous substance cleanup of-these..sites.
NOW,THEREFORE,BE--JT RESOLVED that.the Contra Costa County Board of Supervisors hereby requests that
the California Environmental Protection Agency designate the Department..01."-"'oxic Substances Control as the lead
agency to oversee the hazardous substance cleanup of the Zeneca/Sirr eon-Cherokee and UC Field Station sites; and
BE IT FURTHER RESOLVED that the Contra Costa County Board of Supervisors hereby requests the Department
of Toxic Substances Control to adhere to the California Health and Safety Code and to consult with and defer to the
San Francisco Bay Region Water Quality Control Board regarding water quality impacts, so that the expertise of both
agencies can be fully utilized.
